After long discussion, deliberation and review of testimony this
committee voted to delay for one year the request of Jon-De Farm
for a variance under chapter 17.14(6)h of the St. Croix Co.
Ordinance.
A summation of rationale for the board's decision is as follows:
1) Concerns expressed by Rush River Town Board;
2) Confusion and conflict on testimony on number of animal
units;
3 ) Confusion of the implementing NR 243 . 142 (c) , the
installation of monitoring wells. Confusion as to the
placement, depth and testing procedure.
4 ) Under NR 243 . 14 ( 2 )c (pg. 194-7 ) it states "one is
required to obtain a WBDES permit SHALL, as part of
the permit application, develop and SUBMIT to the
department for approval an animal waste management plan" .
In view of the lack of a written plan the board could not
adequately consider the criteria as outlined in 243.142 (pg. 194-
7) . our main concern was item 2, 5. under above guidelines.
Therefore the board believed a delay would be fair for all
concerned. A letter from Thomas Nelson, County Zoning
Administrator to the Jon-De Farm dated Jan. 21, 1992 requested
certain information. We do not believe his request was
adequately addressed. We believe a delay would give Jon-De Farm
time to develop a waste management plan, resolution of monitoring
wells, and a track record with the operation at 250 animal units.
this delay would give this board, town board and concerned
neighbors a chance to evaluate the waste management plan on
facts, not on speculation and conjectures.
The waste management plan should address the rate of spreading on
the top dressing for alfalfa (hay) fields, delineation of high
water marks and waterways. Also we believe alternative sites
should be addressed for spreading because of natural phenomenon.
This summation was unanimously approved by the members present at
the Board of Adjustment hearing on Jan. 29, 1992.

The meeting was called to order by Chairman Kinney at 9:00 A.M.
Procedures of the hearing requesting that individuals wishing to
testify sign their names and addresses on the sheet in the front
of the room were given.
Supervisors Menter, Stephens and Kinney were in attendance.
Supervisors Sinclear and Bradley were excused. Staff present was
Tom Nelson, Zoning Administrator.
Stephens made a motion to approve the agenda as presented.
Seconded by Menter. Motion carried.
OLD BUSINESS
JOHN PFLEIDER
Nelson gave an update on the John Pfleider revocation stating
Pfleider had not submitted an application by Jan. 15, 1992 as had
been required by the Board of Adjustment.
Bill Radosivich, attorney representing Richard Karlson, requested
that citations and violations be issued. Discussion.
Stephens made a motion that citations and violations be issued
and that Corporation Counsel report on a monthly basis as to what
is being done about prosecution. Motion seconded by Menter.
Motion carried.
ANDERSON EXCAVATION, INC.
Bob Anderson requested that a site previously approved for
demolition materials be permitted again for the demolition of a
school.
DNR supports the proposal and the township of Eau Galle
recommends approval.
Stephens, made a motion that the request be approved contingent
upon a letter from the township. Seconded by Menter. Motion
carried.

The St. Croix County Board of Adjustment has scheduled a public
hearing for Wednesday, Jan. 29, 1992 at 9:30 A.M. in the County

JON-DE FARM, INC.
Nelson explained that the purpose of this hearing was for a
special exception permit to exceed 250 animal units for a dairy
operation.
Manure will be pumped to fields and then incorporated into the
soil . A storage facility has been constructed for 1 year
capacity for 250 cattle. More frequent incorporation would allow
for more cattle.
Dean Doornink provided several exhibits which further
described- the operation. The original loan for construction with
Farm Credit justified 304 cows.
Wayne Loocke , Gene Nelson, Ron Moore, Sandy Koreman, Malory
Monican, Dennis Koneman, Dave Rasmussen all expressed concerns
with nitrates and groundwater quality. Is there enough property
to adequately spread the manure? Discussion.
Don Siler from the soil conservation Service explained the
facility and that there was still the need to develop. an
operations plan for spreading.

Nelson stated that the Nybergs were requesting to build a deck
closer to the town road than permitted. The 40 foot requested is
actually further back than the existing residence which is 34
feet.
Sue Nyberg agreed and stated the township of Richmond supports
the proposal.
RICHARD KARLSON
Nelson stated that the request was to build a road in the Ag.
District to serve several residences.
This use is a special exception in the Ag. District.
Richard karlson agreed with the proposal.
K & M STORAGE/JOHN MORTEL
Nelson stated that there were still several concerns regarding
setbacks of the proposed storage building and that additional
information was needed.
John Mortel agreed to a postponement until Feb. so as to provide
the additional information.

FINDINGS OF FACT
Having heard the testimony and considered ,the evidence presented,
the Board find the following facts:
1. The applicant or appellant is: Jon-De Farm
2065 Co. Rd. J
Baldwin, WI 54002
2. The applicant or appellant is the owner of the following
described property which is the subject of the application or
appeal: NE 1/4 of the NW 1/4 of Sec. 24, Town of Rush River, St.
Croix Co.
3. The property is presently used for Agriculture and has been
so used continuously since 1970.
4. The applicant or appellant proposes: operate a feedlot of 300
cows.
5. The applicant or appellant requests a special exception use
permit under section 17.14(6) of the ordinance.
6. The features of the proposed construction and property which
relate to the grant or denial of the application or appeal are:
A decision was conducted on Jan. 29, 1992 to postpone a decision
until Jan. 29, 1993. This decision was in part because of the
lack of written animal waste plan.
An animal waste plan has been submitted. The Township of Rush
River opposes the proposal.

CONCLUSIONS OP LAW
Based on the above finding of fact the Board concludes that:
SPECIAL EXCEPTION:- The application for a special exception use
permit does quality under the criteria of Section 17.70(5) (c)4
and 17.14(6)n of the ordinance because the Board of Adjustment
has the authority to grant special exception use permits.
ORDER AND DETERMINATION
The basis of the above finding of fact, conclusions of law and
the record in this matter the board orders:
SPECIAL EXCEPTION: The requested special exception is granted
in part subject to the following conditions:
1) A 1 (one) year approval after which applicant must return
for review.
2) The animal waste management plan be implemented with the
Land Conservation Office and the Zoning Office reviewing
periodically. Immediately off to test potable water supplies of
all residences within 1 (one) mile of the facility and provide
this information to the Zoning Office.
3) After 1 (one) year retest the wells.
4 Zoning Office Township and Land Conservation Office have
access to review the facility.
Motion to approve by Bradley, seconded by Menter. Motion carried.
Vote: Menter, yes; Kinney, yes; and Stephens yes; Sinclear,
yes and Bradley, yes.
This decision may be appealed by filing an action in certiori in
the circuit court for this county within 30 days after the date
of filing f decision.

LAWRENCE HORTSCH & DARYL ZIMMER
Lawrence Horsch and Steve Hanks presented the proposal for two
lifts in the Riverway District. There is a management policy to
review the proposals allowing 1 lift per 3 lot owners.
Discussion. Neighbors and township support the proposals .
Easements need to be described and recorded for other landowners.
Stephens made a motion, seconded by Bradley to approve the tow
applications with the condition easement agreements be written.
Motion carried.

operation in Troy township. there is from 2 - 10 years of
material remaining depending on the demand.

A letter was read from Dan Koich of the DNR expressing concerns
of the structure having been placed on slopes exceeding 12%.
Jim Rusch, county surveyor, testified that in his opinion, the
garage has been placed on slopes exceeding 12%.
Various exhibits were presented and general discussion was heard
regarding these issues.

Henry presented a request for a nonmetallic mining operation and

place a concrete crushing facility in the NE portion of the
gravel pit. Discussion on the facility plan.

Bill is requesting an off premise sign at the location of the SE
1/4 of the SE 1/4 of Sec. 18, Township of cylon. This sign would
be directional in purpose for his auto salvage facility.

OLD BUSINESS
RICHARD VASAKA
Richard requested a special exception permit to construct an
addition over an existing porch that had existed at the time the
ordinance went into effect.
The proposed addition would be 12' by 161 , six feet smaller than
the original deck. The township of Troy, DNR and MWBA all support
the proposal.
FRANK BACHMAN
Steve Dunlap, attorney representing Frank Bachman presented his
request for a 60' variance for a 44' by 24' addition (new garage)
and a 11' by 22' addition (sitting room) . Steve stated that he
feel this should also be treated as a special exception.
Nelson stated that what he is requesting is a variance to a
dimension on a nonconforming use that is too close to the
bluffline. A variance can be granted if hardship can be proven.
The township of Troy supports the proposal, however, in the future
would like to know what the recommendation of the DNR is.
The DNR does not support the variance since no hardship can be
shown and there is a reasonable use of the land.

BASS LAKE CHEESE FACTORY/SCOTT ERICKSON
Scott presented a request for two directional signs for Bass Lake
Cheese Factory. The township of St. Joseph supports this proposal.
GARY BUTLER
Gary presented a request for a contract storage yard for his
plumbing business located in Warren Township. All equipment will
be stored in a 40' by 60' storage shed.
The township of Warren supports the proposal conditionally.
JOHN & CAROLINE TINKERS
John requested a variance being 7' closer to the township road. A
building plan was presented showing why the need of the
encroachment.
Nelson stated that the septic system needed to be replaced prior to
building permit issuance.
The township of Baldwin supports this proposal.
Upon completion of the hearing the Board of Adjustment committee
visited each site in question after the following decisions were
made:
RICHARD VASAKA
Motion by Stephens, seconded by Menter to approve the proposed
addition over the existing deck. No walk out will be allowed in
the basement and no future decks will be permitted. Motion
carried.
FRANK BACHMAN
Motion by Stephens, seconded by Kinney, to deny the request as
presented. the proposal is a variance request from a dimensional
standard of the ordinance. Since no hardship could be shown, and
other alternatives exist this proposal should be denied. Motion
carried.
RANDY BEACH
Stephens made a motion to sustain the original decision as made
previously, seconded by Neuman. Motion carried. Four to one vote
with Menter opposing.
JON-DE FARM, INC.
Motion by Stephens, seconded by Kinney to allow an extension on the
permit as had been requested. Motion carried.
BASS LAKE CHEESE FACTORY/SCOTT ERICKSON
Motion by Neuman, seconded by Stephens to approve the proposed
directional signs. Motion carried.

The St. Croix County Board of Adjustment has scheduled a public
