The septic system easement was established prior to the sale of Lot 37 and is recorded on the warranty deed. The soil report for the mound system was completed 7/22/96, so the easement had already been surveyed at that time. The mound septic system belongs to the owner of lot 37 and any damage to the soil cover or soils within 15 ft. around the mound could affect its operation. You might be liable for repair/replacement of the system if you damage any portion of it. The easement includes access to work on the mound and its component forcemain, tanks, etc. so any landscaping along the original lot line between 25&37 could legally be removed if it was necessary to dig up the pipes, etc. on the mound. This is not much different than what happens when a drainage easement crosses property;the area within the easement is set aside for a specific purpose (stormwater runoff, utilities, septic system)and creates access for maintenance. The setbacks for building on Lot 37, including >20% slopes behind the house, limited the area available for septic installation and I suspect that's why the developer opted to create the easement. There were no other soil reports filed for Lot 37, but Lot 25 does have 2 soil reports on file that indicate a conventional, in-ground system may be installed. The lot itself didn't perc for a gravity field, but they didn't perc it back by where the house would go (as far as I know). Apparently it did perc for a conventional system though (he estimated the cost at$6k).
