I have reviewed these materials and still require the following information: • Condition#1 of your land use permit states that you must submit a compliance deposit prior to commencing construction. We have not received this deposit. • Condition#2 of your land use permit states that the vegetation management plan must encompass the area along the top of the slope preservation zone and within 40 feet of the bluffline between the principal structure and the river. Within this area, you must plant native trees,shrubs,and groundcover to ensure that the existing principal structure,trellis, and proposed roof alterations are visually inconspicuous in their entirety from the St. Croix River and to comply with the vegetation standards in Sections 17.36 H.8 and 17.36 I.5.c.1)of the Ordinance. In reviewing the photographs, it appears that your residence and proposed alterations will be visually inconspicuous from the river. However,the vegetation management plan does not include native vegetation within 40 feet of the bluffline, does not include additional trees and shrubs, and does not meet the vegetation standards in Section 17.36 H.B. of the Ordinance. Section 17.36 H.8 provides that, in addition to screening structures, vegetation in the Riverway District shall be managed with the goals of preventing disturbance of environmentally sensitive areas such as steep slopes and bluff top areas, maintaining and restoring historically and ecologically significant plant communities and enhancing diversity, and maintaining and restoring native ground cover, understory, and overstory. The vegetation plan does not currently meet all of these goals. You must submit a revised plan that incorporates additional native trees, shrubs, and groundcover. Additionally,the plan must be more detailed to show the location, number/density, size, and species of existing and proposed trees, shrubs, and groundcover along the top of the slope preservation zone and within 40 feet of the bluffline. Since the residence appears to be screened from the river,you may reduce the density of trees originally required as part of this condition. I would be happy to meet with you to determine an appropriate number and placement of trees and shrubs to meet the goals of the Ordinance. • Condition#3 of your land use permit states that you must record an affidavit against your property referencing the approved vegetation plan. The draft affidavit that you submitted looks good. Once your revised vegetation plan is approved,you must record it with the St. Croix County Register of Deeds. Please contact me if you would like to schedule a meeting to discuss these conditions. If you wish to appeal staff decisions on any of these matters, you may do so by filing with the Zoning Administrator and the St. Croix County Board of Adjustment a notice of appeal specifying the grounds thereof. This notice of appeal must be filed within a reasonable time and will require a public hearing pursuant to Section 17.70(6)of the St. Croix County Zoning Ordinance. The existing 3,481-square foot structure is located over 200 feet from the Ordinary High Water Mark (OHWM) of the St. Croix River and approximately 60 feet from the bluffline at its closest point. The height of the existing structure is approximately 30 feet. The alterations and expansion approved as part of this land use permit include removing a deck on the riverward side of the structure and replacing it with a trellis; overlaying the existing hip roof to create full-height gables; raising one section of the roof over the existing dining room, vestibule, and entry to match the roof height of the upper floor bedrooms; installing a new covered entry on the landward side of the structure; and installing a new walkway to this entry. Additional work proposed as part of this project that does not require a County land use permit but still requires a Town building permit includes installing new windows and siding, and re-roofing the entire structure. Staff finds that the request meets the requirements of the St. Croix County Zoning Ordinance and the Lower St. Croix Riverway District based on the following findings: 1. The property is located in the Rural Residential Management Zone of the Lower St. Croix Riverway District; 2. No filling and grading will occur on slopes over 12 percent or within 40 feet of the bluffline. Only minimal filling and grading is proposed to install footings for the proposed covered entry and to install the walkway on the landward side of the principal structure; 3. The proposed trellis,covered entry,and walkway will add less than 100 square feet of impervious coverage to the site since they will replace existing impervious coverage; 4. The proposed roof alterations will not increase the height of the existing principal structure; 5. The existing principal structure and proposed trellis,entry and walkway all meet the 200-foot setback from OHWM of the St. Croix River; 6. The existing principal structure and proposed trellis do not meet the 100-foot setback from the bluffline and the majority of native vegetation along the top of the slope preservation zone and within 40 feet of the bluffline has been cleared. Since both structures are located over 40 feet from the bluffline,the principal structure may be altered and expanded and the trellis may be constructed provided the finished structures do not protrude above the bluffline,utilize building materials that are earth tone in color and non-reflective,and are made visually inconspicuous with native tree and shrub plantings pursuant to Section 17.36 G.5.c.2.a)of the Ordinance; 7. With conditions for planting additional native trees, shrubs, and groundcover along the top of the slope preservation zone and within the 40-foot bluffline setback area,the existing principal structure and proposed trellis and roof alterations will not be visually conspicuous from the St. Croix River and the property will be brought into compliance with the current standards in the Lower St. Croix Riverway District; 8. The existing principal structure features brown, earth tone siding and shingles. With conditions for finishing all improvements in earth tone colors,the structure will blend in with the natural surroundings; 9. The proposed covered entry and walkway will be located on the landward side of the existing principal structure and will not be visible from the river; 10. The St. Croix County Land and Water Conservation Department has reviewed the plans and visited the site and recommends that, as a condition of this permit,native vegetation be re-established in the slope preservation zone to provide screening; 11. The Wisconsin Department of Natural Resources has reviewed the plans and does not object to the approval of this permit;and 12. With the conditions stipulated above,this project will meet the spirit and intent of the Lower St. Croix Riverway District since it will not degrade the scenic,recreational,or natural values of the St. Croix River Valley,and will not negatively affect the public health,safety and welfare of County residents. Approval of the land use permit is subject to the following conditions: 1. Prior to commencing construction,the applicant shall submit a Compliance Deposit in the amount of $300 to be held by the Zoning Administrator until all conditions have been completed and approved, at which time it will be refunded in full pursuant to Section 17.36 J.8 of the Ordinance. 2. Prior to commencing construction,the applicant shall submit to and have approved by the Zoning Administrator a vegetation management plan for the top of the slope preservation zone and the area and the river. Within this area the applicant within 40 feet of the bluffline between the principal structure pp structure,trellis and shall plant native trees, shrubs, and groundcover to ensure that the existing st , roof alterations are visually inconspicuous in their entirety from the St. Croix River and to proposed Y P Y comply with the vegetation standards in Sections 17.36 H.8 and 17.36 1.5.c.1) of the Ordinance. All trees within this area shall be at least two inches Diameter at Breast Height(DBH)and planted no more than 12 feet apart and staggered parallel to the river and the structure. As part of the plan,the applicant shall III include some faster growing trees species to provide immediate screening as the slower growing species g g p P g g g P reach maturity, and shall agree to allow the area along the top of the bluff to regenerate naturally and not to dump grass clippings and branches down the slopes,which can hinder the growth of native vegetation and contribute to nutrient runoff into the St. Croix River. This vegetation management plan shall be implemented immediately upon completing construction(as weather allows). 3. Within 14 days of approval of the vegetation management plan,the applicant shall record an affidavit with the Register of Deeds referencing the plan and provide a recorded copy to the Zoning Administrator pursuant to Section 17.361.5.c.4)of the Ordinance. The purpose of this is to alert future property owners of the responsibilities and limitations incurred by the plan. 4. The finished principal structure shall be no taller than 35 feet in height pursuant to Section 17.36 G.4.a.1) of the Ordinance. 5. All siding, shingles,trim, and other appurtenances of the structure and the new roof shall be earth tone in color and of a non-reflective nature(except for windows) so as not to be visually conspicuous from the St. Croix River pursuant to Sections 17.36 G.5.c.2)a)and 17.36 H.l of the Ordinance. 6. Within 30 days of substantially completing the proposed expansion,the applicant shall submit to the Zoning Administrator certification from the project engineer or architect that the height of the structure does not exceed 35 feet, as well as photos of the completed construction and vegetation plantings as viewed from the bluffline and the river. 7. All activities approved as part of this land use permit shall commence within one year from the date of approval and be substantially completed within two years,after which time the permit expires pursuant to Section 17.36 J.7 of the Ordinance. Prior to expiration, the applicant may request extensions of up to six months from the Zoning Administrator. The total time granted for extensions shall not exceed one year. 8. Failure to comply with the conditions above may result in the revocation of this permit pursuant to Section 17.36 J.8.b of the Ordinance. This approval does not allow for any construction beyond the limits of this request. Your information will remain on file in the St. Croix County Planning and Zoning Department. You must contact the Town of St. Joseph to obtain a building permit. It is your responsibility to ensure compliance with any other local, state, and federal rules or regulations.
