• • Based on these findings, approval of the land use permit is subject to the following conditions: 1. The applicants shall contact the Zoning Administrator prior to commencing construction and when all construction is completed. 2. Prior to commencing construction,the applicants shall install erosion control measures around the perimeter of the construction site draining toward the lake. During construction, the smallest amount of bare ground shall be exposed for as short a time as possible. Immediately upon completing construction, all disturbed areas shall be stabilized with permanent, self-sustaining vegetation. Erosion control measures shall remain in place until the site is fully stabilized. 3. Prior to commencing construction, the applicants shall submit to and have approved by the Zoning Administrator a vegetation management plan for the steep slope located within the 75-foot setback area between the proposed addition and Bass Lake. Within this area, the applicant shall plant additional native trees, shrubs, and groundcover to substantially screen the proposed screen porch and existing accessory structure,protect the steep slopes from erosion, filter storm water runoff from the additional impervious coverage,and preserve and enhance the natural appearance and ecology of the shoreline in compliance with the vegetation standards in Section 17.28 of the St. Croix County Zoning Ordinance. All new trees within this area shall be at least one inch Diameter at Breast Height(DBH) and planted no more than 12 feet apart and staggered parallel to the lake and the structure. As part of the plan, the applicants shall include a maintenance agreement to ensure that all vegetation establishes successfully and is maintained long-term. This vegetation management plan shall be implemented immediately upon completing construction(as weather allows). 4. Within 30 days of approval of the vegetation management plan,the applicants shall record an affidavit with the Register of Deeds referencing the plan and provide a recorded copy to the Zoning Administrator. The purpose of this is to alert future property owners of the responsibilities and limitations incurred by the plan. 5. No phosphorous fertilizers shall be used to establish and maintain a lawn on the disturbed areas of the site, unless a soil test confirms that phosphorous is needed. 6. Within 60 days of completing construction,the applicants shall submit to the Zoning Administrator photos of the completed additions and landscaping as viewed from all angles, including the shoreline of Bass Lake. The photographs must also show all storm water management measures including roof gutters,rain gardens,and/or any designated infiltration areas. The applicant shall plant additional native trees and shrubs as required by the Zoning Administrator to meet the conditions above. This approval does not allow for any additional construction, structures or structural changes, grading, filling, or clearing of vegetation beyond the limits of this request. Your information will remain on file in the St. Croix County Planning and Zoning Department. You must obtain a building permit from the Town of St. Joseph prior to commencing construction. Staff finds that the proposed additions meet the spirit and intent of the St. 715-386-4674. Croix County Zoning Ordinance and Shoreland District with the following findings: 1. Single-family dwellings, accessory structures, and additions to existing structures are Real Property 715..> allowed with a land use permit in the Shoreland District pursuant to Section 17.35(2)(b) of ;Mr�G-4677 the St.Croix County Zoning Ordinance; Ro&cling 2. The proposed 188-square foot screen porch and the proposed 148-square foot covered cntry 45-386-4675 will both be located over 75 feet from the OHWM of Bass Lake and will meet all rcquircd road and sideyard setbacks and height limitations; 3. The disturbed area for constructing the proposed additions will be less than 2,000 square feet on slopes less than 12 percent, which is allowed without a permit in the Shoreland District pursuant to Section 17.29(2)(a)of the St.Croix County Zoning Ordinance; 4. The slopes within the OHWM setback area are over 25 percent and are currently void of native tree and shrub cover, except for several pine trees along the top of the slope that have been limbed up. With conditions for enhancing the current level of vegetative cover with additional native trees and shrubs to substantially screen the proposed screen porch and protect the steep slopes from erosion, the natural appearance and ecology of the shoreline will be preserved; 5. The St. Croix County and and ty Water Conservation Department has reviewed the lams and P p visited the site, and noted that shoreline vegetation has been removed in excess of the 30- foot viewing and access corridor allowed in the Shoreland District. The Land and Water Conservation Department recommends that the applicants provide a re-vegetation plan to restore vegetation to screen the proposed screen porch addition and the existing structure to comply with the vegetation standards in the Shoreland District, as well as a maintenance plan for the successful establishment of the vegetation; and 6. The Wisconsin Department of Natural Resources has reviewed the plans and notified County staff that Wisconsin Administrative Code NR 115 identifies that counties may prohibit the expansion of nonconforming structures in excess of 50 percent of the equalized assessed value. County staff finds that the St. Croix County Z.oning Ordinance does not specifically address nonconforming structures in the Shoreland District. but that the proposed additions appear to be under 50 percent of the equalized assessed value ul the structure consistent with NR 115. The Department of Natural Resources recommends that additional impervious coverage be actively managed for storm water, and that vegetative screening be added to reduce the visibility of the proposed screen porch addition from the lake.
