Hey Kevin, I'm wondering how to proceed with Kernon Bast's land use permit applications. I sent him a formal letter informing him that he needs a special exception permit for both projects, and informed him to apply by today's deadline. He's already t today, we informed us that he is not tannin to apply, so assuming he doesn't change his mind by the end of he day y, planning 9 should probably begin enforcement action tomorrow. Should I turn the files over to Carrie? Also, what should we do with his land use permit application fee? Normally I would apply it toward the special exception fee, or if an applicant decides to withdraw the application, I would refund a portion of the fee (minus my review time, postage, copying, and any other costs incurred in reviewing the application). Let me know what you think. We've already completed an OHWM determination on the pond closest to CTH N. I was out there yesterday, and Lot 18 has a house going up on it already, and from the grading completed, I would determine that a Ch. 30 permit is not needed. The previously permitted stormwater ponds and grading for the overall development looked very good. If there is 10,000 square feet or more of grading that will occur on Lot 11 within 75 feet of the southern pond, a chapter 30 permit would be required. I have attached a copy of the letter that went out in the mail today, as well as a special exception application form and supplemental information sheet for filling and grading. The next deadline for special exception application submittals is this coming Monday, November 5th. If you haven't already done so, you may want to consider having the DNR verify the navigability of the pond. I have attached a request for navigability determination form, which you can submit to the DNR. If you have any questions on that, I would suggest that you contact Dan Baumann at the DNR.
