We have reviewed your application for a variance and special exception permit for a
Land Information
Planning major home occupation /wedding chapel on your property located in the SE '/ of the
715-386-4674 SW % of section 4, T30N, R18W in the Town of Richmond. Based on our review of
your application with the Home Occupation language in Section 17.155 of the St.
Real Prop Croix County Zoning Ordinance we have determined that your proposed use does not

with the provisions of the ordinance:

Section 17.155 (1)(c) states that home occupations are to be conducted in dwelling
units and accessory structures. Your proposal has outdoor ceremonies for 100-250
people and outdoor portable bathrooms. The outdoor ceremony area and portable
bathrooms would not be inside the dwelling unit or permitted accessory structure.
This section does not allow for any type of home occupation to be operated outside of
structures.
Section 17.155 (4) (d) states that a home occupation shall have adequate parking
spaces. Your proposal indicates parking for 100-250 people. Parking spaces for this
type of commercial operation require grading, drainage, screening and paving to
manage surface water, prevent dust and screen from neighboring views.
Section 17.155 (6) (d) 1. states that major home occupations must be conducted
within the principal dwelling or permitted accessory structure. The pictures on your
website and the illustration in your application indicate that the wedding ceremonies
are to be conducted outside of a structure. This section does not allow for major
home occupations to be operated outside of structures.
Section 17.155 (6) (d) 2. states that home occupations may not be located within 500
feet of any preexisting neighboring residence. Your operation does not comply with
this provision since there are two houses that are approximately 254 feet and 276 feet
from the barn where weddings are conducted.
Section 17.155 (6) (d) 4. states that the total floor area in an accessory structure shall
be limited to a maximum of 1000 square feet total. Your wedding chapel operation
has approximately 1600 square feet in the barn, 174 square feet in the gazebo, and

Attachment to Special Exception Application
1) Describe the details of your request.
We are applying for a special exception permit to become compliant with the St. Croix County
ordinances. Our property is zoned ag-residential. For three years, we have been holding wedding
ceremonies, for profit, on our property. In the past three years, we have held approximately 30 weddings
total. The weddings occur on Friday and Saturday afternoons, from May to October of each year. The
wedding ceremonies are attended by approximately 100 to 250 people. The first two and a half hours are
for the immediate family and wedding party for photographs. The invited guests start arriving about a
half-hour before the ceremony and ceremonies typically take 20 minutes. In sum, our property is used in
a commercial manner a maximum of 26 weekends a year, for a maximum of four hours per event.
Prior to the County contacting us, were unaware that we were in violation of any ordinances and it is our
goal to make things right by the County.
2) Describe the impact of your request on the enjoyment and value of the surrounding
properties. If there is no impact,explain why.
The impact of our request on the enjoyment and value of the surrounding properties is minimal. If there
is any impact, it is a positive, not negative, impact. Visually, the impact is positive because our property
is surrounded on all sides with pine trees which are over 20 feet tall. The two closest neighbors are barely
visible and we consulted with them before we started holding wedding ceremonies in 2008. We received
their blessing in operating the ceremonies. Additionally, we don't have any real road frontage, just
driveway entrances which lead back to our farm, parking lot and a very large valley. All guests park on
our property, so there is never an issue with the neighboring properties being adversely affected by the
guests. Also, the noise coming from the ceremonies is very minimal. Finally, the ceremonies themselves
are very short and the season for ceremonies is also very short, so any impact on the surrounding
properties is limited in duration.
3) Describe the compatibility of your request with the uses and character of the surrounding
area.
Our property is the only remaining 17 acres of what once was a 60 acre farm. Our property is surrounded
by new homes on two acre lots. We have preserved the history of St. Croix County's farming community
by maintaining all original buildings, adding gardens and green space and keeping a view of the Willow
River Valley. Our goal is to preserve our heritage and the"small farm"agriculture feeling. Opening our
property to weddings is our way of allowing people to experience the "small farm" feeling for an
afternoon. Our wedding ceremonies have brought people here from other counties and states, who may
otherwise have not been able to experience St. Croix County's scenic agricultural setting, if we were not
allowed to host weddings on our property.
4) Describe how your request is consistent with the spirit and intent of the zoning district in
which your property is located. (Please refer to the purpose statement for your zoning district
in the St. Croix County Zoning Ordinance.)
This ag-res district was created to establish areas within which agricultural uses, commercial uses serving
agriculture, limited commercial, institutional residential uses may be located. We believe our non-
conforming use is consistent with the spirit of"commercial uses serving agriculture." We are preserving
the rural and agricultural character of the community.
5) Describe how your request will impact public health, safety and general welfare. What
measures will you take to minimize any negative impacts?
Our request will only impact public health, safety and general welfare in a positive way. Our ceremonies
drive individuals into St. Croix County. We do not hold overnight accommodations at our property.
Accordingly, wedding guests are seeking out hotels and commercial enterprises in and around St. Croix
County, increasing our economic development and promoting positive general welfare.
We have held wedding ceremonies on our property for three years and we have never had a health or
safety problem. In the event that we did, we are protected with a personal and business policy of
insurance with $1 million of insurance coverage. Finally, we are both on site for all weddings, to ensure
the health and safety of all guests.
6) How will you ensure that your request will not constitute a nuisance by reason of dust,
smoke,odor or other similar factor?What measures will you take to prevent a nuisance?
Our proposed use does not constitute a nuisance. The wedding ceremonies do not create dust, smoke or
any odors. Additionally, the noise which comes from the ceremonies is minimal. None of our neighbors
have ever complained, and in fact,they support our use of the property.
7) Additional comments:
We respectfully request that the Board of Adjustments use their discretion to validate a use that,while not
approved within our zoning district, is deemed compatible with approved uses and is not found to be
harmful,offensive or adverse to other uses.
