Barber Zoning Administrator St. Croix County Zoning Office Hammond, Wi 54015 Dear Mr. Barber: I have reviewed the request by Mrs. Joan G. Kennedy for an after-the- fact permit to install a hot tub within the 40-foot bluffline setback zone. NR 118 and the St. Croix County Riverway Ordinance do not allow construction within 40 feet of the bluffline. Thus, the hot tub would have to be removed. However, Mrs. Kennedy claims the hot tub was installed for medicinal purposes. If she can prove the tub is necessary as part of a regular year-round program of therapy, I would say we would have to allow the installation of the tub. Then the only question remaining to be resolved is whether or not to allow it to remain at its present location or require that it be moved outside of the bluffline setback zone if possible. I would say it is up to your judgement to require the move or not. If you have any questions about this matter, please contact me at (715) 836-2941. St. Croix County Wisconsin Zoning Office Hammond, Wi. 54015 Attn: Harold C. Barber Zoning Administrator Dear Mr. Barber: Joan Kennedy has scoliosis involving her thoracic and lumbar spine. She gets frequent muscle spasm with this and has used "hydro therapy" for this in the past. I would certainly recommend that she continue to use this type of therapy. Apparently, she has such a pool or device on her own property. It would benefit her not to have to remove this apparatus. Cordial .M.
