OF THE ZONING BOARD OF ADJUSTMENT
ST. CROIX COUNTY, WISCONSIN

FINDINGS OF FACT AND CONCLUSIONS OF LAW
Having heard all the testimony, considered the entire record herein, and conducted an
on-site inspection, the Board finds the following facts:
1. The applicant is Laurey Krear, whose address is 1912 18th Ave., Baldwin, WI
54002.
2. The applicant on September 30, 1997, filed with the Zoning Office an application
for a special exception request for a major home occupation permit.
3. Ralph and Patricia Gavic are the owners of the property which is the subject of
the application and is located in the NW 1/4 of the NW 1/4 of Section 26, T28N-
R17W, Town of Rush River, St. Croix County, Wisconsin.
4. Special Exception request is for a major home occupation permit under Section
17.155(6). A special exception is required where there is a major home
occupation.
5. The subject property is presently the home of the applicant.
6. The Town of Rush River supports the application.
7. The following exhibits were introduced:

Exhibit 2: Letter from the Town of Rush River recommending approval of the
application
Exhibit 3: Copy of the plot plan of the property showing the layout of the
buildings.
Exhibit 4: Schematic drawing of area of the home used for the proposed
business.
8. Laurey Krear and Ralph Gavic, being duly sworn, state that Krear is the applicant
and Gavic is the owner of the property.

9. Krear is the daughter of Mr. Gavic and she and her husband live in the home.
Laurey Krear would like to open a beauty shop in this home.
10. The beauty shop will be on the first floor of the two story home. The shop will take
up less than 20% of the space of the home.
11. Krear has had an operator license for this type of business for 19 years.
12. There are no plans to have employees, and the hours of operation will be
conducted between the hours of 8:00 a.m. and 10:00 p.m.
13. There will be one sign for the business and the size will be according to
dimensions allowed in the ordinance.
14. The Board of Adjustment finds that this special exception application conforms
with the requirements for granting a special exception under 17.155.(6)
15. Special Exception permits may be terminated under Section 17.70(7)(d) of the St.
Croix County Zoning Ordinance if the conditions of the decision are not met.
DECISION
On the basis of the above Findings of Fact, Conclusions of Law, and the record herein,
the Board approves the applicant's request for a special exception for a major home
occupation permit and has been approved on the following vote:

with the following conditions:
1) The Special Exception permit is issued to Laurey Krear.
2) No employees
3) All county and state permits to be obtained.
4) Hours of operation to be 8:00 a.m. to 10:00 p.m.
5) Applicant to secure all required permits.
6) Rezonement ordinance to be signed by County Board.

Any person aggrieved by this decision may file an appeal in St. Croix County circuit court
within 30 days after the filing date shown below, pursuant to sec. 59.694(l 0), Wisconsin
Statutes. St. Croix County assumes no responsibility for action taken in reliance on this
decision prior to the expiration of the appeal period. St. Croix County does not certify
that the identity of all persons legally entitled to notice of the Board of Adjustment
proceedings which resulted in this decision was provided to the County.
If an appeal is taken of this decision, it is the responsibility of the appellant to submit at
his/her expense a transcript of the Board of Adjustment proceedings to the circuit court,
which is available from Northwestern Court Reporters, Hudson, Wisconsin. It is the
responsibility of the Board of Adjustment to submit its record (file) of this matter to the
circuit court.
