After inspection of the Willard Ott property, motion by Chm.
Afdahl to approve the 50 foot setback from CTH "M". Seconded by
Supv. Luckwaldt, motion carried.

Hearing called to order by Chairman Afdahl at 10 :00 a.m. on May 25, 1976.
Preperit were Supvisors Afdahl, Luckwaldt and Pierson.
Zoning Administrator read notice of the hearings as published in the county
newspaper on May 6 and 13, 1976.
CASE 1. Howard Laventure (Robert Hinton) request to build 60' from a
12% slope; less than 1 acre net project area and a height variance not to
exceed 35 feet.
Attorney Douglas Zilz presented the case to the Board of Adjustment.
Calling on Howard Laventure and Robert Hinton. Mr. Thomas Muellner of the
Department of Natural Resources , Madison,lhad no objections. Mr. Steve
Kartak of Minn. /Wis4 Boundary Commission had no objections.
Questions were asked by the Committee. Being no further questions ,
Chairman Afdahl informed the petitioners that after inspection of the property,
• decision would be made and they would be notified of said decision.
CASE 2. Daniel Greenwald in• the Township of Troy requested to construct
• house to exceed the 25 feet in height requirement. Jack Greenwald presented
the case for his father who resides in Kansas. Mr. Jay Peterson, neighbor,
had no objections.
Questions by the Board members. Zoning Administrator explained that the
houses in the area are of the rambler type and there is no physical hardship
on this lot in order to have compliance of the 25 foot height restrictions.
Chairman Afdahl informed Mr. Greenwald that the Board will inspect the
property and then he would be notified of the decision.
CASE 3. Mr. Joseph Meyers , Town of Troy, requested to exceed the 25
foot restriction in the St. Croix Riverway District. Mr. Meyers telephoned
and withdrew his request.
CASE 4. Mr. Glen Fink, Town of Troy, requested to build a garage closer
to Marson Drive that highway setback permit. He would like to build 50 to 70
feet from the centerline of the road. Questions were asked by the Board.
Chairman Afdahl informed Mr. Fink that after inspection of the property,
the Board would render a decision and he would be notified.
CASE 5. Christian Hanson requested to set-up a hot mix plant in the
Township of Hammond on 80 acres of land that was rezoned industrial on May
18, 1976.
Mr. Hanson presented his request stating that the land has a gravel pit
on it and is centrally located in the County. Emmett O'Connell, Chairman of
Hammond Township, feels that the plant is needed and Hammond is centrally
located. Mr. Ralph EKAPwn, St. Croix County Highway Commissioner, explained the
need for the plant as it is centrally located. Mr.Clarence Johnson, Chairman
of Rush River Township , expressed the need for a plant in the area.
Attorney Don Faast of Spring Valley presented objections to the hot mix
plant for residents in the area. Kenneth Peterson explained that the
noise, dust and equipment travelling on the roads are a danger to the children.
Attorney Faast listed a number of stipulations that he believed should be
adhered to before granting approval.
Questions were asked by the Board members. Chairman Afdahl informed Mr.
Hanson that the Board would render a decision after inspection of the property.
CASE 6. Willard Ott in the Townshkip of Pleasant Valley requested to
build a pole type building closer to CTH 'M" than St. Croix County setback
ordinances permit. Mr. Ott has buildings closer to the road than the one he
wishes to construct. After constructing the new building, he will tear.
down the old structures .
Board to inspect the property before a decision is granted.

Dennis Bursch came before the Board to explain a measurement mistake he
made for his request to build closer to CTH "C ' than the setback requirements.
Mr. Bursch stated that the readings should have been 110 feet from the centerline
instead of 120 feet as originally requested.
Chairman Afdahl told Mr. Bursch that the Board would discuss the change and
advise him of the decision.
Hearing closed at 12 noon. Board recessed for lunch and inspection of
properties listed in the hearing.
Meeting reconvened at 1:30 p.m.
After inspection of the Laventure property, a motion by Supv. Luckwaldt
to deny the request of building 60 feet from a 12% slope.and building a
structure of more than 25 feet high from the basement floor. Seconded by
Supv. Pierson. Motion carried. Vote yes to approve; No to deny. Afdahl-No,
Luckwaldt-No, Pierson-no. Motion by Luckwaldt to approve construction of a
house on a net project area of less than one acre. Seconded by Afdahl.
Motion carried.unanimously. Afdahl+-yes, Luckwaldt-yes , Pierson-yes.
Motion by Luckwaldt to permit Laventure to build a single story dwelling
not to exceed 25 feet from the basement floor to peak of the roof or chimney
whichever is greater. Complete structure is to be no closer than 75 feet from
the 12% slope on the southwest lot line, no closer than 70 feet from the 12%
slope on the southeast corner and no closer than 40 feet from the 12% slope
on the east property line. Seconded by Pierson. Motion carried unanimously.

Inspection of the Glen Fink property. A motion,by_Pierson to grrant -a
setback variance of 75 feet from-the centerline -of.Marson Drive. Seconded
by Luckwaldt. Motion carried. Afdahl-yes, Luckwaldt-yes , Pierson-yes.
Inspection of the Greenwald property. Motion by Pierson to deny the
request to build a structure greater than the 25 feet in height requirements
from the basement floor to the peak of the roof or chimney whichever is
greater. Seconded by Afdahl. Motion carried. Afdahl-yes, Luckwaldt-yes,
Pierson-yes.
Inspection of the Willard Ott property. Motion by Afdahl to approve
the 50 foot setback from County Trunk Highway "M". Seconded by Luckwaldt.
Motion carried. Afdahl-yes, Luckwaldt-yes , Pierson-yes.
Motion by Luckwaldt to grant Dennis Bursch permission to build 110 feet
from the centerline of CTH "C" rather that the 120_ feet as requested. Seconded
by Afdahl. Motion carried. Afdahl-yes, Luckwaldt-yes , Pierson-yes.
After inspection of the Hanson property. Discussion on the area of
placement of the hot mix plant. All` members agree that the plant is needed
but more thought and discussion is needed before a decision can be made. A
motion by Pierson to hold off on any decision until the June 29th meeting.
Election of officers was held. Luckwaldt elected Chairman, Afdahl
elected Vice Chairman, Pierson elected Secretary. Harold to keep minutes and
records in the Zoning Office.
Motion by Luckwaldt to appoint Assistant District Attorney Lundell as
Hearing Examiner for the Board of Adjustments. Second by Afdahl. Motion.
carried.
Motion by Afdahl that the Board of Adjustments attend a hearing in Racine
on July 6, 1976. Seconded by Pierson. Motion carried.
Zoning Administrator to make reservations and transportation arrangements.
Those attending will be Supvs. Afdahl, Luckwaldt and Pierson. As well as Ass ' t.
D. A. Lundell and Zoning Administrator, Harold Barber.
Being no further business , a motion by Pierson to adjourn. Seconded
by Afdahl. Hearing adjourned at 6 :00 p.m. Next meeting is June 29, 1976,
at 10 :00 a.m.
