BOARD OF ADJUSTMENT DECISION Request of Gary Grimm for a special exception ) use, Article 8.4 B(3) (b) , Highway Setback, ST. ) A-35-83 CROIX COUNTY ZONING ORDINANCE. Location: SW- ) November 22, 1983 of NWk of Section 36, T28N-R18W, Town of ) Kinnickinnic. ) The St. Croix County Board of Adjustment conducted a public hearing on November 22, 1983 to consider the request of Gary Grimm for a special exception use, Article 8.4 B(3) (b) , Highway Setback, ST. CROIX COUNTY ZONING ORDINANCE. The St. Croix County Board of Adjustment conducted an on site inspection of the site in question. After inspection, the St. Croix County Board of Adjustment entered an Executive Session to discuss the request. After returning to open session, the following decision was rendered. Motion by Supervisor Meinke to grant approval of setback with stipulation that new house shall not be closer to the road than present structure. Seconded by Supervisor Stephens. Motion carried. Robert'Stephens, Secr tar Y St. Croix County Board of Adjustment RS:HB:mj BOARD OF ADJUSTMENT MEETING AND HEARING November 22, 1983 10:00 a.m. - 3:30 p.m. Meeting called to order by Chairman Meinke at 10:00 a.m. in the Courthouse, Hudson, Wisconsin. Present were Supervisors Meinke and Stephens. Absent Supervisor George, Minutes of the October hearing and meeting approved. Chairman Meinke called the hearing to order, Zoning Administrator read notice of hearing as published in the county and local newspapers. 1. Article: 3.1 2, St. Croix Riverway District Appellant: Joan Kennedy Location: SE4 of SE4, Section 35 T30N-R2OW, Town of St. Joseph 2. Article: 8.5 C, Advertising Sign Appellant: Sk 0 1 and Outdoor Advertising, Inc. Location: NE4 of SE4, Section 23 T28N-R19W, Town of Troy 3. Article: 8.4 B (3) (b) , Highway Setback Appellant: Gary Grimm Location: SW4 of NW4, Section 36 T28N-R18W, Town of Kinnickinnic 4. Article: 8.4 F (1) (c) , Driveway Separation . Appellant: William B. Loman Location: SE4 of SW4, Section 22 T30N-R2OW, Town of St. Joseph 5. Article: 8.4 F (1) (c),Driveway Separation Appellant: James Brockpahler Location: SW4 of SW4, Section 33 T31N-R17W, Town of Stanton 6. Article: 8.4 B (4) (b) , Setback from Town Road Appellant: Terry Weiss Location: NE4 of SE4, Section 31 T31N-R17W, Town of Stanton Mrs. Joan Kennedy, R. R. 2, Riverview Acres, presented her request to leave a hot tub (therapy pool) , explaining the reasons. Zoning Administrator read letter from DNR. Mr. Richard Thompson spoke in favor of the hot tub in the present loca- tion. He feels that all adjoining land owners should be able to comment. Mr. Steve Johnson, MN-WI Boundary Area Commission had ques'.ions of Mrs. Kennedy. He suggested that the Board not act on the request until after the rules have been put into effect. Ed Wasik, Skoglund Advertising, presented the request to construct a sign on a commercial parcel of land in the Township of Troy. Zoning Administrator read letter from adjoining land owner objecting to the sign. Mr. Gary Grimm presented his request to construct a new home on the old foundation of a farm house. Mr. William Loman presented his request to construct a driveway that would be less than 200 feet from the adjoining driveway. Mr. Loman explained the reason for the driveway location showing plans and photos. Mr. Steve Johnson, MN-WI Boundary Area Commission, has no objections. Mr. James Brockpahler presented his request to have a driveway that would be approx- imately 110 feet from an adjoining driveway. Mr Chris Bethke, Chairman of the Town of Stanton, has no objections to the driveway location. Mr. Terry. Weiss presented his request to construct a house that would be 90 - 100 feet from the eenterlirie of a tc.n Lead. ",ris Bethke, Town Chairman, has no objections. Motion by' Supervisor Stephens to recess the hearing to inspect all properties. I F Board returned to session to render the following decisions: 1. Joan Kennedy: Motion by Supervisor Stephens to approve, contingent on receipt of statement from aecerrablc --di—I doctor that she needs the hydrotherapy pool for medical purposes, provided such proof is i-- the hands of the St. Croix County Zoning Administrator on or before January 1 , 1984. Seconded by Supervisor Meinke, Motion carried. Vote to approve as motion reads: Meinke, yes; Stephens, yes. 2. Skoglund Outdoor Advertising: Motion by Supervisor Stephens to deny the re uest as sign q � is not relative to services and merchandise sold by Dick & Bob's Garage exclusive)Y and due to objections of adjoining land owners. Seconded by Supervisor Meinke. Motion carried. Vote to deny: Meinke, Stephens,Y � Y p ns, yes. 3. Gary Grimm: Motion by Supervisor Meinke to grant approval of setback with stipulation that new house shall not be closer to the road than present structure. Seconded by Supervisor Stephens. Motion carried. Vote to approve: Meinke, yes; Stephens, yes. 4. William Loman: Motion by Supervisor Stephens to grant approval with stip- ulation that temporary driveways be removed and permanent driveway to be constructed in such a manner that will cause no damage to adjoining owners property. Zoning Administrator is to be notified upon completion for approval. Seconded by Sup- ervisor Meinke. Motion carried. Vote to approve: Meinke, yes; Stephens, yes. 5. James Brockpahler: Motion by Supervisor Meinke to grant permission to construct a driveway. The east edge of the driveway shall be located 5 feet west of the property line separating the Brockpahler-Casey property. The driveway is to be no less than 24 feet and no more than 30 feet wide. Culvert with endwalls to be installed according to St. Croix County specifications. Zoning Administrator to inspect driveway upon completion. Seconded by Supervisor Stephens. Motion carried. Vote to approve with the above conditions: Meinke, yes; Stephens, yes. 6. Terry Weiss: Motion by Supervisor Stephens to grant approval of the 90- 100 foot setback from a town road. Seconded by Supervisor Meinke. Motion carried. Vote to approve: Meinke, yes; Stephens, yes. The next scheduled hearing date is December 27, 1983. Motion by Supervisor Stephens to adjourn. Seconded by Supervisor Meinke. Motion carried.
