Location: NE 1/4 of the SE ) Jan. 25 1/4 of the SE 1/4 of the SE 1/4 of Section 16, ) 1990 T30N-R18W, Town of Richmond, St. Croix County. ) The St. Croix County Board of Adjustment conducted a public hearing on Jan. 25, 1990 to consider the request of Monarch Paving Co. for a Permanent Asphalt Plant, Article 17.19(6) (c) . After inspection, the St. Croix County Board of Adjustment entered an executive session to discuss the request. After returning P to open session, the following decision was Supervisor Menter to rendered. . Motion by Super i approve this use with the following conditions: t Hi De 1 P Annual inspection to be done by County Highway y p artment , Township of Richmond and County Zoning. 2 A code complying se tic system be installed in the area P Y of the use. 3) Any of the above agencies be permitted entrance at any time for inspection. In addition the Mix Surge Silo is to be granted the variance to the 45' height restriction. Motion seconded by Supervisor Swenby. Vote to approve said motion: Swenby, yes; Menter, yes; Kinney, yes. Motion carried. ARTICLE: 17.64(1) (d)2 Setback from town road APPELLANT: Tim Riemenschneider LOCATION: Part of Gov't Lot 4, Section 23, T30N- R19W, Town of St. Joseph 3. ARTICLE: 17.18(1) (r) Special Exception, Similarly Compatible Enterprise APPELLANT: Gary and Sharon Rothe LOCATION: NE 1/4 of the SE 1/4 of Section 15, T30N- R18W, Town of Richmond MONARCH PAVING COMPANY Sam McVicker presented the request for Monarch's hot mix plant to be permanent on the Cemstone property located on land Zoned Industrial located in Sec. 16 of Richmond Township. In addition, they would like a variance to the 45 foot height restriction so that the storage silo (mix surge silo) , could be enlarged. Tom O'Kief St. Croix Co. Highway Commissioner stated that he supported this project but that there would be other requests elsewhere in the county. The Zoning Administrator requested that this facility be reviewed on a yearly basis by the County Zoning Office, County Highway Dept. and the Township of Richmond. Should this facility ever deviate from the original request creating local problems this use could be terminated as stated in 17.70(7) (d)5 of the St. Croix Co. Zoning Ordinance. There is also the need for a sanitary facility on the property. GARY ROTHE The Zoning Administrator explained that this application had been turned down on a request for a Zoning change from Commercial to Industrial. At this time their request is a Special Exception use for this light Industrial use (manufacturing of plastic injection molds) in the Commercial District. Greg Timmerman, Corporation Council Attorney, stated that it is his opinion that this use meets the spirit of the Ordinance in the Commercial District. Mike Hudella, owner of the company, stated that the proposed use is very compatible to the other businesses in this district. There is no exhaust or oil wash and the only truck traffic will be UPS trucks. Joe Hubner, who owns the RV Dealership next door stated he welcomed this use. 2 J e V� BOARD OF ADJUSTMENT MEETING AND HEARINGS January 25, 1990 (This meeting was recorded by a Court Reporter) The meeting was called to order by Vice Chairman Kinney at 9:00 A.M. in the County Board Room, Hudson Courthouse, Hudson, WI. Vice Chairman Kinney explained the procedures of the hearing, requesting that individuals wishing to testify sign their name and address on the sheet in the front of the room. OLD BUSINESS The Zoning Administrator presented a prepared interpretation on the requirements of rebuilding a road to industrial standard. This interpretation had been drafted by Richard Lehmann from Lawton and Kates. He currently assisting the county with the rewriting of the Land Use Ordinances. Also read into the record was a letter from Daniel Fedderly from the St. Croix Co. Highway Dept. describing the poor condition of the existing town road. Tom O'Kief, St. Croix Co. Highway Commissioner testified that the road was in very poor condition but would be very expensive to rebuild to Industrial Standards. Attorney Tom Shoemaker representing the Township of Erin Prairie, restated the concerns of the Township which is still opposed to this use. Robert Doberstein expressed his concerns for lack of attorney and the cost of building such an expensive road. Supervisor Swenby expressed his concern for Dobersteins lack of attorney and suggested that it be postponed for one month until he had a chance to discuss it with legal council. Hearing was called to order by Vice Chairman Kinney at 9:30 A.M. The Zoning Administrator read the notice of the hearing as published in the local newspapers . Vice Chairman Kinney explained the procedures of the hearings. An onsite investigation will be made of each site in question, after which the board contemplates adjournment into closed session for the purpose of deliberating on the appeals, and will readjourn into open session for the purpose of voting on the appeals. NEW BUSINESS 1. ARTICLE: 17.19(6) (c) Permanent Asphalt Plant 1 s Surveyor to determine the exact location of the Right of Way , Line. This information is needed so as to properly site the septic system and residence on the property. Motion seconded by Supervisor Swenby. BOA TN:cj 4 IA Tom Nelson, County Zoning Administrator, stated that he supports this use because of its compatibility to the general area. TIM RIEMENSCHNEIDER Tim presented his request to place a residence closer than 100 feet from the town road right of way line. The distance would be approximately 63 feet. The Zoning Administrator stated that there was a conflict between the site plan the plumber had submitted for the sanitary permit and Tim's site plan. He does feel there is adequate room for the house and septic system. Committee recessed to view the sites in question and reconvened to render the following decisions: CSI TRUCKING, INC. & DOBERSTEIN FARMS: Motion by Supervisor Kinney to postpone the decision until the next regular meeting for the following reasons: 1) The Applicant had requested it so that he can review the new exhibits that were presented. 2) As per 17.70(e) the Board of Adjustments is requesting additional information as required by the Non-metallic Mining Ordinance. This information requested is the contour and drainage maps that had been requested at the first hearing dated Sept. 28, 1989. Motion seconded by Supervisor Menter. Vote to approve said motion: Kinney, , yes; Menter, yes, Swenby, yes. Motion carried. GARY ROTHE: Motion by Supervisor Swenby to approve the commercial property for the requested special exception use, Manufacturing plastic injection molds. This use does meet the spirit of the district and should be permitted. Motion seconded by Supervisor Menter. Vote to approve said motion: Swenby, yes: Menter, yes, Kinney, yes. Motion carried. MONARCH PAVING CO. Motion by Supervisor Menter to approve this use with the following conditions: 1 ) Annual inspection to be done by County Highway Department, Township of Richmond, and County Zoning. 2) A code complying septic system be installed in the area of the use. 3) Any of the above agencies be permitted entrance at any time for inspection. In addition the Mix Surge Silo is to be granted the variance to the 45' height restriction. Motion seconded by Supervisor Swenby. Vote to approve said motion. Swenby, yes; Menter, yes; Kinney, yes.
