Staff finds that the proposed project 715-386-4674,:;F meets the requirements of the St. Croix County Zoning Ordinance and the Lower St. Croix Riverway District, with the following findings: Real Pro rty 1. Section 17.36 F.2.a.5) of the Ordinance allows filling and grading less than 10,000 square 715;;- G-4677 feet outside of the slope preservation zone and greater than 40 feet from the slope preservation zone a land use permit subject to the standards in Section 17.36 H.5. R CIng 2. The proposed grading limits to install the sanitary system span an area of less than 1,000 5-386-4675 square feet and are located greater than 40 feet from the slope preservation zone. 3. The standards in 17.36 H.5 of the Ordinance have been met as follows: • No filling and grading of wetlands will occur as a part of this project. • No filling and grading will occur on or within 40 feet of a slope preservation zone. • With a condition for using BMPs for erosion control before, during and after installation of the sanitary system, the proposed project will minimize erosion, sedimentation, tree damage, and impairment of fish and wildlife habitat. • With a condition to replace any native trees and shrubs that need to be removed, the proposed project will not have a negative impact on the existing native vegetation along the St. Croix River. 4. The Land and Water Conservation Department has reviewed the plans and recommends that all disturbed areas are seeded and mulched immediately after installation. 5. The Wisconsin Department of Natural Resources has reviewed the plans and recommends that disturbance to soils and existing vegetation be minimized, and that all disturbed areas be seeded and mulched immediately. Approval of the land use permit is subject to the following conditions: I. This approval if for the applicant to do filling and grading to install a sanitary system on his property in accordance with the plans received on October 2, 2006, and as provided in the conditions below. 2. Prior to commencing construction,the applicant shall submit a Compliance Deposit in the amount of$300 to be held by the Zoning Administrator until all conditions have been completed and approved, at which time it will be refunded in full pursuant to Section 17.36 J.8 of the Ordinance. 3. The applicant shall follow the Best Management Practices recommended for erosion control in the enclosed document titled Erosion Control for Home Builders. 4. Immediately upon completing installation of the sanitary system, the applicant shall seed and mulch the disturbed area.
