1. The applicants shall contact the Zoning Administrator prior to commencing construction and when all
construction is completed.
2. The height of the addition shall not exceed 35 feet as measured from the lowest adjacent grade to the
midpoint between the eaves and the peak.
3. Prior to commencing construction, the applicants shall submit to and have approved by the Zoning
Administrator detailed plans showing how runoff from the proposed addition is going to reach the proposed
rain garden at the base of the stone retaining wall. Specifically,the plans should show the location of
downspouts and/or any underground piping leading to the rain garden,and flow direction along the bottom
roofline.
4. Prior to commencing construction, the applicants shall install the approved erosion control measures
around the perimeter of the construction site. During construction,the smallest amount of bare ground
shall be exposed for as short a time as possible. Immediately upon completing construction, temporary
ground cover shall be used and all erosion control measure shall remain in place and be maintained until
permanent, self-sustaining vegetation is successfully established.
5. Prior to commencing construction, the applicants shall install construction fencing or other suitable
edge of the stone retaining wall to ensure that it is not disturbed during
barrier along the top g g g
construction.The applicants shall be responsible for ensuring that this retaining wall remains intact.
6. No phosphorous fertilizers shall be used to establish and maintain a lawn on the disturbed areas of the
site, unless a soil test confirms that phosphorous is needed.
7. The applicants shall be responsible for installing rain gardens to capture and infiltrate storm water
runoff from the impervious coverage on the site in accordance with the approved storm water
management plan submitted on September 20, 2007.Within 30 days of completing construction, the
applicant shall execute and record an affidavit against the property referencing the storm water
management plan and a maintenance and operation agreement for the rain gardens and all drainage
ways with the Register of Deeds, and provide the Zoning Administrator with recorded copies of these
documents at this time.
8. The current level of native trees,shrubs, and groundcover along the shoreline, within the 75-foot
OHWM setback area, and on all slopes 25 percent and greater shall be maintained and enhanced with
additional vegetation as necessary in order to:
• substantially screen the addition from the lake during summer leaf-on conditions.
• filter and slow storm water runoff before reaching the lake,
• stabilize the steep slopes to prevent erosion and sedimentation, and
• preserve the natural ecology and wildlife habitat in these sensitive areas (see Condition #9 below).
9. Within 60 days of completing construction, the applicants shall submit to the Zoning Administrator
photos of the completed project as viewed from all angles, including the shoreline of Bass Lake. The
photographs must also show all storm water management measures including roof gutters, rain gardens,
and any designated drainage areas. The applicants shall plant additional native trees and shrubs on the
site as required by the Zoning Administrator to meet the conditions above.
This approval is for an 823-square foot addition and related tilling and grading to install the footings. It
does not allow for any additional construction, structures or structural changes, grading, tilling, or
clearing of vegetation beyond the limits of this request. Your information will remain on file in the St. Croix
County Planning and Zoning Department. You must obtain a building permit from the Town of St. Joseph prior
to commencing construction. It is your responsibility to ensure compliance with any other local, state, or federal
rules or regulations.

Real P property is located within the Shoreland District of Bass Lake in the Town of St. Joseph. Staff
finds that the proposed project meets the spirit and intent of the St.Croix County Zoning Ordinance
7156-4677
and Shoreland District with the following findings:
RcGng 1. Single-family dwellings and additions are allowed with a land use permit in the Shoreland
5-386-4675 District pursuant to Section 17.35(2)(b) of the St. Croix County Zoning Ordinance:
t�t > 2. The filling and grading for the footings of the proposed addition will cover an area of
approximately 1,451 square feet square feet on slopes ranging from 12 to 24.9 percent,
which is allowed with a land use permit in the Shoreland District pursuant to Section
17.29(2)(c)of the St.Croix County Zoning Ordinance;

3. The proposed addition will be located over 75 feet from the OHWM of Bass Lake and w 1
meet all required road and side yard setbacks;
4. The proposed addition will be located on the landward side of a steep stone retaining wall
that faces the lake. With conditions to leave the retaining wall intact, no slopes over 25
percent will be disturbed to install the footings of the proposed addition.
5. The slopes within the OHWM setback area are over 25 percent and currently feature dense
tree and shrub cover, which the applicants plan to leave intact. With conditions for
maintaining and enhancing the current level of native vegetative cover to substantially
screen the proposed dwelling and to protect the steep slopes from erosion and sedimentation,
the natural appearance and ecology of the shoreline will be preserved;
6. The applicants submitted storm water and erosion control plans as part of the permit

fertilizer on the site,negative impacts to the water quality of Bass Lake will be minimized-,
7. The St. Croix County Land and Water Conservation Department has reviewed the erosion
control and storm water management plans and finds them to be sufficient; and
8. The Wisconsin Department of Natural Resources has reviewed the plans and does not object
to these requests; however, the Department recommends that the applicants submit detailed
plans showing how runoff from the proposed addition on the site is going to reach the
proposed rain garden at the base of the stone retaining wall Specifically_ the plans should

Mr. Bigham,
Sorry for the wait. We have been extremely busy this whole week.
After reviewing the latest elevation/contour map that was submitted on September 5,
2007, along with other previously submitted maps and data, we have come to the
following decision regarding your project and our interpretation of the Ordinance. We
have concluded that you will be able to construct an addition in the general vicinity
proposed, provided that filling and grading activities must not disturb the retaining
wall and a minimum distance of three feet must be maintained for grading limits between
the retaining wall and proposed foundation. Your original application contained plans for
taking out part of the retaining wall to allow for a walkout basement. You have since
stated that the addition will not have a walkout and the retaining wall will not be
disturbed. If any of the retaining wall is disturbed, then elevations at the base of the
retaining wall will be required to be used in calculations for slope. This would result in
disturbing slopes of around 31% over a distance of 50 feet, which is prohibited and in
direct violation of the Ordinance. Your builder has stated several times that grading
limits could be established at a maximum of three feet from the proposed structure. We
will require that three foot filling/grading limit. Again, the retaining wall cannot be
disturbed, removed or destroyed.
We will need a revised/amended application to reflect the changes from your original
application. Your application must include the footprint and grading limits of the project.
We will also need revised stormwater and erosion control plans to reflect the changes
from the original application, as per comments fro eve Olson from the LWCD. We
will also need new elevation drawings of the structure since the plan has changed from
the original walkout design.

Planning I am writing this letter as a follow-up to the site visit Steve Olson and I conducted on Tuesday,
715-386-4674 July 3 2007 along with you,Jeanine Shusta,Doug Z ahler, and David Strand. As we discussed on

site, it appears that the proposed filling, grading, and construction activities will affect slopes of
Real Property 25 percent or greater as measured over a horizontal distance of 50 feet, which is prohibited

County Board of Adjustment.
At the site visit,Mr. Strand requested a meeting with Kevin Grabau,Code Administrator, and me
to discuss the applicability of the Ordinance and how slopes are measured in situations involving
retaining walls. Mr. Grabau will be out on vacation until Thursday, July 12`x', and would be
available to meet after that. I will contact Mr. Strand to schedule this meeting. It would be very
helpful to have a survey showing 2-foot contours within and immediately adjacent to the project
area, elevations of the bottom and top of all existing retaining walls, and/or cross section
drawings of the project area with an accurate scale and elevations for the meeting. The more
information you can provide, the better able our staff will be to make a determination.
