CROIX COUNTY AND THE WISCONSIN PROFESSIONAL POLICE ASSOCIATION/LAW ENFORCEMENT EMPLOYEE RELATIONS (WPPA/LEER) UNION FOR 2013-2015 1 WHEREAS, St. Croix County representatives have negotiated a labor agreement with the 2 Wisconsin Professional Police Association/Law Enforcement Employee Relations 3 (WPPA/LEER) Union for the years 2013, 2014 and 2015; and 4 5 WHEREAS, all the terms of the labor agreement in effect for 2011 through 2012 become 6 the terms of the agreement for 2013-2015, except as modified by the attachment to this 7 resolution; and 8 9 WHEREAS, the Administration Committee recommends approval of the agreement. 10 11 THEREFORE, be it resolved by the St. Croix County Board of Supervisors that the labor 12 agreement for January 1, 2013 through December 31, 2015 between St. Croix County and the 13 WPPA/LEER Union is approved. The Court Services Deputy shall also work flexible shifts depending on work load on the basis of a forty (40 hour workweek, Monday through Saturday. Add: Section 1 G. - Huber Deputy to read as follows: This is a special assignment within the Corrections Bureau. The Sheriff shall select the Huber Deputies from among those Deputies who submit a letter of intent unless no Deputy submits such letter. The Deputy performing those tasks could, at any time, be removed from the assignment. The shift is between the hours of 6 A.M. and 10 P.M., scheduled according to the needs of the Huber inmates, and working a modified rotation including Monday through Friday work (see Process Server schedule). Though primary responsibility for this shift is the Huber population, it would also function as a shift filler for the scheduled hours. The Huber Deputy will receive twenty five cents (25¢ ) per hour in addition to the regular Corrections Officer II hourly rate. Add: Section 1H. - Court Services Deputy to read as follows: This is a special assignment in a separate classification. The Sheriff shall select the Court Services Deputies from among those Deputies who submit a letter of intent unless no Deputy submits such letter. The Deputy performing those tasks could, at any time, be reassigned back to their prior classification. Future Court Services Deputies will continue to accrue seniority in their classification while performing this assignment. Current Court Services Deputies (as of May 7, 2014) will not be removed except for just cause. Current Court Services Deputies (as of May 7, 2014) will use their Process Server or Court Officer classification seniority dates for determining time off per Section 10.08. Future Court Services Deputies will use their date of assignment when Section 10.08 is applied. 2 b. Section 4 (page 8 of CBA): Revise lines 22-23 as follows: This shall be done on a rotating seniority basis for employees who are available on a regular scheduled day off.. . Section 4 (page 8 of CBA): Revise lines 23-25 as follows: The County shall make a good faith effort to reach employees to offer the assignment; this shall constitute a telephone call to the _ _s r number desi nated crf by the employee... Section 4 (page 8 of CBA): Insert the following sentence in line 25: The shift will be awarded to the first employee that accepts the shift. 4. ARTICLE 9 - HOLIDAY PAY a. Section 9.01: Revise first sentence to read as follows: All employees except Process Servers, Security Officers assigned to the Government Center, and Court Officers covered by this Agreement shall receive ten (10) days eighty-five (85) hours pay as Holiday Pay on or before December 1 st of each year. b. Section 9.02 (pages 11-12 of CBA): Revise lines 26-30 (page 11) and lines 2-8 (page 12) as follows: Process Servers, Security Officers assigned to the Government Center, Court Services Deputies and Court Officers will not be scheduled to work on a holiday or day designated as the holiday. When the January 1 holiday falls on a weekend, the holiday will always be designated as the following Monday. Holiday pay of eight (8) straight time hours shall be paid to the Process Servers, Security Officers assigned to the Government Center, Court Services Deputies and Court Officers who do not work on the holiday or day designated as the holiday. The number of holidays shall be the same as those outlined in Paragraph A above. Any Process Server, Security Officers assigned to the Government Center, Court Services Deputies or Court Officer required to work on a holiday or designated holiday shall be paid at the employee's straight time hourly rate for the hours worked on the holiday, plus eight (8) straight time hours of employee's regular hourly rate of pay, for the holiday or designated holiday. In order to be eligible for holiday pay, regular full-time Process Servers, Security Officers assigned to the Government Center, Court Services Deputies and Court Officers must be in an in-pay 3 status the workday immediately preceding and the workday immediately following the holiday. 5. ARTICLE 11 - MEDICAL INSURANCE a. Section 1, remainder of language (page 16 of CBA): Delete as follows: Plan Option 2 (A-vailable 2010) Pharmaecuticals: 10. 00 per regular prescriptio $5.00 per FICSMiptioll $0.00 per mail-in preseriptio The in-network medical plan deductible is $1500 for singles and ffimilik"'3. The reference to surrogac in item 46 of Vf Exclusions will be eliminated. C. Section 5 Section 4: (renumbered due to elimination of Section 4): Revise to read as follows: The parties agree that the WPPA will continue to participate in the Health Insurance Advisory Committee. ARTICLE 20 - WAGES - JOB CLASSIFICATION (page 20 of CBA): Revise wage increases as follows: Effective January 1, 2013, 2012 wage rates are increased by two percent (2%) for all steps and classifications. Effective July 1, 2013, wage rates are increased by one percent (1%) for all steps and classifications. Effective January 1, 2014, wage rates are increased by two percent (2%) for all steps and classifications. ARTICLE 26 - EFFECTIVE DATE - DURATION - TERMINATION, Section 1(page 24 of CBA): Revise as follows: THIS AGREEMENT shall be in full force and effect from January 1, 201-1.2013, TO AND INCLUDING December 31, 20+2 2015, and shall continue in full force and effect from year to year thereafter unless written notice of desire to cancel or 5 terminate the Agreement is served by either party upon the other at least sixty (60) days prior to date of expiration. 11. EXHIBIT "A" - AUTOMOBILE STIPEND (page 26 of CBA): Revise by incorporating existing provision into ARTICLE 15 - AUTOMOBILES and by adding Court Services Deputies to the list of classifications. 12. EXHIBIT "B" - FILLING OF THE POSITION OF PRIMARY SERVICES DEPUTY (pages 27-29 of CBA): Revise by incorporating existing provision into ARTICLE 5 - SENIORITY, Section 4 - Qualifications. Also, revise Phase 2 - Interview (page 27 of CBA) by revising lines 30-31 as follows: Phase 2 - Interview: The top scoring applicants will be asked to participate in the interview process. The exact number of to scoring applicants will be based on the needs of the Department and the number of anticipated vacancies. 13. SIDELETTER "D" - ARBITRATOR SELECTION (page 34 of CBA): Delete Sideletter D in its entirety, as WERC changes have significantly affected the available pool of arbitrators. 18. SIDELETTER "E" - WELLNESS INCENTIVE PROGRAM: Renumber to Sideletter "A" and read as follows: The County will continue to, on a trial basis, provide a Health and Wellness incentive program to encourage officers to maintain good health and fitness. Up to $300 per year will be available for the purchase of an individual membership in a formal health and wellness program. This must be a legitimate, well-established business such as a gym or exercise club, YMCA, or hospital/clinic sponsored fitness program. If a couple/family membership is purchased, the employee is reimbursed the single rate only. The wellness incentive money can also be used to pay for health/fitness classes limited to the following activities: aerobics class, water aerobics class, swimming class, dance class, exercise class, smoking cessation class, or weight control class. The class(es) must be taught by a qualified instructor associated with a legitimate organization (exercise/fitness center, school district, community program, YMCA, etc). The County retains the right to accept or reject a request for reimbursement based upon the criteria noted herein. Receipts for the Wellness Incentive Program must be presented to the Sheriffs Department in December of each year for up to 12 months of services and not to exceed $300. The bill can be for a period of time inclusive of January 1 through December 31 of the payment year. An officer who is not in pay status in November when the bill is to be presented for payment, will receive -$0- payment for the year. An officer who starts in permanent status on or after February 1 of the year is not eligible to receive payment in that year. There is no pro-ration of payment for officers who work only a portion of the year. The payments will be authorized by the Sheriff and a reimbursement voucher check will be sent to the officer. 7 19. SIDELETTER "F" - DIRECT DEPOSIT/EQUALIZED PAY PERIODS (page 36 of CBA): Revise by incorporating existing provision into ARTICLE 20 - WAGES - JOB CLASSIFICATION and/or including the provision under a newly created Exhibit "A" - Wage Schedule (Law Enforcement Association Wage Grid). 20. SIDELETTER "H" - SERGEANT POSITIONS (pages 38-39 of CBA): a. Revise as follows: 1. Posting requirements and qualifications will be listed on patral sergeant andi-a+ primary services/corrections/court services sergeant job descriptions as follows: a. Jail Corrections Bureau Sergeant: Associates Degree in: a Wisconsin vocational or technical education district or its accredited equivalent from another state or a minimum of 60 fully accredited college level credits, eligible to be a jail- certified in state of Wisconsin. Must have 2 years experience as a St. Croix County Jail Corrections Deputy. Or any equivalent combination of experience and training which provides the required skills, knowledge, and abilities. b. Patrol Primary Services Sergeant: Associates Degree in: Criminal Justice, Law Enforcement, Sociology, or related field; minimum of 60 college level credit hours; bachelor's degree preferred. Must have 2 years experience as a Patrol Deputy in the St. Croix County Sheriff's Office. Or any equivalent combination of experience and training which provides the required skills, knowledge, and abilities. C. Court Services Sergeant: Associates Degree in: Criminal Justice, Law Enforcement, Sociology, or related field; minimum of 60 college level credit hours, bachelor's degree referred. Must have 2 years experience as a Court Services Deputy in the St. Croix County Sheriffs Office. Or any equivalent combination of experience and training which provides the required skills, knowledge, and abilities. 2. Sergeant Classification seniority will be established from the date of hire in respective patro it primary services/corrections/court 8 services classification. Thereafter, if new sergeants are appointed, seniority within the sergeant classification will prevail. 3. Personnel selected for the sergeant positions will be paid $2.00 an hour above the bargained rate of pay for patrol or eorreetions rip mare services/corrections/court services deputies with the same level of years of service. The $2.00 is fixed. 4. When open patrol primary services or corrections shifts are posted, respective sergeants may sign up, number of years (seniority) as a patrol primary services deputy/patrol primary services sergeant shall prevail for open patrol primary services shifts and for PTO requests. Corrections sergeants may sign up for open corrections shifts, number of years (seniority) as corrections deputy/corrections sergeant shall prevail when filling these shifts and for PTO requests. Sergeants will receive the $2.00 premium when filling normal patrol rip mars services or corrections shifts. 5. If a primary services or corrections sergeant shift is unfilled and posted as an overtime shift, patrol primary services or corrections deputies may sign up, however, they will not receive the $2.00 premium. 6. Employees selected to sergeant positions shall serve a sip (6) twelve U22 month probationary period. 7. If at any future time a jail corrections or patrol primary services sergeant should decide to give up his/her position as sergeant, accrued time as a sergeant shall count towards seniority in the patrol rip mars services or corrections classifications that they return to. b. Add revised Sideletter H to ARTICLE 5 - SENIORITY, Section 2 - Job Classifications. 21. SIDELETTER "I" - 6/4 WORK CYCLE (page 37 of CBA): Revise by incorporating existing provision into ARTICLE 6 - WORK WEEK - CALL-IN PAY - OVERTIME, Section 1 A. - Primary Service/Deputies. 22. SIDELETTER "B": Relabel Court Services Sergeant and read as follows: During the term of this Agreement, the Court Services Sergeant shall receive a Two Dollar ($2.00) per hour premium over their base wage. 9 23. WAGE SCHEDULE (page 40 of CBA): Revise wage grid line 8 as follows: Primary Services Deputy, Security Officer II, Process Server, Court Services Deputy 24. STATEMENT OF UNDERSTANDING - HEALTH REIMBURSEMENT ACCOUNT (HRA) (pages 41-42 of CBA): Delete Statement of Understanding in its entirety, under WERC ruling that HRA accounts are a prohibited subject of bargaining. 25. STATEMENT OF UNDERSTANDING - SICK LEAVE BANK CONVERSION - RETIREMENT HEALTH SAVINGS PLAN (page 43 of CBA): Delete Statement of Understanding in its entirety, as it has already been incorporated into ARTICLE 10 - PERSONAL, TIME OFF (PTO), Section 10:07. 26. REVISED MEMORANDUM OF UNDERSTANDING (pages 44-45 of CBA): Delete Memorandum of Understanding in its entirety, since: #1 will be revised under ARTICLE 6 - WORK WEEK - CALL-IN PAY - OVERTIME (work cycle). #2 is a mandatory subject of bargaining (health insurance premium contributions) #3,4 and 5 will be revised under ARTICLE 11 - MEDICAL INSURANCE (specific plan features/coverage levels and Health Insurance Advisory Committee) ST.
