REVIEW:
The Zoning Administrator will review the application for completeness and assign a file number to the application.The Zoning
Administrator may require additional information and will notify the applicant of this within 10 days.Upon receiving a complete
application and supporting documents,the Zoning Administrator will:
• send copies of the applications to the appropriate reviewing agencies for comment.Applicants are encouraged to contact their
town to discuss their application and inquire about necessary building permits and approvals at the town level;
• schedule a site visit to the applicant's property,at which time the applicant shall flag all applicable property/project corners
and label the flags accordingly;and
• review the file and prepare findings for approval or denial of the permit within 60 days.Upon approval,the permit will be
mailed to the applicant or to the applicant's agent.
If approved,the land use permit will be valid for one year from the date of the permit issuance.The applicant may also be required to
apply through the Town for a local building permit.All site plans,pictures,and other materials submitted with the application become
the property of the Planning and Zoning Department and will remain in the file.

• any other unique limiting conditions of the property or information deemed necessary by the Zoning Administrator.
For projects that involve land disturbance requests,the following additional information may be required:

Dear Mr. and Mrs. Shurb:
This letter confirms zoning approval to alter the roof on an existing principal structure in the Lower
St. Croix Riverway District in the Town of St. Joseph pursuant to Section 17.36 F.2.a.1 of the St.
Croix County Zoning Ordinance. The existing structure is over 200 feet from the Ordinary High
Water Mark (OHWM) of the St. Croix River and approximately 74 feet from the bluffline at its
closest point. The proposed alteration will increase the height of the structure from 15 feet, 5 inches
to 27 feet, 2 inches. Staff finds that the request meets the requirements of the St. Croix County Zoning
Ordinance and the Lower St.Croix Riverway District,with the following findings:
1. The property is in the Rural Residential Management Zone;
2. No grading and filling is proposed as part of this project;
3. The footprint of the existing principal structure will not be expanded or enlarged;
4. The proposed vertical expansion meets the height requirement for principal structures;
5. The existing principal structure exceeds the setback from OHWM of the St.Croix River;
6. The existing principal structure does not meet the 100-foot setback from the bluffline,and the
majority of native vegetation along the top of the bluff and within 40 feet of the bluffline has
been cleared. Since the structure is located over 40 feet from the bluffline, it may be expanded
vertically provided the finished structure does not protrude above the bluffline,utilizes
building materials that are earth tone in color and of a non-reflective nature,and is made
visually inconspicuous with native tree and shrub plantings;
7. With conditions for planting additional native trees, shrubs, and groundcover within the
40-foot bluffline setback area and finishing the structure in earth tone colors, the existing
principal structure and proposed vertical expansion will not be visually conspicuous from
the St. Croix River and the property will be brought into compliance with the vegetation
management standards in the Lower St. Croix Riverway District;
8. The Wisconsin Department of Natural Resources has reviewed the plans and does not object
to the approval of this permit; and
9. With the conditions stipulated above,this project will meet the spirit and intent of the Lower
St.Croix Riverway District since it will not degrade the scenic,recreational,or natural values
of the St. Croix River Valley,and will not negatively affect the public health, safety and
welfare of County residents.
Approval of the land use permit is subject to the following conditions:
1. Prior to commencing construction,the applicant shall submit a Compliance Deposit in the
amount of$300 to be held by the Zoning Administrator until all conditions have been
completed and approved, at which time it will be refunded in full pursuant to Section 17.36
J.8 of the Ordinance.
2. Prior to commencing construction,the applicant shall submit to and have approved by the Zoning
Administrator a vegetation management plan for the area along the top of the bluff and within 40 feet of
the bluffline between the principal structure and the river. Within this area, the applicant shall plant
native trees, shrubs, and groundcover to ensure that the existing structure and proposed vertical
expansion are visually inconspicuous from the St. Croix River and to comply with the vegetation
standards in Sections 17.36 H.8 and 17.36 1.5.c.1)of the Ordinance. All trees shall be at least two inches
Diameter at Breast Height(DBH)and planted no more than 12 feet apart and staggered parallel to the
river and the structure.As part of the plan,the applicant shall agree to allow the area along the top of the
bluff to regenerate naturally, and not to dump grass clippings and branches down the slopes, which can
hinder the growth of native vegetation and contribute to nutrient runoff into the St. Croix River. This
vegetation management plan shall be implemented immediately upon completing construction (as
weather allows).
3. Within 14 days of approval of the vegetation management plan,the applicant shall record an affidavit
with the Register of Deeds referencing the plan and provide a recorded copy to the Zoning
Administrator pursuant to Section 17.36 I.5.c.4)of the Ordinance. The purpose of this is to alert future
property owners of the responsibilities and limitations incurred by the plan.
4. The house shall be no taller than 35 feet in height pursuant to Section 17.36 GA.a.1) of the Ordinance.
5. All siding, shingles,trim, and other appurtenances of the house and the new roof shall be earth tone in
color and of a non-reflective nature(except for windows) so as not to be visually conspicuous from the
St. Croix River pursuant to Sections 17.36 G.5.c.2)a)and 17.36 H.1 of the Ordinance.
6. Within 30 days of substantially completing the proposed expansion, the applicant shall submit to the
Zoning Administrator certification from the project engineer or architect that the height of the structure
does not exceed 35 feet, as well as photos of the completed construction and vegetation plantings as
viewed from the bluffline and the river.
This approval does not allow for any construction beyond the limits of this request. Your information will
remain on file in the St. Croix County Planning and Zoning Department. You must contact the Town of St.
Joseph to obtain a building permit, and obtain verification on whether or not your existing sanitary system is
adequate for the proposed expansion. It is your responsibility to ensure compliance with any other local, state,
and federal rules or regulations. If you have any questions, please do not hesitate to contact me.

I rec'd a call this morning from a Peter Thompson concerned with the
Rolle land subdivision. I explained the process of
application/variance/cond. Use/spec. exemption and told him that he has
opportunities through the county as well as the town to express his
opinions. He's not in favor of Rolle's current plan. I would guess
he'll be contacting you.

Hi Dan,
This property is in the Rural Residential zone. I haven't been out to
the property yet, but based on the site plan and the photos submitted it
appears that the house is outside of the OHWM setback area and is 74
feet from the bluffline at its closest point.
The Ordinance allows the bluffline setback to be reduced to 40 feet if
the structure does not protrude above the bluffline, is not in the SPZ,
is earthtone, and is visually inconspicuous. So, if those standards are
met and I can verify the measurements on the site plan, I'm thinking
we'd address this as a legal conforming structure. Either way I would
require additional vegetative screening as a condition of approval . I
would also push for storm water management, although we can't require it
if the applicant is not increasing the amount of impervious coverage.
Let me know if you would approach this differently.

After reviewing some older permits that were never followed up with by zoning staff,

Planning I came across your 2006 land use permit. At the time, this Department was lacking
715-386-4674 the resources to follow up with every permit that was issued. Even though much
time has passed since then, I wish to finish verifying that the conditions of the
Real Prop permit have been met. This Department still holds a $300.00 compliance deposit
715-3 677 from you. I think it would be most appropriate to check the status of all the
conditions of the permit, bring any outstanding concerns into compliance, return the

Condition 2: Prior to commencing construction, the applicant shall submit to and
have approved by the Zoning Administrator a vegetation management plan for the
area along the top of the bluff and within 40 feet of the bluffline between the
principal structure and the river. Within this area, the applicant shall plant native
trees, shrubs, and groundcover to ensure that the existing structure and proposed
vertical expansion are visually inconspicuous from the St. Croix River and to comply
with the vegetation standards in Sections 17.36 H.8 and 17.36 1.5.c.4) of the
Ordinance. All trees shall be at least two inches Diameter at Breast Height (DBH)
and planted no more than 12 feet apart and staggered parallel to the river and the
structure. As part of the plan, the applicant shall agree to allow the area along the
top of the bluff to regenerate naturally, and not to dump grass clippings and
branches down the slopes, which can hinder growth of native vegetation and
contribute to nutrient runoff into the St. Croix River. This vegetation management
plan shall be implemented immediately upon completing construction (as weather
allows). I do not believe that this was ever submitted. Please let me know the
status of this condition. All I am looking for is a plan showing how the house
will be screened(from the river) by vegetation and that the bluffline will be
protected from erosion by using native vegetation.
Condition 3: Within 14 days of approval of the vegetation management plan, the
applicant shall record an affidavit with the Register of Deeds referencing the plan
and provide a recorded copy to the Zoning Administrator pursuant to Section 17.36
