Mr. Richard Stout presented his request to fill and grade a road that will enter a new minor subdivision which he is proposing. Mr. Al Nyhagen, land surveyor, showed the board drawings of the road construction. Zoning Administrator read letters from Land Conservation Department and D.N.R. Chairman Stephens read letters into the record. Steven Muza, attorney, presented the objections of the Stout request for Mr. and Mrs. Ron Gorke, talking about future easements. He feels that this could be a tres- pass, not an easement. Mr. Ron Gorke presented his objections to the Stout request with an overhead slide presentation. Mr. Thomas Huninghake presented his objections to the Stout request. Stakes for the road were on the property in question. Steven Muza stated that the photos were taken by Mr. Gorke. Richard Stout rebutted the objections of Gorke and Huninghake stating that he would have sold the property to the Gorke's and Huninghake. Al Nyhagen showed the board field notes on 5-3-84 and 6-28-84, walking over the proposed subdivision. He also staked the road within the right of way. Mr. Muza asked a question of Al Nyhagen as to whether or not he had talked to the Gorkes. Mr. Nolan Anderson presented his request to construct a house that would be within the area of the house that burned. The setback would be 80 feet from a town road. Hearing recessed to inspect the properties in question. Board returned to session to render decisions. 1. Joan Kennedy: Motion by Supervisor Meinke to approve the Joan Kennedy re- quest when proof of bond is received from St. Joseph Township, and as long as the holding tank meets all state requirements and extensions of driveway sidewalls are built to D.N.R specifications. Seconded by Supervisor Kelly. Motion carried. Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes. 2. Ralph Weggel: Motion by Supervisor Meinke to approve the dock as it meets the Corps of Engineers approval and the dock shall be removed annually before the river freezes over. Seconded by Supervisor Kelly. Motion carried. Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes. Arnold Beihoffer: Motion by Supervisor Kelly to grant approval of a 110 foot setback from CTH "C" and a 30 foot setback from the north property line, as this is the only way to utilize the lot. Seconded by Supervisor Meinke. Motion carried. Vote to approve: Kelly, yes; Meinke, yes; Stephens, yes. 4. Peter Banning: Motion by Supervisor Kelly to approve the lift with the con- dition that the least amount of trees be removed and the stairway shall be removed upon completion of the lift. Seconded by Supervisor Meinke. Motion carried. Vote to approve: Kelly, yes; Meinke, yes; Stephens, yes. 5. Richard Stout: Motion by Supervisor Stephens to approve the road in it's present configuration and meets all specs of the county and D.N.R. with the excep- tion of the blacktop. The road, properly installed, will not cause any significant harm to the adjoining property. Moving the road to the center of the easement will cause unnecessary harm to the Huninghake property. Seconded by Supervisor Kelly. Motion carried. Vote to approve: Stephens, yes; Kelly, yes; Meinke, yes. 6. Nolan Anderson: Motion by Supervisor Stephens to table this request until more information is received on percolation test, type and location of a sewer system. In the event the approval by the Zoning Administrator, and present location of the house stakes are not over the present sanitary system. MT. Anderson to bring the above information to the May Board of Adjustment hearings. Seconded by Supervisor Kelly. Motion carried. Mrs. Kennedy has a pumping agreement with Gene Cudd, dated March 18, 1985, and township approval with a $500 Performance Bond. Mr.Ogden also presented the correspondence on widening the driveway from D.N.R., giving approval, dated 12-11-84. Motion by Supervisor Stephens to deny the request of Arthur Partridge as they have not sent in information required. Seconded by Supervisor Meinke. Motion carried. Vote to deny: Kelly, yes; Meinke, yes; Stephens, yes. Mr. Ralph Weggel presented his request to construct a removable dock in the St. Croix River. He has approval from the U.S. Corps of Engineers. Mr. Arnold Beihoffer presented his request to rehear the setback from the Apple River and County Highwy "C". Chairman Stephens informed Mr. Beihoffer that the board will be at the site at 1:00 p.m. Mrs. Peter Banning presented their request to construct a lift on their property in the St. Croix Riverway District. Mr. Jake Vander Voort, D.N.R., has no objections to the lift. Zoning Administrator read letter from MN-WI Boundary Area Commission having no ob- jections to the lift. Mr. Robert Seibenaler objected to the lift as there is a stairway on the property. He feels that the river bank is being cluttered. He feels that this is a personal and selfish request. Mrs. William Mc Clelland objected to the lift. The Plumbing Section of the State of Wisconsin, Department of Industry, Labor $ Human Relations has refused to grant her approval for a replacement drain field. Th-6y refused approval of a new drain field .becau.se it would ..be located near a steep slope and under her driveway. Her only alternative is to inTta-1-1 a holding tank. She has agreed to install a 3000 gallon holding tank. The State of Wisconsin will only approve holding tank applications that are accompained by a Holding Tank Agreement . The Agreement makes the local unit of government, the. Town Board in this case , responsible for . the pump- ing of the holding tank. if the property owner does not have it pumped at the proper time . Attached is the Agreement which has been signed by Joan .Kennedy along with a map showing the location of the proposed holding tank. Either Joan Kennedy or I can attend a Town Board Meeting when this would be considered. Please inform me of the date and time of the meeting. Please call if you have any questions . The Owner further agrees that the Town of St. Jose h may enter upon the property des- cribed above at any reasonable time, to Inspect, or pump and haul wastes from the subject holding tank. 2. -Owner, agrees to pay all charges aqd costs incurred by the Town ov iu�c of St. Jospeh for inspection, pumping, hauling or otherwise servicing and�maintaining a subject holding tank in such a man- ner as to prevent or abate any nuisance or health hazard caused by such holding tank. Town shall notify the Owner of any such cost which shat a pa y the er within thirty (30.) days from the date of notice and in the gvent that the Owner does not pay said cost within thirty (30) days, Owner hereby specifically agrees that all of said costs and charges may be placed on the tax roll as a special assessment for the abatement of nuisance, and said tax shall be collected as provided by Wisconsin Statute. VARIANCE REQUESTED: To allow a system to be placed 18 feet from a greater than 30% slope and to allow the system to be placed 5 feet under a driveway. PETITIONER'S STATEMENTS: 1. The edge of the top of the seepage pit will be 18 feet horizontal from the slope greater than 30%. 2. If you put a system under a driveway at deeper than 5 feet there will be no compaction at that distance. COMMENTS: 1. This soil data was obtained by the use of a power auger and therefore, conditions of the soil cannot accurately be determined. 2. Kennedy for my review. The appeal is for a special exception use permit to construct an addition onto her existing home. Due to a scheduling conflict, I was unable to attend the Board of Adjustments hearing on this appeal. I have visited the site on the ground and have viewed it from the river. It is my opinion that the proposed addition would be visually inconspicuous from the river. In reviewing the site plan submitted by Francis H. Ogden, professional engineer, I noted the construction included two four-foot high railroad tie walls. These walls were to be built on slopes in excess of 12 percent and then backfilled to widen the existing driveway. Section NR 118.06(12)(a)2b prohibits grading or filling on slopes greater than 12 percent. We will have to object to the granting of any special exception use permit which includes filling on slopes in excess of 12 percent. I have reviewed the proposal carefully, and it appears that the house addition could be designed and built without encroaching on slopes in excess of 12 percent. While it may be inconvenient to use the existing driveway, a variance to the prohibition, against filling on slopes in excess of 12 percent cannot be granted under any circumstances. If St. Croix County decides to revise their Lower St. Croix Scenic Riverway Zoning Ordinance to include all of the revisions in the recently enacted Wisconsin Admistrative Code Chapter NR118, Standards and Criteria for the Lower St . Croix National Scenic Riverway, dated February 1984, you should be able to comply with the regulations and obtain a special exception. I have investigated the soils in .the location of the proposed addition by performing four soil borings to a depth of 25 feet below the existing grade and find the soils to be coarse brown sand & gravel . The U.S. Department of Agriculture, Soil Conservation Service Classification is Emmert loamy sand with a sand & gravel substratum. At proposed footing depths the soil will be sand & .gravel. It is non-plastic , has a permea- bility greater than 20 inches per hour, a low shrink-swell potential and an allowable bearing value in excess of 3000 pounds per square foot. The soils are very adequate to support the proposed addition. There is little chance for serious erosion problems to develop if moderate care is taken while the construction is in progress . When the construction is completed all disturbed areas around the addition and the driveway should be covered with a minimum of 4 inches of topsoil and sodded. I opened the existing septic tank and determined that it .has a capacity of 818 gallons . The Wisconsin Administrative Code ILHR 83 requires a minimum of 750 gallons for septic tanks serving 1 and 2 bedroom single family homes . Therefore your septic tank is adequate for the proposed addition. Joan G. Kennedy Page 2 I have investigated your seepage pit (drywell) and find it to be very inadequate. It is approximately one-half the size required for a one bedroom home. The day I checked it was full of liquid to the same level as the liquid in your septic tank. This indicates that the seepage pit has failed due to clogging of the pores in the surrounding soil . I re- commend that your seepage pit be replaced with a completely new drywell or drywells which will be adequate to serve your existing home and pro- posed addition. During our telephone conversation on August 6, 1984, . you directed me to seek approval from the County and the Plumbing Section of the State of Wisconsin, Department of Industry, Labor and Human Relations for replacement seepage pits which will be adequate to serve your present home and proposed addition .
