BOARD OF ADJUSTMENT DECISION Request of Monarch Paving Co. , Special Exception, ) Article 17. 19 (6) (c) , Asphalt Plant, ST. CROIX ) A-89-62 ZONING ORDINANCE. Location: NE 1/4 of the SE 1/4 ) Dec. 28 and the SE 1/4 of the SE 1/4 of Section 16, T30N- ) 1989 R18W, Town of Richmond. ) The St. Croix County Board of Adjustment conducted a public hearing on Dec. 28, 1989 to consider the request of Monarch Paving Company for a special exception. Article 17.19(6) (c) Asphalt Plant. After inspection, the St. Croix County Board of Adjustment entered an executive session to discuss the request. After returning to open session, the following decision was rendered: Motion by Supervisor Bradley to approve the special exception for a Hot Mix Plant in the Industrial District. This special exception would be good for a 150 day period and allow private work to be done for driveways and parking lots. Motion seconded by Supervisor Menter. Vote to approve said motion: Kinney, yes; Bradley, yes; Swenby, yes; Menter, yes; Meinke, yes. Motion carried. All variances approved must be acted on or constructed within one (1) year from date of approval or they shall be null and void. Jo h Bradley, Secret ry St. Croix County Board of Adjustment JB;TCN cj Monarch PdVing Company Town of Richmond, Clerk File Julie Speer informed the BOA that she was concerned with the zoning of her farm and if a large and small animal vet clinic could be developed on the property using the existing farm buildings. The Zoning Administrator presented a map of the St. Croix Riverway District showing that her farm was in the Riverway District. The Zoning Administrator went on to read a letter from Dan Koich, DNR Water Management Specialist, who interpreted this nonconforming use to be a compatible substitution as long as no new structures were built. Motion by Supervisor Kinney and seconded by Supervisor Bradley to approve the farm as a large and small animal vet clinic utilizing the existing farm structures. WILLIAM HARWELL: William Harwell expressed his concern that he had not heard any thing back from the DNR after the BOA had conditionally approved his application for filling on Bass Lake. The Zoning Administrator stated he would contact Dan Koich to see what the problem was. There was a general discussion on the CSI Trucking-Doberstein Farm application. Supervisor Swenby stated that he would like to see this back on the agenda for the next regular meeting. Hearing called to order by Chairman Meinke at 9:30 A.M. The Zoning Administrator read the notice of the hearing as published in the local newspapers. Chairman Meinke explained the procedures of the hearing. An on site investigation will be made of the site in question after which the board contemplates adjournment into closed session for the purpose of deliberating on the appeals, and will readjourn into open session for the purpose of voting on the appeals: 1.ARTICLE: 17.19(6) (c) Asphalt Plant APPELLANT: Monarch Paving Co. LOCATION: NE 1/4 of the SE 1/4 and the SE 1/4 of the SE 1/4 of the SE 1/4 of Section 16, T30N- R18W, Town of Richmond Sam McVicker explained that he wants the hot mix plant at the Cemstone site on a fairly permanent basis and be able to provide material for the private sector. The Zoning Administrator stated that when the application was submitted it was for a temporary use in the Ag-Residential district. Since that time the Cemstone property has been rezoned to Industrial. However, because of the initial application, it 2 s O 6 BOARD OF ADJUSTMENT MEETING AND HEARINGS December 28, 1989 (This meeting was recorded by a Court Reporter) The meeting was called to order by Chairman Meinke at 9:00 A.M. in the County Board Room, Courthouse, Hudson. All members present. Chairman Meinke explained the procedures of the hearing, requesting that individuals wishing to testify sign their name and address on the sheet in the front of the room. OLD BUSINESS TOM SODERBERG: ' Tom explained that he still has not reviewed a recommendation from the township of Troy. It seems the issue between the neighbors and the Soderbergs is not the number of horses but instead the location of a lot line. The Zoning Administrator read a letter from Charles Harris, who represents the Soderbergs, that was addressed to Attorney William Gilbert, encouraging the two sides to come up with an agreeable solution. The Zoning Administrator explained that the intent of the ordinance was to provide assurances that the animals would be provided with food and waste disposal. Motion by Supervisor Swenby, seconded by Supervisor Menter to postpone a decision until the next regular meeting. BYE, KRUEGER & GOFF, PROFIT SHARING: The Zoning Administrator stated that he had discussed the issue with Randy Cudd, the realtor representing the parcel. Because of the difficult freezing weather the bore holes verifying soil conditions could not be done. The Zoning Administrator recommended that we postpone this application until we were assured the soils could be reviewed. Supervisor Kinney stated that we do not have the obligation to rescue individuals from poor judgment on purchasing land. Supervisor Swenby made a motion, seconded by Supervisor Menter, to deny this request for a holding tank on new construction. Vote to approve said motion: Kinney, yes; Swenby, yes; Menter, yes; Bradley, yes; Meinke, yes. Motion carried. RICHARD ZEJDLIK AND KENNETH SPEER: 1 was published as a temporary use and would have to be resubmitted for a permanent facility. Tom O'Keefe, County Highway Commissioner, stated that the material on this location is excellent and it would be a tremendous advantage to the citizens in this area. This use, however, should not be something approved as a use without time limitations. Sam McVicker stated that with this Zoning change he can now do work for the private sector. His estimate is they will do 40-60 thousand tons of private work. John Cahoon stated that he had been late for the hearing but would like to further express his objection to the holding tank. He doesn't feel it would be safe on the steep hill for a pumper truck to travel on. . Committee recessed to view the site in question and reconvened to render the following decision: MONARCH PAVING COMPANY: Motion by Supervisor Bradley to approve the Special Exception for a Hot Mix Plant in the Industrial District. Supervisor Bradley made a motion to approve all minutes up to the November 21, 1989 minutes that were submitted. Motion seconded by Supervisor Kinney. Supervisor Bradley stated that he thinks the minutes are becoming to comprehensive and long, especially since a court reporter records the hearings. It was the feeling of the BOA that the minutes become more condensed and statement be placed on the minutes stating a court reporter had recorded the hearings.
