Springer for a special ) exception use, Article 8.4 B(4) (b) , Set- ) back from a Town Road, ST. CROIX COUNTY ) A-20-84 ZONING ORDINANCE. Location: SE.4 of SW4 ) May 22, 1984 of Section 1, T30N-R18W, Town of Richmond. ) The St. Croix County Board of Adjustment conducted a public hearing on May 22, 1984 to consider the request of Joel C. Springer for a special exception use, Article 8.4 B(4) (b) , Setback from a Town Road, ST. CROIX COUNTY ZONING ORDINANCE. The St. Croix County Board of Adjustment conducted an on-site inspection of the site in question. After inspection, the St. Croix County Board of Adjustment entered an Execu- tive Session to discuss the request. After returning to open session, the following decision was rendered. Motion by Supervisor Meinke to approve the request as the new addition will be further from the road than the original building. Seconded by Supervisor Kelly. Motion carried. Meinke, yes; Stephens, yes; Kelly, yes. All variances approved must be acted on or constructed within one (1) year from date of approval or they shall be null and void. Rebhan, Town Clerk 2 - Others speaking in favor of the request were Mary Bader, Leonard Skalic`ky, Margaret .Jr Langness, Marty and Lee Chevalier, Lee Ballentine, Jack Sandquist and John Lowe. Carolyn Barrette, Town Clerk, presented a map of the road and showed that the road was established in 1877. Phillip Stringer and Robert Englehart were neutral on the matter. 3. Mr. Thomas Gleason presented his request to construct a go cart track on his property in Houlton. Anthony Huppert, track operator, explained the go carts and noise levels. He also has a track in Prescott. A petition was presented to the Board from adjoining land owners who are against the track. Ray Brown, Town Chairman, informed the Board that the Town Board voted to deny the request due to traffic prob- lems and crowd control. 4. Mr. George Sinclear presented his request to have a concession stand on the Apple River. This is not a beer garden. Attorney James Bartholomew explained the Town Ordinance and County Board approval of the rezoning. The Town Board has no objections. 5. Mr. Joel Springer presented his request to construct an addition to his house that would be 125 feet from the centerline of C.T.H. "GG". His house is now 117 feet from the centerline.. Questions by Board members. Mrs. William Smith questioned the reason requiring a variance. Chairman Stephens explained them. Mrs. Smith has no objections. I 6. Mrs. Caroline Stoner presented their request to construct a garage that would be 120 feet from the centerline of a town road. The reason for the request is a hill on the property. The Town Board has no objections. 7. Mrs. Harold Rohl presented their request for a limerock quarry on their property. The quarry will be leased to Kraemer & Sons of Plain, Wisconsin. Mr. Ralph Brown of Kraemer Construction explained that they will start quarrying limestone and crushed rock. The lime will be available for county and private use. Mr. Gilmore Solberg, Town Chairman, stated that the Township has no objections. 8. Mr. James. Rusch presented the request of Joy Keiper to construct a house that would be 40 feet from the bluffline of the St. Croix River District. Mr. Glen Gaynor spoke in favor of the request. Zoning Administrator read letter from Minnesota- Wisconsin Area Boundary Commission stating that the house could be set back 80 feet. Questions by Board members. 9. Mr. Robert Dosedel presented his request to construct two duplexes on two one (1) acre parcels of land. The property i& jiext to the mobile home park and the land is not good for farm land. 10. Mr. Keven Bottineau presented his request to construct a house on his premises that would be approximately 75 feet from the centerline of a town road and 54 feet from Bass Lake. The all year residence will be replacing a cottage on the property. Hearing recessed to view' all properties in question. The Board of Adjustment madethe following decisions: 1. Jon Erickson: Motion by Stephens to deny because it would cause water to stand on property and back up on to adjoining land owners property. Seconded by Meinke. Motion carried. Vote to -.deny: .Meinke, yes; Kelly, _yes; Stepheng, yes. '. 2. Joel Springer: Motion by Meinke to approve the request as the new addition will be further from the road than the original building. Seconded by Kelly. Motion carried. Vote to approve: Meinke, yes; Stephens, yes; Kelly, yes. 3. Don Stoner: Motion by Meinke to approve the request as they are unable to build a garage due to a hill on the property. The front of the garage shall be no closer to the road than the house. Seconded by Stephens. Motion carried. Vote to approve: Meinke, yes; Stephens, yes; Kelly, yes. 4. George Sinclear: Motion by Stephens to grant approval of the concession stand as it is a good use of the land. At completion, it shall meet with town, county and state requirements. Seconded by Kelly. Motion carried. Vote to approve: Meinke, yes; Stephens, yes; Kelly, yes. 5. Harold Rohl: Motion by Kelly to approve the limestone quarry and land shall be landscaped to St. k3roix County Zoning regulation at the time the quarry is closed. Seconded by Stephens. Mr. Jon Erickson presented his request to fill and grade a lagoon on Cedar Lake, explaining his reason for filling was due to stagnate water and odors. Questions from board members. 2. Town of St. Joseph, filling and grading of Bass Lake on Boardman Road. Mr. Ray Brown, Town Chairman, explained the reason for the request for filling and grading. It is in order to make the road passable. Mr. Clifford Noreen spoke in favor. Mr. John Schottler farms on both sides of the lake and has to travel an additional 211 miles. He will furnish the fill material from his farm. - 3 - 6. Joy M. Keiper: Motion by Meinke to allow a setback of 60 feet from the bluffline and the structure shall not exceed 25 feet from the basement floor to the peak of the roof. This is the best usage of the land. Seconded by Kelly. Motion carried. Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes. 7. Town of St. Joseph: Motion by Meinke to approve filling and grading of Boardman Road on Bass Lake. The project shall not start until plans have been approved from DNR, with such plans showing a projected 5 year use of road without further construc- tion. Seconded by Stephens. Motion carried. Vote to approve: Meinke, yes; Kelly, yes; Stephens, yes. 8. Robert Dosedel: Motion by Stephens to approve the request to construct 2 duplexes that will be on 1 acre lots each. They are to use the commom driveway that has been constructed by St. Croix County Highway Department. The present usage complies with good neighborhood usage. Seconded by Meinke. Motion carried. Vote to -approve: Meinke, yes; Kelly, yes, Stephens, yes. 9. Keven Bottineau: Motion by Kelly to approve the 54 foot setback from Bass Lake as it will be furtheV from the lake than the present structure. Seconded by Meinke. Motion carried. Vote to approve: Meinke, yes; Kelly, yes, Stephens, yes. 10. Thomas Gleason: Motion by Stephens to deny the request due to traffice problems, crowd, and noise levels and that it is unacceptable to village residents and township officials as well as sanitary requirements not being met. Seconded by Meinke. Motion carried. Vote to deny: Meinke, yes; Kelly, no; Stephens, yes. The next scheduled Board of Adjustment Hearing is June 26, 1984. Motion by Supervisor Meinke to adjourn. Seconded by Supervisor Stephens. Motion carried.
