The height of the single-family dwelling and attached garage shall not exceed 35 feet as measured from the lowest adjacent grade to the midpoint between the eaves and the peak. 3. Prior to commencing construction, the applicant shall install sediment logs around the perimeter of the construction site and stockpile areas draining toward the lake. The sediment logs shall be installed on the flat area along the top of the steep slopes. During construction, the smallest amount of bare ground shall be exposed for as short a time as possible. Immediately upon completing construction, temporary ground cover shall be used and the sediment logs shall remain and be maintained until permanent, self- sustaining vegetation is successfully established. 4. No phosphorous fertilizers shall be used to establish and maintain a lawn on the disturbed areas of the site, unless a soil test confirms that phosphorous is needed. 5. The applicant shall be responsible for installing three rain gardens to capture and infiltrate storm water runoff from the impervious coverage on the site in accordance with the storm water management plan submitted on June 8, 2007. Within 30 days of completing construction, the applicant shall execute and record an affidavit against the property referencing the storm water management plan and maintenance requirements for the rain gardens and all drainage ways with the Register of Deeds, and provide the Zoning Administrator with recorded copies of these documents. 6. The current level of native trees, shrubs, and groundeover along the shoreline, within the 7546ot OHWM setback area, and on all slopes 25 percent and greater shall be maintained in order to: • substantially screen the dwelling from the lake during summer leaf-on conditions, • filter and slow storm water runoff before reaching the lake, • stabilize the steep slopes to prevent erosion and sedimentation, and • preserve the natural ecology and wildlife habitat in these sensitive areas(see Condition#7). 7. Within 60 days of completing construction, the applicant shall submit to the Zoning Administrator photos of the completed project as viewed from all angles, including the shoreline of Bass Lake. The photographs must also show all storm water management measures including roof gutters, rain gardens, and/or any designated infiltration areas. The applicant shall plant additional native trees and shrubs as required by the Zoning Administrator to meet the conditions above. This approval does not allow for any additional construction, structures or structural changes, grading, filling, or clearing of vegetation beyond the limits of this request. SURVEYOR'S REPORT The deeds for the parcels that compose the lots shown on this map describe the property as being in Government Lot 1 of Section 23. In the course of this survey it was discovered that a part of the property actually lies in Government Lot 4 of Section 26. This discovery is based upon the location of section corner monuments of record at the southeast comer of Section 23 and the southwest comer of Section 23. The quarter comer between these comers is in Bass Lake and therefore a monument was not placed during the government surveys. With the aid of a survey map prepared by Carroll Grubb, dated June 28, 1953, and revised in Sept. 1955, Oct. 1988 and May 1961, 1 was able to retrace the boundaries of the parcels on this map and the section line between Sections 23 and 26 that was used as the basis of Grubb% survey. According to Grubb's survey the section line was "set by others". This section Line would place the southeast comer of Section 23 in the center line of 140th Avenue approximately 33 feet south of the record monument. This centerline location of the southeast corner of Section 23 is in conflict with the legal description for 140th Avenue which states that the right—of—way is "The north 4 rods of the east 2344 feet of Government Lot Number 4 of Section 26, T30N, R19W". The record monument at the southeast corner of Section 23 is in agreement with that legal description. Much of the property in Government Lot 1 of Section 23 and Government Lot 4 of Section 26 has been divided into small tracts and conveyed by metes and bounds description. Surveys done by James Grubb in Government Lot 4 and Art Weggerer in Government Lot 1 (CSM Vol. 1, pg. 238) have used this some line as the section line between Section 23 and 26. From the field work and research I have done it appears that all of the parcels that have been conveyed from these Government Lots, until recently, have used the same line as shown on the Carroll Grubb survey. All of these conveyances were made by James and Edna Simon, or their heirs and assigns, as they were the title holders of both Government Lots 1 and 4. Regardless of the section line, I believe the Intent of the conveyances is as shown by the location of the found monuments at the parcel comers. These monuments fit reasonably well with the record. I believe that it is safe to say that the conveyances were based upon the survey, and therefore, the monuments should hold. as to the intent'of the conveyance. I also believe that since title to both Government Lot 1 and Government Lot 4 was held by the some owner, there should be no issue with regard to title.
