Jameson for a ) special exception use, Article 2 . 3 D ( 1 ) , ) A-27_83 Sideyard Setback, ST. CROIX COUNTY ) October 25 , 19$3 ZONING ORDINANCE . Location : NEk of ) SEA of Section 4 , T30N-R18W, Town of ) ULD BUSINESS Richmond . ) The St . Croix County Board of Adjustment reviewed the request of Mr. Dean Jameson made on September 27 ,"1983 for a special exception use , Article 2. 3 D( 1 ) , Sideyard Setback, ST . CROIX COUNTY ZONING ORDINANCE . The St. Croix County Board of Adjustment conducted an on-site inspection of the site in question. After inspection, the St . Croix County Board of Adjustment entered an Executive Session to discuss the request . After returning to open session , the following decision was rendered. Motion by Supervisor Stephens to deny the request of Dean Jameson because there are other options for expansion available and to proceed , with the plans proposed could possibly cause encroachment on the neighbor to the south' s use of his property in the future . Variance of setback for the entry way will be granted . Seconded by Supervisor George . Vote to deny : Meinke , yes George , yes ; Stephens , yes . Meeting called to order by Chairman Meinke at 10 : 00 a .m. in the County Board Room , Courthouse , Hudson , Wisconsin . All members present . Minutes of the September hearing and meeting approved . Old business : Mr . Dean Jameson discussed with the Board their denial of his side- yard setback of four (4) feet . He explained his reasons for wanting the addition to the south side of his house . Chairman Meinke informed Mr . Jameson that the Board would look at the site again and then make a decision. Zoning Administrator Harold Barber read notice of hearing as published in the county and local newspapers . ARTICLE : 8 . 4 B (4) (b) APPELLANT : Thomas Stephens LOCATION : NEk of Section 19 , T30N-R18W, Town of Richmond Mr. Stephens presented his request to construct a barn that would be approximately 120 feet from a town road , explaining that a telephone cable runs through his property making it impossible to place the building in another area. Questions by members of the Board. Chairman Meinke informed Mr . Stephens' that the Board would be out to inspect the property and the Zoning Administrator will inform him of their decision. Hearing recessed to inspect the properties in question . Board returned to session to render the following decisions : Motion by Supervisor George to grant a 120 foot setback from a town road to Thomas Stephens . Seconded by Supervisor Meinke . Vote to approve.: . Meinke, yes ; George , yes , Stephens , abstained , as appellant is a 'relative . Motion by Supervisor Stephens to deny the request of Dean Jameson be- cause there are other options; for expansion available and to proceed with the plan proposed could possibly cause encroachment on the neighbor to the south's use of his property in the future . CROIX COUNTY ZONING ORDINANCE . The St . Croix County Board of Adjustment conducted an on-site inspection of the site in question . After inspection , the St . Croix County Board of Adjustment entered an Executive Session to discuss the request . After returning to open session , the following decision was rendered. The mobile home is for his daughter and is a temporary situation . Mr. Steve Wilcox presented the request of Dr. Robert Howard to place rip- rap on his shore line that will stop erosion on his property. Questions by members of the Board. Mr. Deane Jameson resented his request to construe a p t n addition to his q house that would be 4 feet from the property line of James Moeller. Questions by members of the Board. Hearing recessed to inspect the properties in question. Committee entered into executive session to discuss the properties in question . Board returned to open session to render the following decisions : 1 . Richard Krampert : Motion by Supervisor Stephens to grant the request . Seconded by Supervisor George. Motion carried. Vote to approve : George , yes ; Stephens , yes ; Meinke , yes . 2 . Wallace Cudd : Motion by Supervisor George to approve the request . Seconded by Supervisor Stephens . Motion carried . Vote to approve : George , yes ; , Stephens , yes ; Meinke , yes . 3. Ted Orf : Motion by Supervisor ervisor Ste hens to approve with the stip- ulation P PP - 1 ulation that any further exterior or interior improvements other than normal maintenance be made , or if plumbing containers (sinks , lavatories , sanitary stools ) or water be installed this variance shall automatically be revoked and the building shall be returned as close as possible to the status of date of purchase by Ted Orf , Jr . Ted Orf , Jr. shall understand that the premises may be inspected without notice by the Zoning Administra- tor or Environmental Protection Officer once every thirty ( 30) days . The District Attorney requested a copy of the building permit , a letter from DNR on establishing the highwater mark and .location of the highwater mark. Harold is to talk with the Town Clerk. Zoning Administrator read letter from Town Board having no objections . Mr. Richard Peterson spoke in favor of the request . Mr. Richard Krampert presented his request to leave fill in a pond on his property. Mr. Chris Bethke , Town Chairman , informed the Board that they have no objections . The pond is man made and he feels that there should not be any restrictions after the fact . Stanley Schneider , DNR, Game Warden , objects to the request as the rock in the pond is in violation of Chapter 30 of the Statutes. The pond is approximately 1 /2 acre in size . There is litigation pending on this property. Mr. Wallace Cudd presented his request to rip-rap the shoreland on his property . He also wished to construct a, 13' x 24 ' addition to his house that would be, the same distance from the lake as the original structure . He also would like to rebuild a wall on his property . Mr. Ted Orf presented his request to use a structure that was used as a church camp . He wishes to use this structure as a summer cabin .
