FINDINGS, CONCLUSIONS, AND DECISION
OF THE ZONING BOARD OF ADJUSTMENT
ST. CROIX COUNTY, WISCONSIN

Hearing Date: September 25 and November 26, 1997
FINDINGS OF FACT AND CONCLUSIONS OF LAW
Having heard all the testimony, considered the entire record herein, and conducted an
on-site inspection, the Board finds the following facts:
1. The applicant is Richard Ohlfs whose address is 250 N. Staff Ave., New
Richmond, Wisconsin 54017.
2. The applicant on August 29, 1997, filed with the Zoning Office an application for
a special exception permit for limited commercial recreational activities in an
ag/residential district.
3. Richard Ohlfs is the owner of the property which is the subject of the application
and is located in the N 1/2 of the SW 1/4 of Section 23, T30N, R1 8W in the Town
of Richmond, St. Croix County, Wisconsin.
4. The subject property is presently in the Ag/Residential district.
5. The request is for a model railroad museum and train ride on his property, along
with miniature golf, campground and a personal residence.
6. Ohlfs attempted to have his 80 acres rezoned to commercial, but the Planning,
Zoning and Parks Committee suggested that he try this avenue instead of
rezoning.
7. Ohlfs would like to have the project ready to open to the public within 5 years.
8. There was some opposition to the project by two adjacent landowners to the Ohlfs
property, with the biggest concerns being traffic and noise.
9. The driveway to the property has been put in and it is 800 feet long. It was built
like this to be used for expansion.
10. Land and Water Conservation and the DNR have been talking with Ohlfs about
the pond on the property.

11. The trains will not run past 8:00 or 9:00 p.m. in the evenings.

13. After visiting the site, the Board asked Mr. Ohlfs to come back before them again
with more information on the amount of time he believes this project will take and
what steps he plans to take in creating this project.
14. Mr. Ohlfs appeared again before the Board on November 26th under Old
Business.
15. Ohlfs did not have a plan with him or a timeline as to the stages he plans to
implement for the project.
16. The Board found that the applicant does not have a plan put together for this
project. The Board had requested at the hearing in September that he put
together a plan showing the timeline of this project.
17. The Board has denied the application based on lack of information. This is a very
large project and would be a commercial use in an ag/residential area.
18. The Board will allow Mr. Ohlfs to reapply and come back before them when he
has a plan consisting of a timeline for the project.
19. The Board of Adjustment found that evidence given was not sufficient to allow this
limited commercial use in an ag/residential area.
DECISION
On the basis of the above Findings of Fact, Conclusions of Law, and the record herein,
the Board denied the applicant's request for limited commercial residential activities in
an ag/residential area.

APPEAL RIGHTS
Any person aggrieved by this decision may file an appeal in St. Croix County circuit court
within 30 days after the filing date shown below, pursuant to sec. 59.694(l 0), Wisconsin
Statutes. St. Croix County assumes no responsibility for action taken in reliance on this
decision prior to the expiration of the appeal period. St. Croix County does not certify
that the identity of all persons legally entitled to notice of the Board of Adjustment
proceedings which resulted in this decision was provided to the County.
If an appeal is taken of this decision, it is the responsibility of the appellant to submit at
his/her expense a transcript of the Board of Adjustment proceedings to the circuit court,
which is available from Northwestern Court Reporters, Hudson, Wisconsin. It is the
responsibility of the Board of Adjustment to submit its record (file) of this matter to the
circuit court.

The St . Croix County Board of Adjustment has asked that you appear
before them at the next meeting on November 26, 1997 to continue
with your request for a special exception permit for limited
commercial recreational activities in an ag/residential district .
The Board has further stated that if you do not appear before them
in November, they will not have sufficient information to approve
your request. Should you decide to pursue this matter after that
date, a new application would need to be submitted at that time.

Dear Mr. Ohlfs :
The St . Croix County Board of Adjustment has voted to postpone a
decision on your application until the October 23rd meeting. In
order for them to make a decision on this application, they would
like you to come back before them in October with a more detailed
plan on the stages you plan on going through to implement your
project . They are looking at getting information on your plans for
the first year and each year thereafter until completed. I realize
it is difficult for you to do this, but with a project this size,
they are apprehensive in approving your application without more
details .
You will be on the agenda for the October 23rd meeting which will
begin at 8 : 30 a.m. at the St. Croix County Government Center.
