Dear Mr. Peabody:
Earlier today we discussed your proposal to alter the site plan for
the location of the proposed mini-storage building that you
received approval from the St . Croix County Board of Adjustments to
construct . It is my understanding that you wish to re-orient the
storage building so that it will run north/south. It will be
located 35' south of your north property line and will sit 257'
east of the center line of 140th Street .
Please accept this letter as confirmation of our determination that
this constitutes a minor change to the project and will not need to
receive B.O.A. approval . This letter will serve as written
approval to proceed with the proposed changes as outlined above .
If you have any questions or concerns which I can answer for you,
please contact me at the Zoning office between the hours of 8 : 00 am
through 5 : 00 pm, Monday through Friday.

9. Introduced as Exhibit 3 was a letter dated July 10, 1996 from
Janice Ball, on behalf of the Town of Richmond stating their
approval for a self storage unit, 401x1001x8' .
10. Introduced as Exhibit 4 was a 3-page Rental Agreement and 1-
page of Rules and Regulations. Larry Peabody testified the
times of operation would be added to the agreement.
11. Larry Peabody testified they have 4 acres of property which is
not being utilized. Peabody believes there is a need for mini
storage units in the Town of Richmond because of multiple
dwellings going up on the south side of New Richmond at this
time.
12 . Peabody testified there was only going to be one building, but
Tom Nelson had advised him if he planned on adding additional
buildings, to indicate that on the original plans.
13 . Peabody testified they use the large area on the east section
of the property for parking. Peabody still sells school
buses, does warranty work on buses and has an automobile
service center. There is a 3-stall garage and another
building that the office space is in on the premises. There
is one full time person in the office and a full time mechanic
there from 8 to 5, Monday through Friday, and usually a half
day on Saturday.
14 . Peabody testified the parking lot was gravel. Nelson
suggested they should hard surface the public way to the
facility including around the unit.
15. Peabody testified there were lights there now, but he would
have to install a couple more.
16. Peabody testified the hours of operation would be 8: 00 a.m. to
9: 00 P.M.
17 . Peabody testified the sites were staked.
18 . Board member Art Jensen stated that a certified plan from the
state was needed.
19 . Peabody testified the area was the highest point of their
property. They will have to put some fill for the driveway,
so water should not be a problem.

FINDINGS, CONCLUSIONS, AND DECISION
OF THE ZONING BOARD OF ADJUSTMENT
ST. CROIX COUNTY, WISCONSIN

FINDINGS OF FACT
Having heard all the testimony, considered the entire record
herein, and conducted an on-site inspection, the Board finds the
following facts:
1. The applicants are Larry W. Peabody and Renee L. Peabody,
whose address is 1172 County Road H, New Richmond, Wisconsin
54017 .
2 . The applicants on June 26, 1996 filed with the Zoning Office
an application for a special exception use for mini storage
units.
3 . The applicants are the owners of the property which is the
subject of the application which is located in the SW, of the
SW, of Section _}.A' T30N-R18W, Town of Richmond, St. Croix
County, Wisconsin. lqoti S+-
4 . The subject property is currently used for school bus sales
and service.
5. The property is zoned Commercial under the current Zoning Code
of the St. Croix County Zoning Ordinance.
6. Zoning Administrator, Tom Nelson indicated this was a request
for a mini storage operation in a commercially zoned district
which is not a permitted use, but rather permitted by a
special exception. Nelson noted the Peabodys are requesting
two mini storage buildings be placed on this particular
property. Nelson further stated there are no standards in the
commercial district at this time concerning setback
requirements. It is dealt with case-by-case.
7 . Introduced as Exhibit 1 was a drawing of the property
identifying the location of each building. The buildings
being approximately 1001x40' wide located 35' off the north
property boundary.
8. Introduced as Exhibit 2 was a 2-page building plan showing 18
storage units, 101x20' and one handicap storage unit on the
end of the building, 101x401 . Total building size
401x1001x8 ' .
5. The applicants must allow free and unlimited access to the
site during construction and operation at any reasonable time
to any Zoning Department employee to check for compliance with
this decision.
6. The Board of Adjustment may change or revoke this decision if
the project becomes detrimental to the public interest.
7 . The applicant must keep a copy of this decision at the site
during construction.
8. Tom Nelson, Zoning Administrator, shall be notified prior to
beginning the project. Call him at (715) 386-4680 so that
compliance inspections can be made.
9. There shall be 24' paved area for access to the building and
20' paved area around the building.
10. There shall be no outside storage on the property.
11 . There shall be no hazardous materials stored on the property.
12 . No retail sales shall be allowed on the property.
13 . There shall be security lighting on the property.
14 . Accepting this decision and beginning the project means that
the applicants have read, understand, and agree to follow all
conditions of this decision.
APPEAL RIGHTS
This decision may be appealed by any person aggrieved by filing an
action in certiorari in the circuit court of this County within 30
days after the date of filing shown below. The County assumes no
liability for and makes no warranty as to the legality of any
construction commenced prior to the expiration of this 30-day
period or the identity of any person who may claim to be aggrieved
by this decision.

CONCLUSIONS OF LAW
The Board concludes that:
1. The Board of Adjustment has authority under sec. 17 .70 (5) (c) 4,
St. Croix County Zoning Ordinance, to approve or deny a
request for a special exception use.
2 . Special exception use permits may be terminated pursuant to
sec. 17 .70 (7) (d) 5, St. Croix County Zoning Ordinance, if the
conditions of the decision are not followed.
3 . Section 17 . 18 (1) (r) allows a special exception for mini-
storage units.
DECISION
On the basis of the above Findings of Fact, Conclusions of Law, and
the record herein, the Board approves the applicant's request for
a special exception use for mini-storage unit facility on the
following vote:

A. Jensen Yes
with the following conditions:
1. This decision expires on October 15, 1997 . No construction
may begin or continue after this date unless an extension is
granted in writing by the Board of Adjustment prior to the
expiration date.
2 . The applicants must complete this project according to the
plans submitted and the conditions stated herein. Minor
changes in the project must be submitted to and approved in
writing by the Zoning Office before the project starts or
continues. Major changes must be brought back to the Board of
Adjustment for review and approval.
3 . The applicants are responsible for obtaining any permit or
approval required for the project by municipal, town, county
or state laws, rules or regulations before starting the
project.
4 . The applicant must provide confirmation to the County Zoning
Department that all other permits or approvals have been
received.
