HomeMy WebLinkAbout028-1030-80-000 (2) 4 jy,L BOARD OF ADJUSTMENT MEETING AND HEARING February 24, 1992 (This meeting was recorded by a court reporter) The meeting was called to order by Chairman Kinney at 9:00 A.M. Chairman Kinney explained the procedures of the hearing, requesting that individuals wishing to testify sign their names and addresses on the sheet in the front of the room. Supervisors Menter, Stephens, Sinclear and Kinney were all in attendance. Supervisor Bradleys absence was excused. Staff present included Zoning Administrator Tom Nelson and Assistant Zoning Administrator Jim Thompson. OLD BUSINESS AT Dan presented a site plan showing his proposed major home occupation for a cabinet shop. Gene Nelson stated that the township supports the proposed home occupation. Stephens made a motion to grant the use as proposed. Seconded by Sinclear. Motion carried. M & M STORAGE Michael Mortel provided a survey verifying the 75' setback of the proposed storage building from the river as required by the Board of Adjustment. Motion by Stephens, seconded by Sinclear to approve the proposed commercial storage application as presented by the applicant. Nelson stated that John Pflieder has made application for his special exception permit as required by the Board of Adjustment. He is requesting that his citation and violations be suspended. Stephens made a motion to suspend the citation and violation until after the March Board of Adjustment meeting since he was now in compliance. Motion seconded by menter. NEW BUSINESS The hearing was called to order at 9:30 A.M. Nelson read the notice as published: 1 The St. Croix County Board of Adjustment has scheduled a public hearing for Monday, Feb. 24, 1992 at 9:30 A.M. in the County Board Room of the St. Croix County Courthouse, Hudson, Wisconsin to consider the following appeals to the St. Croix County Zoning Ordinance. An onsite investigation will be made of each site in question, after which the board contemplates adjournment into closed session for the purpose of deliberating on the appeals, pursuant to Sec. 19 . 85(1 ) (a) , Wisconsin Statutes , and will reconvene into open session for the purpose of voting on the appeals. 1. ARTICLE: 17.15(6) (d) Contractor Storage Yard APPELLANT: Edward Cernohous LOCATION: NW 1/4 of the NE 1/4 of Sec. 8, T28N-R19W, Town of Troy LANRENCE HORSCH Steve Hanks presented a plan for a mechanical lift to the St. Croix River down the bluff. Brad Lowman, an adjoining land owner expressed his concerns wanting to protect his future interests. Nelson stated that it has always been a management policy to allow 1 lift for every three property owners. Discussion. 2 Stephens made a notion, seconded by Sinclear, that this request as well as the next request by Daryl & Bonnie Zimmer be postponed until the next regular meeting so that property owners can be notified. Notice will include the neighbors three parcels on either side of the applicants so as to provide the opportunity for proper planning in accordance with the management policy. Motion carried. EUGENE & GARY LARSON Gary presented a site and concept plan for a private airstrip where others, by permission, can land on the runway.. A hanger may be constructed in the future to house the plane. There was a concern by the Board of Adjustment if proper documentation was received by the neighbors to the property. Discussion. Jerry Larson, town board chairman, stated that the township supports the proposal. DAN ORP/BILL LAWSON Bill presented a request to construct a driveway in the Shoreland District of Bass Lake on slopes that exceed 20%. This driveway would provide legal access to the property. Access at this time is provided across another persons property without an easement. The township of St. Joseph supports the proposal. ALLEN SIEKNEIER Allen Nyhagen presented a request for a driveway separation on property along STH 12. The parcel in question is a pre-existing parcel that cannot meet the 500 foot driveway separation. The township of Warren supports the proposal. GARY PULFORD Thompson explained that Gary Pulford was in violation of the Zoning Ordinance by building a living quarters above a detached garage. At this time Pulford is requesting a special exception use permit for a two family residence. He is proposing to enclose a corridor between the two buildings approximately 75' long. Town township of Somerset is opposed to the creation of a parcel split but would support two residences. ED CERNOHOUS Ed presented a request for a contractor storage yard on property 3 he owns in Troy township. Nelson stated complaints had been received for a junkyard and Cernohous was cited. Individuals expressing concerns were Tony Nasvik, Shelly Waldera, Renee' Bugni and Glen Wiesr. Dean Albert, townboard chairman, stated the township supports the proposal with a limit of 4 vehicles and no storage materials. OLD BUSINESS FRANK BACHMAN Steve Dunlap requested a postponement until the next regular meeting. He has not been able to obtain the assessment values of the structure as it existed in 1976 or the proposed values of the structure as it will be remodeled. Motion by Stephens, seconded by Menter to postpone a decision until the proper information can be presented. JOHN BETTENDORF Attorney Mark Gherity representing Bettendorf requested that the Board of Adjustment reconsider their denial of the variance request to exceed the driveway width of 35 feet. Their request is for 124 feet to accommodate the truck traffic. Gherity cited several examples of other commercial driveway that exceeded this setback. JOHN JOHNSTON John DeBoer stated that the commercial storage building would be to store inventory items for Doboy from New Richmond. There would be very limited traffic. Larry Isdahl stated the building would be 129,000 feet square and requires state plan approval. There will be no loading docks. Stephens made a motion to approve the storage use with the condition that State approved plans be received. Motion seconded by Bradley. Motion carried. 1 MARK MONTRBIRAND Nelson stated that Montbriands Board of Adjustment approval for an addition to his lake cabin has also required the installation of a holding tank. The one year period had lapsed and a violation was issued. Montbriand is requesting a extension of this period. Nelson stated that he was opposed to this request since he had a year to complete this project. Stephens made a motion to extend his installation date to May 1 of 1992. Motion seconded by Menter. Motion carried. LLOYD OLSON Nelson stated this was a request for a storage building to store boats, campers and etc. for individuals in the community. Bradley made a motion that the use be permitted as requested. Motion seconded by Stephens. Motion carried. NEW BUSINESS The hearing was called to order at 10:00 A.M. JAMES RABOIN Raboin requested an Auto Mechanic Business on this property that was recently rezoned to commercial. There are no other employees other than himself. No hazardous materials will be stored on the property. The township of Star Prairie supports this proposal. VERNON E. KLAUSTERMEIER Klaustermeier presented a request to build a storage shed 55 feet setback from the county road in Emerald. The existing building are currently closer than this setback. The township of Emerald supports this proposal. RANDY BEACH Beach presented an amended request of 70 feet setback from the center of a town road. The township of Stanton has opposed the original request of 60 feet since the other existing structures were setback further. The proposed structure is a 24 feet by 40 feet garage. After visiting the properties the following decision were made: JOHN BETTENDORF Stephens stated that the driveway at this time is noncompliance of the ordinance and original decision. Proper procedure for an appeal has not been followed and the driveway should be brought into compliance or cited with an violation.
