I 8. The Wisconsin Department of Natural Resources has reviewed the plans and has verified that a Chapter 30 permit is not required. Based on these findings, approval of the land use permit is subject to the following conditions: 1. The applicant shall contact the Zoning Administrator prior to commencing construction and when all construction is completed. 2. The height of the additions to the principal structure shall not exceed 35 feet and the height of the accessory structure shall not exceed 20 feet. Height shall be measured from the lowest adjacent grade to the midpoint between the eaves and the peals. 3. Prior to commencing construction,the applicant shall install a double row of reinforced silt fence around the perimeter of the construction site and any stockpile areas draining toward the lake. During constriction,the smallest amount of bare ground shall be exposed for as short a time as possible. Silt fence shall be maintained until self-sustaining vegetation is established. � b g 4. No phosphorous fertilizers shall be used to establish and maintain a lawn on the disturbed area of the site, unless a soil test confirms that phosphorous is needed. 5. The applicant shall direct all roof runoff from the principal structure and the garage to the existing depression between the structure and lake. This depression shall be maintained as a storm water infiltration basin to capture at minimum 1.5 inches of runoff from the square footage of roof area directed to it. The infiltration basin shall be maintained consistent with the enclosed document titled Storm Water Basins— Using Natural Landscaping for Water Quality and Esthetics. 6. The applicant shall plant and maintain additional native trees, shrubs and groundcover within 35 feet of the OHWM of Cedar Lake consistent with the Wisconsin Department of Natural Resources report titled, Designation of Sensitive Areas in Cedar Lake, St. Croix County, and with the vegetation standards in the Shoreland District in the St. Croix County Zoning Ordinance in order to: • substantially screen the principal structure from the lake during summer leaf-on conditions, • filter and slow storm water runoff from the site before reaching the lake, and • preserve the natural ecology and wildlife habitat in this sensitive area(see Condition#7 below). 7. Within 30 days of completing construction, the applicant shall submit to the Zoning Administrator photos of the completed project as viewed from all angles, including the shoreline of Cedar Lake. The photographs must also show the storm water infiltration basin and native plantings within the 35-foot shoreline buffer area. The applicant shall plant additional native trees, shrubs, and groundcover as required by the Zoning Administrator to meet the conditions above. 8. Within 30 days of completing construction,the applicant shall record an affidavit with the Register of Deeds referencing this pen-nit and a long-term maintenance and monitoring agreement for the storm water infiltration basin and the 35-foot shoreline buffer, and submit recorded copies of these documents to the Zoning Administrator at this time. The purpose is to alert future property owners of the responsibilities and limitations incurred by this permit and the maintenance and monitoring agreement. This approval does not allow for any additional construction, structures or structural changes, grading, filling, or clearing of vegetation beyond the limits of this request. Your information will remain on file in the St. Croix County Planning and Zoning Department. You must obtain a building permit from the Town of Star Prairie prior to commencing construction. You must complete the project as described on or before September 15, 2002. If you will not complete the project by this date, you must submit a written request for an extension prior to the expiration date of the permit. You may not begin or continue construction after the original permit expiration date unless the Department grants a new permit or permit extension in writing. 2. This permit does not authorize any work other than what you specifically describe in your application and plans, and as modified by the conditions of this permit. You are responsible for obtaining any permit or approval that may be required for your project by local zoning ordinances or by the U.S. Army Corps of Engineers before starting your project. 4. You must also have a copy of the permit and approved plan available at the project site at all times until the project is complete. 7. Your acceptance of this permit and efforts to begin work on this project signify that you have read, understood and agreed to follow all conditions of this permit. 8. You must submit a series of photographs to the Department, within one week of completion of work on the site. The photographs must be taken from different vantage points and depict all work authorized by this permit. 9. You, your agent, and any involved contractors or consultants may be considered a party to the violation pursuant to Section 30.292, Wis. Stats., for any violations of Chapter 30, Wisconsin Statutes or this permit. 10. Construction shall be accomplished in such a manner as to minimize erosion and siltation into surface waters. Erosion control measures such as silt fence and straw bales must meet or exceed the standards in the Wisconsin Construction Site Best Management Practices Handbook. 11. Disturbance of bank vegetation must be kept to a minimum during construction. Any vegetative removal must comply with local zoning regulations. 12. The project must be constructed in such a manner as to prevent upland soil losses and sediment deposition into surface waters. FINDINGS OF FACT 1. Jerome Hermann has filed an application fora permit to place stabilization material on the shoreline of Cedar Lake, located in the Town of Star Prairie, St. Croix County, also described as in the %of, Township 31 North, Range 18 West. 2. The project will consist of placing large field stone in front of a retaining wall to prevent ice shifts from damaging the retaining wall. The wall will be roughly 10 feet in length and 2'-3'feet in height. 3. The Department has completed an investigation of the project site and has evaluated the project as described in the application and plans. 4. The proposed project, if constructed in accordance with this permit will not adversely affect water quality, will not increase water pollution in surface waters and will not cause environmental pollution as defined in s. 283.01(6m), Wis. Stats. 5. The Department of Natural Resources and the applicant have completed all procedural requirements and the project as permitted will comply with all applicable requirements of Sections 1.11, 30.12(3), , Wisconsin Statutes and Chapters NR 102, 103, 115, 116, 117, 150, 299 of the Wisconsin Administrative Code. CONCLUSIONS OF LAW 1. The Department has authority under the above indicated Statutes and Administrative Codes, to issue a permit for the construction and maintenance of this project. NOTICE OF APPEAL RIGHTS If you believe that you have a right to challenge this decision, you should know that the Wisconsin statutes and administrative rules establish time periods within which requests to review Department decisions shall be filed. To request a contested case hearing pursuant to section 227.42, Wis. Stats., you have 30 days after the decision is mailed, or otherwise served by the Department, to serve a petition for hearing on the Secretary of the Department of Natural Resources, P.O.
