Dear Mr. Zeller
At the Board of Adjustment meeting on June 28, 2001,the Board tabled your Special Exception request for a
one-day Arts and Music Festival to be held at the former NIKE missile site in the Town of Warren. The Board
requires more information regarding the following items:
1. The Board requested that the Fire Marshall visit the site and inspect the silo bunkers,to insure that there is
adequate ingress and egress for orderly and safe exits of the patrons. The Fire Marshall shall present his
findings in writing.
2. The Board believes it is important to view the facility from inside the gates. At their viewing on June 28th,
they were only allowed to view the property from the perimeter of the facility.
3. Submit information on the ambient noise levels that will be anticipated at the property lines. The Board
would like some more concrete information, such as testing,that would indicate what can be expected for
noise levels. Zoning staff should be contacted at least 24 hours prior to the tests.
4. The number of vendors seemed to be unclear. Please submit information on how many vendors are
expected.
5. There needs to be some kind of agreement between the ambulance and fire department and the Sheriff's
department. Safety is an issue, and the Board would like to see something in writing from these
departments.
6. The Town of Warren must give their approval on this request,as stipulated in the ordinance.
7. The insurance policy needs to be increased to$10 million dollars,rather than$1 million.
The Board of Adjustment shall consider the submittal of the above information,however the submittal of this
information shall not constitute approval of the request. This information will be used by the board to make an
informed decision to approve or deny this request to hold an Arts and Music Festival on August 4, 2001 at this
site.
This information should be delivered to the Zoning Office no later than July 20' ,to be placed on the agenda
for the July 26"'Board of Adjustment meeting. This information will be discussed under old business.

BOARD Of AUSTMENTS MEETING AND HEARIGMINUTES
July 26, 2001
(This meeting was recorded by Northwestern Court Reporters)
The meeting was called to order by Chairperson Julie Speer at 8:30 a.m. A role call was
made. Julie Speer, Tom Rose, Rich Peterson, Nick Golz and Dick King were present.
Staff included: Steve Fisher, Zoning Director, Rod Eslinger, Zoning Specialist, and Deb
Zimmermann, Administrative Assistant. Chairperson Speer believes this to be a
properly noticed meeting.
Motion was made by Peterson, second by King to adopt the agenda. Motion carried.
The Board set the next meeting date as August 23, 2001. The starting time will be 8:30
a.m. The meeting will be held at the Government Center.
Motion by Golz, second by Rose to approve minutes from the June 28th, 2001 meeting
with one change on page 8, where Rose voted no, rather than yes in a decision.
Change will be made. All in favor. Motion carried.
CORPORATION COUNSEL REPORT/ UPDATE ON VIOLATIONS AND LITIGATION
Corporation Counsel will be available if needed.
OTHER BUSINESS
Eslinger explained that this item is for clarification of Condition #3 of the Emerald Dairy
Special Exception Permit granted February 22, 2001. An environmental bond was set
for the proposed lagoon that is being built on the site. Mr. Vrieze has informed the
Zoning Department that the lagoon will not be constructed until next year, and is asking
the Board to allow him to wait for the bonding until the lagoon is completed next year.
Zoning has received a bond in the amount of$235,000 to cover the existing lagoon.
John Vrieze, being duly sworn, told the Board that they cannot get the lagoon done this
year and plan to complete sometime next year. He reiterated that there is a bond in
place with the zoning office for the existing lagoon. Discussion held. Motion by Rose,
second by Golz to allow the applicant to delay the bonding for the lagoon until
construction next year. All in favor. Motion carried.
OLD BUSINESS
Eslinger told the Board that they have had a request from Greyston Real Estate to
withdraw their special exception request from last month for an arts and music festival in
the Industrial District. The Board had tabled the matter for more information, and the
applicant then asked to withdraw the request. Motion by Peterson, second by King to
accept the withdrawal. All in favor. Motion carried.
NEW BUSINESS
Chairperson Speer welcomed everyone in attendance and gave a brief overview of how
the Board of Adjustment meeting is conducted. Chairperson Speer stated that the public
hearing notice was published correctly and was read into the record as follows:

The request is for a Special Exception permit to conduct an Arts and Music Festival on the property formerly
known as the NIKE Missile Base in the Town of Warren. The one-day event is scheduled for August 4, 2001, from
8:00 p.m. to 3:30 a.m. Various musicians and DJ's will provide music below ground in the former missile soil
bunkers. Artists and venders will display their merchandise for sale above ground. A light show will also be
provided. Concessions will be available on the grounds and portable satellite toilets will be available for the public.
All event parking will be on the Missile Base property.

Section 17.19 (1) Special Exceptions.
(a) Any use I the Industrial District shall only be allowed as a special exception if
approved by the Board of Adjustment as provided in Section 17.70 (7), and with approval of

The Board of Adjustment after contemplating all relevant information, may do one of the following:
1. Recommend approval of the request: "Arts and Music Festival"
2. Recommend denial of the request.
3. Table/postpone the decision to absorb information gathered or request additional information.

Special exception use permits are granted at the discretion of the Board of Adjustment. They are made
available to validate uses which,while not approved within the zoning district in question,are deemed to be
compatible with approved uses and/or not found to be hazardous,harmful,offensive or otherwise adverse to
other uses. Special exceptions are subject to conditions,compatibility with surrounding land uses and
compliance with the St.Croix Zoning Ordinance.

Dear Mr. Eslinger,
Thank you for the phone call regarding the Application for Special Exception at the s
NIKE Missile Base. As required, enclosed please find the necessary information

;required to complete our Application for Special Exception.
The NIKE Missile Base is unique. It provides an opportunity for us to present our show r
lin a totally original atmosphere. The design and lay-out of the facility provide an F'
amazing array of possibilities for lighting and special effects and because it is
constructed primarily of concrete and steel, the possibility of damage is minimal.
Both bunkers are wired for three-phase output and there is more than enough power
in-house to handle any situation we wilt come up against. Both rooms are large with
good ventilation and security will be on hand should any situations arise. The music
wilt be presented in the bunkers thus limiting the amount of discernible noise you will
hear outside. Outside, water will be available along with CD's and an assortment of fi
sundries for purchase. Other artists and venders will also be there with their own'.
.wares for purchase.

The whole facility is enclosed within a double wall of chain link fencing ensuring a
much easier task of controlling the movements of the guests. It also benefits our
;parking staff by providing a safe area to park vehicles. Operations will be handled at
the trailer home just inside the front gate. Entrance to and from the event is provided,
'via two lane blacktop roads and it is only four miles to the 1-94 freeway entrance. We
believe that the event should also generate revenue for some of the surrounding'
businesses as welt.
We have discussed the possibilities of this sort of event with Mr. Jim Zeller of

Greystone Commercial for the past two years. We met Mr. Zeller at an event we`.
-produced at Canterbury Park in Shakopee, Minnesota. He seemed interested in how W
we presented our shows and what was involved with producing a successful event.',
Later we met with him at his office in Stillwater and this is where the topic of the
NIKE Missile Base first came up. After personally viewing the facility with Mr. Zeller.
;we became convinced that this would be an ideal site for this type of event. The I`

positive aspects of the sight are many. We cannot foresee a situation that would
come up that could not easily be dealt with. Our staff have many years of experiencek

and are very professional..
in closing, the NIKE Missile Base is ideal for what we have in mind. With all its
:features many things that can be problems at other shows are already dealt with. Our
relationship with the property owner is very good and after speaking with the Board

Members of the Town of Warren, we feel that they are excited to try something new 9
and original in their community.
Our Application for Special Exception at the NIKE Missile Base covers a 24 hour period
beginning at 12:00pm on 08/04/01.
