1. Within 30 days of the date of this approval, the applicant shall construct a berm of approximately one foot
in height on the southwest portion of the arena to store storm water runoff and allow sediments to settle out
and the water to infiltrate into the ground. The purpose of this berm is to stop runoff and sediments from
draining onto the adjacent property to the southwest. Prior to constructing the berm, the applicant shall
install a double-row of silt fence down slope of the bens. The silt fencing shall be maintained until self-
sustaining vegetation is successfully established. "The applicant shall notify the Zoning Administrator when
the berm has been constructed and provide photographs of the berm for the file.
2. Within 30 days of this approval,the applicant shall install erosion control measures and maintain them until
the permanent vegetation establishes. Class 2 or Class 3 erosion mat shall be installed in the concentrated
flow channels and all other areas shall be mulched and hydro-seeded. Within this timeframe, the applicant
shall prepare a good seedbed and apply seed on all disturbed areas (as weather allows), and add minerals
and lime as specified by a professional soil test. No phosphorous fertilizers shall be used unless the soil test
confirms that phosphorous is needed. Soil testing kits are available at the UW-Extension office. Animal
units must be kept off all disturbed pasture areas until permanent self-sustaining vegetation is successfully
established (this should take approximately one growing season). The applicant shall notify the Zoning
Administrator when all of this work has been completed and provide photographs of' all pastures with
permanent vegetation for the file.
3. Within 30 days of this approval,the applicant shall complete a 590 Nutrient Management Plan to address the
management of animal waste on the site.
4. Within 30 days of completing construction,the applicant shall execute and record an affidavit against the
property referencing the berm and long-term operation and maintenance plans for vegetation in all of the
pastures with the Register of Deeds,and provide the Zoning Administrator with recorded copies of these
documents.
This approval does not allow for any additional construction, structures, grading, filling, or clearing of
vegetation beyond the limits of this request. Your information will remain on file in the St. Croix County
Planning and Zoning Department. It is your responsibility to ensure compliance with any other local, state, or
federal rules or regulations, including but not limited to a NR 216 permit from the Wisconsin Department of

Natural Resources if necessary.

permit. Staff finds that the application meets the spirit and intent of the St. Croix County Zoning
R cling Ordinance with the following findings:
-386-4675 1. Any construction or land disturbance activities affecting more than 10,000 square feet in area
on slopes of 12—19.9 percent is allowed with a land use permit pursuant to Section 17.12(7)
of the St.Croix County Zoning Ordinance,
2. Any construction or land disturbance activities on slopes of 20-24.0 percent is allowed with a
E land use permit pursuant to Section 17.12(8)of the St.Croix County Zoning Ordinance;
3. The total disturbed area for the project is known to be over 10,000 square feet,but the
exact square footage is not known. This project may require a NR 216 storm water permit
from the Wisconsin Department of Natural Resources if it exceeds one acre;
4. During the site visit on October 2,2007, staff observed severe gullying and erosion in the
disturbed areas, and runoff and sedimentation collecting in closed depression on the site, as
well as sedimentation along the driveway on the adjacent property to the southwest. With
conditions for installing and maintaining erosion control and storm water management
measures until self-sustaining permanent vegetation is established on all disturbed areas,
. limiting the use of phosphorous fertilizer; and recording long-term operation and
maintenance plans for the vegetation and any permanent storm water management
measures on the site,negative environmental impacts will be minimized and the purpose
and intent of the Ordinance will be met;
5. The St.Croix County Land and Water Conservation Department has reviewed the plans and
visited the site.To address the sediments being carried off the arena area and onto the
? neighboring property,the Department recommends that the applicant construct a berm of

Today I spoke with you regarding the 590 Nutrient Management Plan that was

required for this plan. You must state what you will be doing with the horse manure.

and drawing showing the location of the composting p g pile. A soil sample will be
needed to verify the site is suitable for composting. If the manure is being removed
from the property, I would need a written statement stating where it is being taken. If
you plan to spread the manure on the fields, I would need a written statement and a
drawing showing the acreage, and the location of the field along with the slopes and
contours. A soil sample will be needed to verify the site is suitable for field
spreading.
This information must be in this office no later than January 11, 2008.

On December 17, 2007 1 spoke with you regarding a certified letter I sent on

completed before your after-the-fact Land Use Permit was issued and therefore,
you did not read the conditions of the permit. You must supply this Department with
either a site plan drawing showing the exact location of the erosion mat or a
narrative very specifically describing the location. This information must be in this
office no later than January 2, 2008. 1 told you the silt fencing, berm and other
conditions of the permit must be completed in the spring of 2008. The conditions of
the Land Use Permit (LU 0091) are listed below. I have also enclosed a copy for
your review.
