SCO13V June 15,2007 File LU0070 Gary Elert 1378 Hilltop Ridge Houlton, WI 54016 Re: Land Use Permit for Accessory Structure in the Lower St. Croix Riverway District 1370 Hilltop Drive,Parcel#27.30.20.510I,Town of St. Joseph Dear Mr. Elert: This letter confirms zoning approval to construct an accessory structure in the Lower St. Croix Riverway District in the Town of St. Joseph. According to the plans you submitted, the proposed detached garage would have a footprint of approximately 1,378 square feet with a 144 square foot canopy. The garage will be located over 45 feet from the blufflines to the north and south as identified by the Wisconsin Department of Natural Resources. The existing driveway will be extended a total of XXXX square feet to provide two access points to the proposed garage to the east and to the north. The proposed garage and driveways will replace 10 sheds and garages totaling 3,246 square feet that have been or will be removed from the property, resulting in a net decrease of XXXX square feet of impervious coverage on the site. Staff finds that the proposed construction meets the requirements of the Lower St. Croix Riverway District,with the following findings: 1. The property is zoned Ag Residential and is located within the Rural Residential Management Zone of the Lower St.Croix Riverway District; 2. Accessory structures are allowed in the Lower St. Croix Riverway District with a land use permit pursuant to Section 17.36 F.2.a.1)of the St. Croix County Zoning Ordinance; 3. The proposed garage will be located more than 200 feet from the OHWM of the St. Croix River and more than 40 feet from the blufflines to the north and to the south; 4. The proposed garage will be located on the landward side of an existing principal structure and the slopes surrounding the site feature dense tree cover. With conditions for maintaining and enhancing the current level of native vegetation on and within 40 feet of the slope preservation zone,limiting the height of the garage to no more than 20 feet,and finishing the garage in earth tone colors,the garage will not be visible from the St. Croix River; 5. With conditions for restricting any filling and grading activities within 40 feet of either bluffline and for implementing erosion control measures before, during and after construction,the project will not negatively impact the scenic,recreational,or environmental quality of the Lower St.Croix River; 6. With conditions to remove all remaining sheds and garages as indicated in the April 27, 2007 letter from the applicant,the proposed garage and driveway will not add impervious coverage to the site; 7. With conditions to manage storm water runoff from the existing impervious coverage in order to increase infiltration on site,minimize erosion on steep slopes,and reduce sedimentation and nutrient flow into the river consistent with Section 17.36 H.7 of the Ordinance,the property will be brought into compliance with the current storm water standards in the Lower St.Croix Riverway District; 8. The Land and Water Conservation Department has reviewed the storm water management plans and finds it to be in compliance with the standards in Section 17.361I.7.of the Lower St.Croix Riverway District. 9. The Wisconsin Department of Natural Resources has reviewed the plans and does not object to approval of the permit;and 10. With erosion and sediment control and storm water management,this project meets the spirit and intent of the Lower St. Croix Riverway District since it will not degrade the scenic, recreational, or natural values of the St. Croix River Valley, and will not negatively affect the public health, safety and welfare of County residents. Approval of the land use permit is subject to the following conditions: 1. Prior to commencing construction,the applicants shall submit a Compliance Deposit in the amount of $350 to be held by the Zoning Administrator until all conditions have been completed and approved, at which time it will be refunded in full pursuant to Section 17.36 J.8 of the Ordinance. 2. Prior to commencing construction of garage,the applicant shall install silt fence around the construction site to control erosion in accordance with the enclosed pamphlet titled Erosion Control for Homebuilders. The silt fence shall be located a minimum of 40 feet from the blufflines to the north and to the south to ensure that no filling and grading activities occur within 40 feet of either bluffline. Immediately upon completing construction,permanent native groundcover shall be established on all disturbed areas. The silt fence shall be maintained until permanent native groundcover has successfully established. 3. The garage shall be located a minimum of 45 feet from the bluffline flagged by staff from the Wisconsin Department of Natural Resources on June 7, 2007, and as indicated in the revised site plan submitted on June 14,2007. 4. The height of the garage shall not exceed 20 feet as measured from the lowest adjacent grade to the midpoint between the eaves and the peak(or highest point if the structure has a flat roof). 5. All siding, shingles,trim, and other appurtenances of the carport shall be earth tone in color so as not to be visually conspicuous from the St. Croix River. 6. All existing native vegetation—including trees, shrubs,and groundcover-on and within 40 feet of the bluffline shall be maintained at the current level and enhanced as necessary to replace dead, diseased, or dying trees and shrubs in accordance with the vegetation standards in Section 17.36 H.B. of the Lower St. Croix Riverway District. 7. Within one year of this approval,the applicant shall remove all remaining sheds and garages as indicated in the April 27,2007 letter to staff. 8. Within 30 days of completing construction,the applicant shall install a rain garden in accordance with the. 9. Within 30 days of completing construction,the applicant shall execute and record an affidavit describing the rain garden,as well as a maintenance agreement for the rain garden, with the County Register of Deeds pursuant to Section 1.7.36 H.7.g. of the Lower St. Croix Riverway District. The affidavit shall alert subsequent purchasers of the land of the maintenance requirements of the plans. The applicant shall submit a copy of the recorded affidavit,along with an as-built drawing and photos of the completed construction and rain gardens,to the Zoning Administrator. 10. All siding, shingles,trim, and other appurtenances of the structure, including the roof, shall be earth tone in color and of a non-reflective nature(except for windows) so as not to be visually conspicuous from the St. Croix River pursuant to Sections 17.36 G.5.c.2)a)and 17.36 H.1 of the Ordinance. 11. Within 30 days of substantially completing the proposed construction,the applicant shall submit to the Zoning Administrator certification from the project engineer or architect that the alterations and all associated storm water management measures have been done in compliance with the approved plans, as well as photos of the completed construction,plantings, and infiltration area(s)as viewed from all angles, including from the blufflines and the river. 12. All activities approved as part of this land use permit shall commence within one year from the date of approval and be substantially completed within two years,after which time the permit expires pursuant to Section 17.36 J.7 of the Ordinance. Prior to expiration,the applicant may request extensions of up to six months from the Zoning Administrator. The total time granted for extensions shall not exceed one year. 13. Failure to comply with the conditions above may result in the revocation of this permit pursuant to Section 17.36 J.8.b of the Ordinance. This approval does not allow for any construction,grading,filling,or clearing of vegetation beyond the limits of this request. Please verify. - It appears that you will be adding driveway accesses to the north and east of the new garage. What is the total square footage of .surface area for these driveways? Will they be gravel or paved? - The closest point of the garage to the bluffline is 45 feet. Please verify that the grading limits for the project will not extend more than five feet from the foundatiun. If possible, please get me this information before 1:30 today. I have to leave for an appointment at 2: 30 and would like to finish the permit before then if possible. Otherwise I won't be able to get back to it until Monday morning.
