715-3 677 This letter confirms zoning approval according to the plans you have submitted for
disturbing an area of over 10,000 square feet on slopes ranging from approximately
Re cling 12% to 24.9% to harvest timber as part of forest management on undeveloped land
-386-4675 owned by Fourth Baptist Church. The property is located on several parcels within
Section 8 in the Town of Somerset. This work was done in the fall of 2007 without
obtaining the required permits. You were notified by our code enforcement staff that you
needed to stabilize the site, address any erosion problems that occurred as a result of
the land disturbance, and apply for an after-the-fact land use permit. Staff finds that the
application meets the spirit and intent of the St. Croix County Zoning Ordinance with the
following findings:
1. Forest management is a permitted use in the Agricultural and Ag Res districts
pursuant to 17.14(1)(a)and 17.15(1)(a);
2. The Church applied to the St. Croix County Clerk's office in October 2007 for
permission to cut logs and received approval after verification that no taxes were
due on property. Ed Schachtner, Chairman for Town of Somerset and Dan
Borh, DNR Forester were copied on this letter;
3. Any construction or land disturbance activities affecting more than 10,000
square feet in area on slopes of 12 — 19.9 percent is allowed with a land use
permit pursuant to Section 17.12(7)of the St. Croix County Zoning Ordinance;
4. Any construction or land disturbance activities on slopes of 20-24.0 percent is
allowed with a land use permit pursuant to Section 17.12(8)of the St. Croix County
Zoning Ordinance;
5. The total disturbed area for the project is known to be over 10,000 square feet,
but the exact square footage is not known. The timber harvest occurred outside
the Lower St. Croix Riverway District boundary and no water resources were
negatively impacted by this activity;
6. During site visits on JUly 9th, September 23rd, and October 7, 2008 staff
observed areas of soil exposed on steep slopes where logging skidders had
transported cut timber. An existing trail was graded to allow access by semi-
tractor trailers to a landing site. Consulting Forester, Erik Eggen, responded to
