30 permit is not required for the proposed filling and grading activities.The Department does not have any
concerns provided the project is done in accordance with the standards in the Lower St.Croix Riverway
District.
7. With conditions,this project will meet the spirit and intent of the Lower St.Croix Riverway District since it
will not degrade the scenic,recreational,or natural values of the St.Croix River Valley,and will not
negatively affect the public health, safety and welfare of County residents.
Approval of the land use permit is subject to the following conditions:
1. Prior to commencing construction,the applicants shall submit a Compliance Deposit in the amount of
$350 to be held by the Zoning Administrator until all conditions have been completed and approved,at
which time it will be refunded in full pursuant to Section 17.36 J.8 of the Ordinance.
2. Prior to commencing construction or any filling and grading activities,the applicant shall install silt fence
around the construction site in accordance with the grading and erosion control plan. Immediately upon
completing construction,the applicants shall seed and mulch all disturbed areas.The silt fence shall be
maintained until permanent, self-sustaining vegetation has been established.The applicants shall not use
phosphorous fertilizers to establish and maintain a lawn on the disturbed area of the site,unless a soil test
confirms that phosphorous is needed.
3. The completed addition shall be no taller than 35 feet in height.
4. All siding, shingles,trim,and other appurtenances of the addition shall be earth tone in color so as not to
be visually conspicuous from the St.Croix River.
5. All existing vegetation—including trees and shrubs-on and within 40 feet of the bluffline shall be
maintained at the current level and enhanced as necessary to replace dead,diseased,or dying trees and
shrubs in accordance with the vegetation standards in Section 17.36 H.B. of the Ordinance.
6. Within 30 days of substantially completing the project,the applicant shall submit to the Zoning
Administrator certification from the project engineer/architect that the addition and driveway
reconfiguration have been completed as approved,as well as photos of the completed construction.
7. Within 30 days of substantially completing construction,the applicants shall execute and record an
affidavit against the property referencing the storm water management plan and designated infiltration
areas.The applicants shall provide recorded copies of the affidavit to the Zoning Administrator at this
time. The intent is to make the current and future owners aware of the responsibilities as well as the
limitations incurred as a result of the conditions of this permit.
This approval does not allow for any construction,filling and grading activities,or vegetation removal
beyond the limits of this request. Your information will remain on file in the St. Croix County Planning and
Zoning Department. Please contact the Town of Troy to obtain the necessary permits and approvals under its
Lower St. Croix Riverway Ordinance.It is your responsibility to ensure compliance with any other local,state,or
federal rules or regulations. If you have any questions,please do not hesitate to contact me.

This letter confirms zoning approval to construct a two and a half story 1479 square foot addition

as indicated in the plans submitted as part of your application and as provided in the conditions

below. Staff finds that the proposed project meets the requirements of the St. Croix County Zoning
715.4. -4677 Ordinance and the Lower St.Croix Riverway District,with the following findings:
1. Section 17.36 F.2.a.1) of the Ordinance allows single-family dwellings and accessory
Rycling structures with a land use permit subject to the applicable standards in Sections 17.36 G and
!W-386-4675 17.36 H.
2. The standards in 17.36 G and H have been met for the proposed addition as follows:
• The existing principal structure and proposed addition meet the required setbacks from the
bluffline, OHWM,road,and adjacent property lines.
• The proposed addition meets the height requirements for principal structures.
• The proposed addition will be earth tone in color.
• No trees will be removed within 40 feet of the bluffline, within the slope preservation
zone, or within the OHWM setback.
• The proposed addition will be visually inconspicuous from the St. Croix River.
• The proposed addition will not protrude above the bluffline.
3. Section 17.36 F.2.a.2) of the Ordinance allows filling and grading less than 10,000 square
feet outside of the slope preservation zone and greater than 40 feet from the bluffline with a
land use permit subject to the standards in Section 17.36 H.5.a.1)
4. The standards in Section 17.36 H.5.a.1)-5)have been met for the proposed filling and grading
activities as follows:
• The grading limits for the proposed project are less than 10,000 square feet.
• No grading, filling, or tree removal is proposed on or within 40 feet of the slope
preservation zone.
• The applicants have submitted erosion control and storm water management plans to
minimize erosion, sedimentation, and tree damage on the site.
• The proposed filling and grading will not impair fish and wildlife habitat since the lot is
located over 400 feet from the shoreline.
5. The St. Croix County Land and Water Conservation Department has reviewed the storm water
and erosion control plans and fords them to be in compliance with the Lower St. Croix
Riverway standards.
