On behalf of the property owner of the above parcel, you provided the zoning

71'-386-4675 office with a copy of plans for a proposed commercial accessory structure that
is intended for use as cold storage. The new building will replace an older
cabin (habitable dwelling) that had previously been connected to the existing
Private On-site Wastewater Treatment System (POWTS), which also services
the Phaneuf-Vanasse American Legion Post III restaurant/bar.
According to your stated desc ri pt ion, the project involves razing t h e existing

cabin and filling in the basement prior to construction of the pole building on a
slab foundation. The existing building sewer will be stubbed and left available
for future connection, but there is no plumbing in the proposed building. There
are no permit records on file for the original septic system, but it consists of two
1000-gallon septic tanks and an 800 gallon pump chamber that discharges to
an in-ground seepage bed. This project will not result in an increase of the
design wastewater flow, but the POWTS will have to be evaluated by a
licensed plumber and a reconnection permit obtained if future plans involve
adding sanitary facilities. Reconnection permit #STC0113 was issued in 2007
and provides a site plan indicating the locations for POWTS components on
this parcel.
If this POWTS should fail at any time in the future, the system will be need to
be inspected by a licensed plumber or POWTS maintainer to determine if it
must be replaced according to state code requirements in effect at that time.
You also confirmed that the proposed building would be 160 feet from the
centerline of County Rd. V V. This location will exceed the minimum setback of
100 feet to the centerline of the road per St. Croix County highway department.
The 5-foot minimum side and rear-yard setbacks for the accessory structure

AND ORDER OF THE ZONING BOARD OF ADJUSTMENT
ST. CROIX COUNTY, WISCONSIN
Case: 21-96

FINDINGS OF FACT
Having heard all the testimony, considered the entire record
herein, and conducted an on-site inspection, the Board finds the
following facts:
1. The applicant(s) are Gabriele Schulberg and Anita Bartkey.
2 . The applicant(s) on March 27 , 1996, filed with the Zoning
office an application for a special exception use request for
a gift, antique/craft store.
3 . Phaneuf-Vanasse Post #3 (American Legion) is the owner of the
property which is the subject of this application which is
located in the SW; of the NE, of Section 5, T30N, R19W, Town
of Somerset, St. Croix County, Wisconsin.
4 . The subject property is currently used for nothing.
5. This property is zoned commercial under the current zoning
code.
6. Nelson stated this was a request for a gift, antique/craft
store. Nelson introduced Exhibit #1, an introduction letter
stating what they are requesting. It was noted no
correspondence had been received from the township; Nelson
then presented Exhibit #2 , a site plan identifying the
American Legion in Somerset and an old run down building;
Exhibit #3 , a floor plan of how the lower level is to be
sited; Exhibit #4 , a floor plan of the upper level; Exhibit
#5, a half section map from the real property department
identifying surrounding landowners.
7 . Bradley asked if this property was zoned commercial . Nelson
stated yes.
8 . Anita and Tom Bartkey, being duly sworn, stated they are from
New Richmond. Mr. Bartkey went on to state they are the
owners of the little cottage which was a gift store at one
time and they had fixed it up and repaired it.
9 . Bradley asked the Bartkeys how long they owned the property.
Mr. Bartkey stated they don't own it, it is owned by the
American Legion.
10. Nelson asked the Bartkeys to identify where the septic system
is.
11. Bradley noted the Board cannot make a decision without
township approval, but may be able to conditionally approve
it. Filipiak asked if they could contact the township. Mr.
Bartkey said yes.
12 . Filipiak questioned Exhibit #2 and Mrs. Bartkey pointed out
the areas in questions. Filipiak then labeled their building
as A, the legion building as B and the septic as C.
13 . Filipiak questioned the upstairs. Mrs. Bartkey clarified
there is an upstairs and the lower level is a walkout
basement.
CONCLUSION OF LAW
The Board Concludes that:
1. The Board of Adjustment has authority under Section 17 . 70 (5)
(c) 4 to approve special exception uses.
2 . Special exception uses may be terminated as per 17 .70 (7) (d)
of the St. Croix County Zoning Ordinance if the plan or the
conditions of the decision are not followed.
3 . Section 17 . 18 (a) allows a special exception for retail sales.
DECISION
On the basis of the above Findings of Fact, Conclusion of Law, and
the record herein, the Board approves the applicant's request for
a retail sales/antique shop on the following vote:
Chairman Bradley yes
T. Filipiak yes
A. Jensen yes
C. Mehls yes
with the following conditions:
1. This decision expires on May 23 , 1997 .
2 . The applicant is responsible for obtaining any permit or
approval required for the project by municipal , town or county
zoning ordinances before starting the project.
3 . The applicant must provide confirmation that he has completed
the permit process with all other regulatory agencies.
4 . The Board of Adjustment may change or revoke this decision if
the project becomes detrimental to the public interest.
5. The applicant must keep a copy of this decision at the project
site at all times until the project has been completed.
6. Tom Nelson, Zoning Administrator, shall be notified prior to
beginning the project. Call him at (715) 386-4680 so that
compliance inspections can be made.
7 . Accepting this decision and beginning the project means that
the applicant has read, understands, and agrees to follow all
conditions of this decision.
APPEAL RIGHTS
This decision may be appealed by any person aggrieved by filing an
action in certiorari in the circuit court of this County within 30
days after the date of filing shown below. The County assumes no
liability for and makes no warranty as to the legality of any
construction commenced prior to the expiration of this 30-day
period or the identity of any person who may claim to be aggrieved
by this decision.
