OF THE ZONING BOARD OF ADJUSTMENT
ST. CROIX COUNTY, WISCONSIN

FINDINGS OF FACT AND CONCLUSIONS OF LAW
Having heard all the testimony, considered the entire record herein, and conducted an
on-site inspection, the Board finds the following facts:
1. The applicant is John Neumann, whose address is 222 162nd St., Hammond,
Wisconsin 54015.
2. The applicant on June 25, 1998, filed with the Zoning Office an application for a
special exception permit to exceed one animal unit per acre of spreadable land. A
special exception is required under Section 17.14(6)(i) where animal units per acre
are exceeded.
3. John S. Neumann is the owner of the property which is the subject of the
application and is located in the SE 1/4 of the SE 1/4 of Section 19; the SW 1/4 of
the SW 1/4 and the E 1/2 of the SW 1/4 and the SW 1/4 of the NW 1/4 of Section
20, all in T28N-R17W, Town of Pleasant Valley
4. The subject property is presently used for crop production and raising dairy heifers.
5. The Town of Pleasant Valley approves of the application.
6. Mr. Neumann is asking for a permit to raise approximately 750 calves on his
property. The calves are brought to Neumann weighing about 300 pounds and he
raises them to 850 to 1,000 pounds and then returns them to the owner.
7. The nutrient management plan submitted indicates that Neumann has enough
land to spread the waste. He owns 224 acres and rents the rest from area
landowners. He has approximately twice as much land as is needed for spreading
the waste.
8. Land and Water Conservation has worked with Neumann on the 590 Plan for this
business. They recommend approval of the permit.
9. Land and Water Conservation recommends that any spreading that is in critical
areas (open water, wetlands or surface drainage conduits to water or wetlands) is
to be knifed into the soil immediately after spreading.
10. The following exhibits were introduced:

11. John Neumann, being duly sworn, stated that he is the owner of the property and
raises dairy heifers for area farms. After raising them to a certain size, he returns
them to the owners.
12. There are no plans to add more buildings. Neumann is remodeling some of the
existing buildings.
13. There will be no employees.
14. The proposed storage pits for the project will be large enough to hold all of the
waste generated over a 1 1/2 year period.
15. Approximately 75 to 80% of the feed that he uses is produced on his land. He
buys some dry hay and a small amount of grain. The trucks used to haul this feed
will not cause any traffic problem as it will be very minimum.
16. After reviewing the facts given, the Board of Adjustment finds that this special
exception application conforms with the requirements for granting a special
exception under 17.14(6)(i).
17. Special exception uses may be terminated as per 17.70(7)(d) of the St. Croix
County Zoning Ordinance if the plan or the conditions of the decision are not
followed.
DECISION
On the basis of the above Findings of Fact, Conclusions of Law, and the record herein,
the Board approves the applicant's request for a special exception permit to exceed one
animal unit per acre of spreadable land and has been approved on the following vote:

with the following conditions:
1. Manure applications to be immediately incorporated into the soil if less than
200 feet from critical areas (open water, wetlands or surface drainage
conduits to water or wetlands).
2. All required reviews and approvals to be obtained and forwarded to Zoning
Office.
3. Land and Water Conservation Office to be notified when pits are empty to
allow annual inspection of liner.
4. Annual review of 590 Plan by crop consultant with results to be forwarded
to Land and Water Conservation.
APPEAL RIGHTS
Any person aggrieved by this decision may file an appeal in St. Croix County circuit court
within 30 days after the filing date shown below, pursuant to sec. 59.694(10), Wisconsin
Statutes. St. Croix County assumes no responsibility for action taken in reliance on this
decision prior to the expiration of the appeal period. St. Croix County does not certify that
the identity of all persons legally entitled to notice of the Board of Adjustment proceedings
which resulted in this decision was provided to the County.
If an appeal is taken of this decision, it is the responsibility of the appellant to submit at
his/her expense a transcript of the Board of Adjustment proceedings to the circuit court,
which is available from Northwestern Court Reporters, Hudson, Wisconsin. It is the
responsibility of the Board of Adjustment to submit its record (file) of this matter to the
circuit court.
