Alex Blackburn forwarded your message to me. According to Section 17.36 G.5.a.1)of the Ordinance, on
modifications or additions to existing structures, any cantilevered portions of the structure must meet
the required setback. Thus, the proposed cantilevered addition cannot encroach within the bluffline
setback area.
How far is the existing structure from the bluffline?

Alex,
Passe Engineering has been working with Kevin Adkins to modify the deck and add a 3
season porch on the rear of his home at 163 Riverview Acres Road in St. Joseph Township.
Kevin asked me to check with you to see if he could increase his 3 season porch from 14' by
14'to 16' by 16', leaving the footings for the deck at the same location. Currently the
proposed addition does not encroach into the Bluff setback. With the larger porch, it would
be cantilevered approximately 18 inches into the bluff setback. According to Ordinance
17.36G.5, the setback varies between existing and new structures. Since the home (and
deck)was existing prior to the ordinance, does the allowable encroachment of 3 feet apply for
the Roof Overhang? (17.36G.5a.1), or is the porch addition considered a new structure which
measures the setback from the horizontal plane of the Roof Overhang (17.36G.5b)?

8. With conditions for planting additional native trees, shrubs,and groundcover along the top of the slope
preservation zone and within the 40-foot bluffline setback area,the existing principal structure and
proposed accessory structures will not be visually conspicuous from the St. Croix River and the property
will be brought into compliance with the current standards in the Lower St. Croix Riverway District;
9. With conditions for finishing all improvements in earth tone colors,the structure will blend in with the
natural surroundings;
10. The proposed covered entrance will be located on the landward side of the existing principal structure and
will not be visible from the river;
11. The St. Croix County Land and Water Conservation Department has reviewed the plans and visited the
site and finds the storm water and erosion control plans for the site to be complete; however,the
Department is concerned about yard waster presently being distributed over the bluffline and the amount
of trees marked for removal, and recommends that the trees are replaced in accordance with the
vegetation management standards in the Ordinance;
12. The Wisconsin Department of Natural Resources has reviewed the plans and verified that a Chapter 30
permit is not required for the project,and recommends storm water treatment for all runoff on the site due to
the large amount of existing impervious coverage;and
13. With the conditions stipulated above,this project will meet the spirit and intent of the Lower St.Croix
Riverway District since it will not degrade the scenic,recreational,or natural values of the St.Croix River
Valley,and will not negatively affect the public health,safety and welfare of County residents.
Approval of this land use permit is subject to the following conditions:
1. Prior to commencing construction,the applicant shall submit a Compliance Deposit in the amount of
$300 to be held by the Zoning Administrator until all conditions have been completed and approved,at
which time it will be refunded in full pursuant to Section 17.36 J.8 of the St. Croix County Zoning
Ordinance.
2. Prior to commencing construction,the applicant shall submit to and have approved by the Zoning
Administrator a vegetation management plan for the top of the slope preservation zone and the area
within 40 feet of the bluffline between the principal structure and the river. Within this area,the applicant
shall plant replacement trees for those being removed in accordance with the tree replacement schedule in
the Ordinance,and plant additional native trees, shrubs, and groundcover to ensure that the existing
principal structure and proposed accessory structures are visually inconspicuous in their entirety from the
St. Croix River and to comply with the vegetation standards in Sections 17.36 H.8 and 17.36 1.5.c.1)of
the St. Croix County Zoning Ordinance,and to provide additional filtration of runoff from the existing
impervious coverage on the site..All trees within this area shall be at least two inches Diameter at Breast
Height (DBH)and planted no more than 12 feet apart and staggered parallel to the river and the structure.
As part of the plan,the applicants shall agree not to dump grass clippings,branches, and other yard waste
down the slopes,which can hinder the growth of native vegetation and contribute to nutrient runoff into
the St. Croix River.This vegetation management plan shall be implemented immediately upon
completing construction(as weather allows).
3. The applicant shall be responsible for implementing the erosion control and storm water management
plan in accordance with the timeframes provided in the plan. Erosion control measures shall be
maintained until permanent, self-sustaining native vegetation has successfully established on all disturbed
areas of the site.
4. Within 14 days of approval of the vegetation management plan as required by Condition#2 above, the
applicant shall record an affidavit with the Register of Deeds referencing both the erosion control and
storm water management plan and vegetation management plan and operation and maintenance
agreements for each, and provide recorded copies of these documents to the Zoning Administrator
pursuant to Section 17.36 I.5.c.4)of the Ordinance.The purpose of this is to alert future property owners
of the responsibilities and limitations incurred by the plans.
5. The finished accessory structures shall be no taller than 20 feet in height pursuant to Section 17.36
GA.a.3)of the St. Croix County Zoning Ordinance.

3. According to the plans submitted,no filling and grading will occur on slopes over 12 percent or
within 40 feet of the bluffline. Only minimal disturbance is proposed outside of the bluttine
setback area to install footings for the proposed elevated screened porch,deck,and covered

4. The proposed structures will add approximately 1,330 square feet of impervious coverage to the
site.The applicants plan to remove approximately 300 square feet of existing concrete patio,

resulting in a net increase of 1,030 square feet of impervious coverage.The applicants have
"w: submitted an erosion control and storm water management plan to address the runoff from the
added impervious coverage pursuant to Section 17.36 H.7 of the St. Croix County Zoning
Ordinance;
5. No proposed alterations to the existing principal structure will increase the height of the
structure, and it appears that no proposed accessory structures will exceed 20 feet in height;
6. The existing principal structure and proposed accessory structures all meet the 200-toot setbarl<
from OHWM of the St.Croix River;
7. The existing principal structure and proposed accessory structures and modifications do not
meet the 100-foot setback from the bluffline,and several existing trees along the top of the
slope preservation zone and within 40 feet of the bluffline that currently provide screening from
the river appear to be diseased or dying and marked for removal. Since all existing and
proposed structures are located at least 40 feet from the bluffline, the principal structure may be
altered and the proposed accessory structures may be constructed provided the finished
structures do not protrude above the bluffline, utilize building materials that are earth tone in
color and non-reflective,and are made visually inconspicuous with native tree and shrub

6. All siding, shingles,trim,and other appurtenances of the existing principal and proposed accessory
structures shall be earth tone in color and of a non-reflective nature (except for windows) so as not to be
visually conspicuous from the St. Croix River pursuant to Sections 17.36 G.5.c.2)a)and 17.36 H.1 of the
St. Croix County Zoning Ordinance.
7. Within 30 days of substantially completing the proposed construction, the applicants shall submit to the
Zoning Administrator photos of the completed project and vegetation plantings as viewed from the
bluffline and the river.
8. All activities approved as part of this land use permit shall commence within one year from the date of
approval and be substantially completed within two years, after which time the permit expires pursuant to
Section 17.36 J.7 of the Ordinance. Prior to expiration,the applicant may request extensions of up to six
months from the Zoning Administrator. The total time granted for extensions shall not exceed one year.
9. Failure to comply with the conditions above may result in the revocation of this permit pursuant to
Section 17.36 J.8.b of the Ordinance.
This approval does not allow for any construction beyond the limits of this request. Your information will
remain on file in the St. Croix County Planning and Zoning Department. You must contact the Town of St. Joseph
to obtain a building permit. It is your responsibility to ensure compliance with any other local, state, and federal

REVIEW:
The Zoning Administrator will review the applica ion or co pletenis nd assign a file number to the application.The Zoning
Administrator may require additional information and will notify the applicant of this within 10 days. Upon receiving a complete
application and supporting documents,the Zoning Administrator will:
• send copies of the applications to the appropriate reviewing agencies for comment.Applicants are encouraged to contact
their town to discuss their application and inquire about necessary building permits and approvals at the town level;
• schedule a site visit to the applicant's property,at which time the applicant shall flag all applicable property/project corners
and label the flags accordingly;and
• review the file and prepare findings for approval or denial of the permit within 60 days. Upon approval,the permit will be
mailed to the applicant or to the applicant's agent.
If approved,the land use permit will be valid for one year from the date of the permit issuance.The applicant may also be required to
apply through the Town for a local building permit.All site plans,pictures,and other materials submitted with the application become
the property of the Planning and Zoning Department and will remain in the file.
