Driveway 29 ft. wide at entrance narrows to an average of

- 2374 sq. ft. being used for sales area and storage,
storage being approximately 815 sq. ft. of total
Hours of operation, Monday through Saturday 9: 00 a.m. to
6: 00 p.m. , Sunday 11: 00 a.m. to 5:00 p.m.

10. The applicants have been attempting to work with the Town of
Warren and the Village of Roberts on this matter.
11. Out of a shed the applicants are selling crafts and amish
furniture, out of a separate building, they sell livestock
feeds, and out of a small portion of their home they have a
checkout counter and sell fresh produce.
12 . There are plans to have hayrides and a family petting zoo
almost every weekend now through Christmas.
13 . The applicants have requested the property be rezoned to
commercial, as this is more of a commercial venture, but the
Town of Warren did not support this request as it would not
support their local plan. The Town of Warren has agreed to
expand the understanding of a home occupation.
14 . Home occupations usually have little or no activity, have no
retail, and no items for resale or consignment sales.
15. The applicants are using about 3 , 000 square feet for the
business.
16. The County recognizes the property in question as ag-
residential now. The Town of Warren is suggesting by their
plan that it be Conservancy, however the Town of Warren has
not brought the plan forward to the County Board. Zoning
Administrator, Tom Nelson stated at the hearing that what the
Town of Warren is suggesting, is that any future use in that
area should be open space use. Home occupation is not a
conservancy use, so the Town of Warren is ignoring their own
ordinance by allowing it to stay ag-residential and allowing
this home occupation.
17 . Approximately 60-620 of the business at The Country Store is
from the sale of amish products.
18 . The applicants are also working with the Tourist Board to
promote The Country Store.

FINDINGS OF FACT
Ha ing heard all the testimony, considered the entire record
he ein, and conducted an on-site inspection, the Board finds the
following facts:
1. The applicants are Jill and Cal Joski, whose address is 638
Hwy 65, Roberts, Wisconsin 54023 .
2 . The applicants on September 30, 1996 filed with the Zoning
Office an application for a home occupation.
3 . Jill and Cal Joski are the owners of the property which is the
subject of the application which is located in the NE; of the
SE; of Section 33 , T29N-R18W, Town of Warren, St. Croix
County, Wisconsin.
5. The subject property is presently used for a residence and for
doing business as The Country Store.
6. The property is zoned ag-residential under the St. Croix
County Zoning Ordinance.
7 . The Town of Warren supports the application with conditions.
8 . This is an after-the-fact request for a permit. The
applicants have being doing business as The Country Store
since June, 1995.
9 . The proposed use of the property is to operate a retail
business offering the following products or services to the
public:
1) General livestock feed, including equine feeds
2) Pet foods
3) Fresh produce from their garden, example pumpkins
4) Wild bird feed, feeders and houses
5) Fresh flowers and floral arrangements
6) Fresh eggs
7) Artisan crafts
8) Framed art
9) Amish furniture, baskets, quilts and rugs
10) Christmas trees
General information concerning the property:

CONCLUSIONS OF LAW
The Board concludes that:
1. The Board of Adjustment has authority under Section
17 . 70 (5) (c) 4 to approve or deny a request for a special
exception use.
2 . Section 17 . 155 allows a special exception for a home
occupation.
DECISION
On the basis of the above Findings of Fact, Conclusions of Law, and
the record herein, the Board denies the applicants' request for a
home occupation permit because this is a commercial venture, not a
home occupation, on the following vote:

APPEAL RIGHTS

The Applicant, as witnessed by his signature on this application, hereby acknowledges that he has

1. Applicants are responsible for appearing at the Town Board's regular meeting prior
to the Board of Adjustment meeting to obtain a Town Board recommendation and
have the Town send a letter to the Zoning Department stating their position on the
request.
2. Applicants must submit a site plan showing distances from property lines, roads and/or
water.
3. Applicants are to submit a list of adjoining property owners and their addresses, including
those on the opposite side of a public road.
4. Applicants will be heard by the Board of Adjustment after a public hearing on the
application at which time testimony and arguments will be received. The Board will
adjourn to view the sites in question after which time they will reconvene to render
decisions. However, the applicant should not consider the decision to be final until
written notice of the decision has been presented to him.
5. At the public hearing, the applicant may appear in person or through an agent or an
attorney of his choice. The applicant/agent/attorney may present testimony, evidence and
arguments in support of his application.
6. The fact that an application for a permit has been filed does not automatically mean that

RESOLUTION OF THE TOWN BOARD OF THE
TOWN OF WARREN, ST. CROIX COUNTY,
REGARDING A SPECIAL EXCEPTION FOR
CAL AND JILL JOSKI
September 9, 1996
Motion Redmon, Second Kamm that the following Resolution be
adopted by the Town Board of the Town of Warren:
WHEREAS, the Town Board of the Town of Warren has received an
Application from Cal and Jill Joski (the "Applicant") , for a
Special Exception for the property gene roaflWarrrent (d the the
Property)
SE 1 of Section 33 T 29 N R 18 W Town
which Property is currently zoned Agricultural Residential as
defined by the zoning ordinances now in effect; and
WHEREAS, Applicant desires to use the Property for the limited
purpose of a agricultural and country store using only existing
agricultural buildings which use requires a Special Exception under
the zoning ordinances now in effect, and as that ordinance has been
int rpreted by the Warren Town Board; and
WHEREAS, hearings were held on this matter; and
WHEREAS, the Applicant has demonstrated to the satisfaction of
the Town Board that it has he the issuance of ram Special Exceptiong
ordinances pertaining to
su ject to the conditions imposed below.
NOW, THEREFORE, BE IT RESOLVED BY THE TOWN BOARD OF THE TOWN
OF WARREN, ST. CROIX COUNTY, AS FOLLOWS:
1 . Subject to the conditions contained in this Resolution,
the
Town of Warren approves the issuance of a Special Exception to
the Applicant for the Property for the limited purpose of a
agricultural and country store using only existing
agricultural buildings, subject to the conditions provided in
this Resolution.
2 . The approval,conditioned upon the Applicant strictly complying Exception is co ocomplying
with the following conditions :
A. The Applicant must obtain within twelve months of the
date hereof and maintain the approval of a Special
Exception from St . Croix County.
B. All activities shall be conducted inside existing
agricultural buildings on the Property.

C. All storage and storage facilities shall be screened or
within buildings . The Property and exterior storage
shall be maintained in a neat and orderly fashion, in
full compliance with rules regarding inoperative
vehicles .
D. Retail sales shall be limited to agricultural items
including produce and flowers, seed and feed, plants and
Christmas trees and incidental items limited to handmade
and Amish furniture and quilts and handcrafted gifts sold
only from existing buildings . The store may be open only
from 7 a.m. to 10 p.m.
E. The Applicant shall have no full-time employees who do
not reside on the Property and no more than two part-time
employees at any one time.
F. Except as provided herein, the Property shall not be used
by the Applicant or any other party for any use or
activity not permitted by this Special Exception or other
permitted use.
G. The Applicant shall maintain all driveways and parking
areas in a manner to control dust, which may be gravel .
H. The Applicant shall provide adequate parking on the
Property and no street parking shall be permitted.
I . The Applicant shall take all reasonable measures to
control noise coming from the Property.
J. The Applicant shall use exterior lighting (except
permitted signage) on the Property no higher than the
roof line of the buildings which shall be directed
downward, all in such a manner so as to not be a nuisance
to neighboring property.
K. The Applicant shall allow the Town of Warren or its
representatives access to the Property at any time to
assure compliance with this Resolution.
L. The Applicant shall reimburse the Town of Warren for all
costs and expenses incurred in connection with the
consideration of the application for this special
exception including notice publication costs and
additional expenses for special meetings called to
consider the application. In addition, the Applicant
shall reimburse the Town of Warren for all reasonable
fees, costs and expenses incurred in connection with the
Town of Warren enforcing compliance with this Resolution.
M. The Applicant shall not store, or allow others to store,
any hazardous or highly flammable materials on the
Property except in full compliance with all laws and

regulations and shall file and maintain current
information with the Chief of the Fire Department
regarding the type and nature of goods stored on the
Property, if any.
The Applicant shall comply in all respects with all
federal, state, county and local laws and regulations
applicable to the Property and the operations conducted
on the Property.
D. This Special Exception may be used only by the Applicant
and may not be assigned or otherwise transferred by the
Applicant without the prior consent of the Town Board,
Any purported assignment or transfer shall automatically
nullify and void this Special Exception. For purposes of
this paragraph any change in ownership or control of the
voting stock of the Applicant shall be considered a
transfer requiring the consent of the Town Board. So
long as the new owner signs an acknowledgment and
agreement to the terms of this Resolution such Town
consent shall not be withheld without just cause.
P. The approval of the requested Special Exception shall be
evidenced by this Resolution which approval shall be
effective only upon the execution of the acknowledgment
and agreement of the Applicant and the landowner in the
space provided below. Failure of the Applicant to so
sign this Resolution and return a copy to the Town Clerk
within f ive (5) days or failure of St . Croix County to
approve the Special Exception within twelve months shall
cause this Resolution to be null and void and of no
effect .
The Town of Warren reserves the full right to add any
additional conditions to this Special Exception that it
deems necessary to protect the public health, safety and
welfare of the residents of the Town of Warren. When
adding any amendment to this Special Exception, the Town
Board shall follow the required procedures as set out by
its ordinances in effect at that time and in accordance
with state law.
The authority granted by this Special Exception extends
to only the Property. Any expansion or alteration of the
storage operation on the Property beyond that provided in
this Resolution will require Town Board approval and an
amendment to the Special Exception. Any amendments shall
comply with the Town of Warren ordinances in effect at
that time.
Any violation of the terms and conditions of this
Resolution and the Special Exception, as it may be
amended, or any Town of Warren or county ordinances shall
be grounds for termination of the Special Exception and

will also entitle the Town of Warren to seek and obtain
injunctive relief .
The foregoing Resolution, upon being put to a vote, was
adopted as of the date first above-written.
