Gaylord, dated Land Information March 18, 2008. In that letter, Mr. Gaylord requested verification on advice we gave you Planning d2r to the gift of property Y to your son. Specifically, he has requested answers to the 715-386-4674 << following three questions: ::>:,01, Real Pr 1. Before the gift, when Mr. Cudd owned the lots in common ownership, could he 715 46677 77 have sold the vacant lot? - 2. If he could have, was he told that he could not; and, if so, why? R cling 3. If he could not have, was the tax assessor told that he could have and, if so, why? -386-4675 In answer to your attorney's questions above, before the gift, this office did not know aA whether or not you could have sold or used the vacant lot(s)as a separate single-family building site. We informed you that we could not make that determination until you \ demonstrated that the lot(s) you wished to gift to your son and your remaining adjacent lot(s) each had compliant building sites (please refer to my letter to your attorney dated February 6, 2007, specifically the fourth bullet under the heading "Gift v. Sale"). You u. have since submitted a professional survey and soil tests to demonstrate compliance. The tax assessor did not contact this office until December 4, 2007, after you had submitted the survey and gifted the vacant lot to your son and your son had constructed a single-family home on it. At that time, I referred him to my February 6, 2007 letter to your attorney and provided him with a copy of it. I hope this answers your questions.
