The St. Croix County Land and Water Conservation Department recommends that the shoreline and the area 35 feet inland from the OHWM be restored with native vegetation,all newly created impervious coverage be mitigated with storm water measures designed and installed to infiltrate 1.5 inches of runoff, no phosphorous fertilizer be used to establish vegetation unless a soil test confirms the needs, and silt fence be maintained until self-sustaining vegetation is established. 10. The Wisconsin Department of Natural Resources has stipulated that the rock placed along the shoreline does not meet the standards for placement under Wisconsin Administrative Code NR 328; the deadline for shoreline restoration agreed upon by all parties is October 1, 2007; the Department will agree to the County's approval of the vegetation plan to satisfy the restoration obligations and will not take further enforcement actions if the shoreline restoration is done in accordance with the approved plans and in within the approved timeframe; and that additional mitigation be conducted to fully satisfy the requirements of the Ordinance for bringing the violations into compliance with the Ordinance. I Based on these findings, approval of the land use permit is subject to the following conditions: 1. The applicant shall contact the Zoning Administrator when all construction is completed. 2. The applicant shall maintain the silt fence until permanent,self-sustaining vegetation is successfully established on all disturbed areas of the site. 3. No phosphorous fertilizers shall be used to establish and maintain vegetation on the disturbed areas of the site, unless a soil test confirms that phosphorous is needed. 4. Within 30 days of the date of this approval,the applicant shall submit to and have approved by the Zoning Administrator a storm water management plan to account for the storm water runoff from all new impervious coverage on the site.The storm water mitigation measures must be designed and installed to infiltrate the first 1.5 inches of runoff in a rain event.The applicant shall be responsible for implementing and completing the plan no later than October 1,2007. 5. No later than October 1,2007, the applicant shall fully implement the revised shoreline restoration plan submitted on August 16,2007, including the planting of native vegetation;the complete removal of the deck,retaining walls, and rip rap; and the reduction of the stairway to no more than four feet wide. 6. No later than October 1, 2007, the applicant shall plant additional native trees, shrubs, and groundcover along the shoreline and within the 35-foot OHWM setback/shoreline buffer area in order to: • substantially screen the additions from the river during summer leaf-on conditions, • further filter and slow storm water runoff from the site before reaching the river; • prevent erosion and sedimentation along the shoreline,and • preserve the natural ecology and wildlife habitat along the shoreline(see Condition 1_8 bclo,.O. 7. Within 30 days of completing construction, the applicant shall execute and record an affidavit against the property referencing the storm water and restoration plans and a maintenance and monitoring agreement for the storm water mitigation measures and vegetation within the 35-foot shoreline restoration and buffer area with the Register of Deeds, and provide the Zoning Administrator with recorded copies of these documents. 8. Within 60 days of completing construction, the applicant shall submit to the Zoning Administrator photos of the completed project as viewed from all angles, including the shoreline of the Apple River.The photographs must also show all newly p lanted vegetation. The applicant shall plant additional native trees and shrubs as required by the Zoning Administrator to meet the conditions above. This approval does not allow for any additional construction, structures or structural changes, grading, filling, or clearing of vegetation. The property is located within the Shoreland District of the 715-386-4674 < Apple River in the Town of Star Prairie. Staff finds that the proposed project meets the spirit and intent of the St.Croix County Zoning Ordinance with the following findings: Real pmp&tV 1. Single-family dwellings, additions, and accessory structures are allowed with a land use 715> G-4677 permit in the Shoreland District pursuant to Section 17.35(2)(b) of the St. Croix County Recycling Zoning Ordinance, 715-386-4675 2. The applicant obtained a building permit for the proposed three-season porch from the Town of Star Prairie on June 29, 2007. Construction has not begun on the proposed porch or deck,but the applicant has excavated an area for the foundation; 3. The filling and grading for the foundation is less than 2,000 square feet on slopes less than 25 percent,which is allowed without a permit in the Shoreland District pursuant to Section 17.29(2)(a)of the St.Croix County Zoning Ordinance; 4. The proposed three-season porch and deck are located over 75 feet from the OHWM of the Apple River and meet all required road and side yard setbacks; 5. Silt fencing has been installed around the construction site and all stockpiles; 6. On August 1,2007,the applicant was notified by staff from the Planning and Zoning Department that shoreline alteration activities done on the property earlier this summer— including the installation of a deck,retaining walls,rip rap,and stairs along the banks of the Apple River were done in violation of the St.Croix County Zoning Ordinance. Staff informed the applicant that a restoration plan including the complete removal of the deck, retaining walls,and rip rap;reduction of the stairs to four feet; and showing proposed vegetation and grading limits for the entire project must be submitted prior to issuance of the land use permit. The applicant submitted these items on August 6. 2007 and revised them on August 16,2007, which was approved by staff, 7. With conditions to maintain the silt fence until self-sustaining permanent vegetation is established on all disturbed areas;prohibit the use of phosphorous fertilizer to establish and maintain a lawn; implement the restoration plan within the agreed upon timeline; and record a maintenance and monitoring agreement against the property for the restoration area,negative impacts to the water quality of the river will be minimized; 8. With conditions for enhancing the current level of native vegetative cover— including trees, shrubs, and groundcover-to substantially screen the proposed porch and deck, preserve wildlife habitat, and provide further filtration of storm water runoff from the impervious coverage on the site consistent with the standards in the Shoreland District. the natural beauty and ecology of the shoreline will be protected.
