MOUND RESTRICTION WAIVER
The Department has reviewed the above-referenced submittal.
The Department has reviewed the request to waive the restriction on the
above referenced property. This request is supported with information that
indicates this property is acceptable for development with a soil
absorption type private sewage system. Therefore, the Department waives
the above mentioned restriction and has no objection to the development of
this property provided that the private sewage system is constructed in
• accordance with the applicable requirements of Chapter Comm 83, Wisconsin
Admistrative Code.
Conditional approval is hereby granted to waive the mound system restriction
provided the following condition(s) are met:
1. That the release and waiver of this lot restriction be incorporated into a
correction instrument under s. 236.295, Wis. Stats. This should eliminate
future questions regarding the restriction on the recorded plat.
This approval does not include review of the design for the proposed private
sewage system. All other applicable criteria, as contained in chapter .Comm 83,
Wisconsin Administrative Code, must be met prior to issuance of the sanitary
permit for a project at this site.
All permits required by the city, village, township or county shall be obtained
prior to installation.

Dear Mr. Cook:
I'm writing to request that a correction affidavit be recorded removing lots: 16, 24, 49, &
53 in Troy Village, from the deed restriction regarding mound systems. I will contact you
again when additional lots in Troy Village received waivers from the State. I don't believe
it's necessary to record an affidavit with each waiver.
Note: Correction instruments must be approved by the town board and must be notarized
recording in the register of deeds office (I believe you have an agreement with the

town of Troy regarding this matter). It is recommend, but not required, to record waiver
releases on the deed.
Please provide the Zoning Office with a copy of the recorded correction affidavit. We will
make copies and place one in each property file.
Since this is an integral part of the approval process its the developer's responsibility to
follow through with the recording of the correction instruments. I will assist in any way to
help this approval process go as smooth as possible.

location must be adequate to support the below grade system conclusion.
Information collected on adjoining lots maybe used to help prove enough area
exists on the lot in question.
A second way to go is to preplan the lot under Comm 85.04(7) using Table
85.04. This means doing enough soil and site work to show that there is at least
2,000 ft2 for the initial SAS and 2,000 ft2 for the replacement SAS. So there must
be at least 4,000 ft2 of continuous suitable soil area. The areas must be large
enough to support four bedroom trench designs, and setbacks must be
considered.
A third way, under Comm 85.04(7)(c), allows further reductions in continuous
suitable soil areas. The code states that if a system can be installed in complete
compliance with Comm 83 the department can approve greater reductions in
depth and area of the minimum continuous suitable soil area. However, two
contiguous four bedroom trench type SAS areas must still be identified. The
detail required for this submittal is similar to that required for sanitary permit
submission. We need to know exactly where the SAS will be located, where the
house and well will be, and that there are no other setback encumbrances that
would adversely affect SAS placement.
This memo may not have covered every aspect of mound waiver submittals, but
should be helpful in your submissions for Troy Village.

SUBJECT: Troy Village - Mound Waivers
I just received the county onsite for Lot 49 in Troy Village. However, the review
cannot proceed since no fees have been received by the Plat Review Section in
Madison.
There still seems to be some confusion regarding what's required to obtain a
waiver to a mound restriction so I will try to outline our requirements,
The fees are $80.00 per lot. Fees must accompany the submittal to DOA Plat
Review. All information and fees are sent to:

Unless a waiver is obtained, lots restricted to mound systems on a recorded plat
may only use mound system technology for onsite waste disposal pursuant to
Comm 85.04(5), Wis. Adm. Code. However, the restriction can be waived if it
can be shown that the lot meets the requirements of Comm 85.03 and Comm
85.04, Wis. Adm. Code.
Each submission must be complete (i.e. soil's information, drawings, site plan,
calculations, and supporting information for the lot in question). Do not
reference documentation or materials included in other submissions.
Basically, to obtain a mound waiver you need to show that the lot meets
requirements for a below grade system in one of three ways. The first and most
general way is to show that there is at least 10,000 ftZ of continuous suitable soil

cover of 42 inches over the distribution pipes.

a mound type POWTS on the above referenced property based on documentation of a recent
soil evaluation by James K. Thompson dated September 06, 2013 which indicates the tested
area on Lot 51 is suitable for an in-ground dispersal unit.
Therefore, the Division hereby waives the above-mentioned restriction and has no objection to
the use of an in-ground POWTS System, provided that the system is constructed in accordance
with the applicable requirements of chapter SPS 383 Wisconsin Administrative Code.
Note: All requirements of SPS 383 shall be met prior to Sanitary Permit issuance.
All necessary Plan Approvals and Permits required by the City, Village, Township, County or
other governmental agency shall be obtained prior to installation. This release does not
guarantee the outlot above is buildable. City, Village, Township, County or other governmental
agencies may have further rules restricting building and/or POWTS placement.
We recommend that this release be incorporated into a Correction Instrument under s. 236.295,
Wis. Stats. to eliminate future questions regarding the use of a POWTS on Lot# 51 . You may
want to contact Plat Review concerning those procedures.

replacement system is a mound system. This recommendation will eliminate future questions
regarding the restriction on the recorded plat.
2. Both absorption system areas are preplanned, and as such no development shall occur in the
preplanned area and development adjacent to the preplanned area shall meet appropriate setbacks
so as not to jeopardize private sewage system installation. Pursuant to Com 87.04 (7)(a)2., Wis.
Adm. Code, any changes to the location or extent of the preplanned area will require Department
review and approval.
3. The mound replacement area is to include a 25-foot setback area down slope of the mound perimeter
that, along with the mound area itself shall not be subject to soil compaction or alteration during
building construction. The area for the mound system must be fenced off to prevent traffic across the
site during building construction. The surface grade elevation in the area for the mound shall not be
cut or filled.
4. The system elevation for the two subsurface trenches shall be 88.00 feet for the trench adjacent to the
east lot line(trench A)and 87.00 feet for the next trench west(trench B). When using aggregate and
pipe in the absorption area, the maximum finished grade for trench A is 92.08 feet, and for trench B
maximum finished grade is 91.08 feet.
This certification does not include review of the design for the proposed private sewage system. All other
applicable criteria, as contained in chapter Comm 83, Wisconsin Administrative Code, must be met prior
to issuance of the sanitary permit for a project at this site.
All permits required by the city, village,township or county shall be obtained prior to installation.

The Department has reviewed the request to release the mound restriction on the above referenced
property. The approval of this proposal is being put on hold until additional supporting information is
received:
1. The surface grade elevation of soil boring number 1 is not clearly indicated on the soil test report form.
2. There is insufficient information to make a determination as to the vertical separation available below
each soil absorption trench. Provide system elevations for each trench and the soil boring(s)that
supports the chosen elevation. None of the chosen system elevations will work with soil borings 4 and
5 and thus inadequate system area has been shown for the preplanned areas.
3. On the other hand, the area tested may contain 10,000 ft2 of suitable soil and may not have to be
preplanned in advance as per your request. If adequate area is available with 48 inches or more of
suitable soil below the mottled layer(B-5 is a problem)then the lot can be certified without
preplanning. See Comm 85.06(2)(f)1, and the one foot exception. Soil borings must be deep enough
to install the drain field entirely(12 inches)into the sandy material below the mottled layer. Keep in
mind that there are maximum depths of cover requirements too.

RE: Onsite soil verification, lot 23, 27-28, 60-61, 64 & 112 of Troy Village Subdivision, Sec. 19, Town of

Dear Leroy:
I have reviewed the soil reports for lots 23_�-2 nd 112 in Troy Village Subdivision, filed by
Tom Nelson, CSTM #227387 and have conrifications on the se lots. My findings have
verified that the soil conditions as reported by Mr. Nelson are accurately described. The soils on these lots
are suitable for subsurface sewage disposal with loading rates of 0.5/0.6 and 0.7/0.8 GPD/sq.ft.
I'm also concerned that a large portion of the tested area on lots 23, 27-29 and 112, was disturbed ate to
the fact that the borings got quite large during excavation and were open for such a long time. Specifically,
I'm concerned that when these borings are back filled, some of the subsoil will mix with the coarser soils,
thus affecting the infiltration rate.
