Staff finds that the request meets the requirements of the St. Croix County Zoning Ordinance based on the following findings: 1. The proposed sign is affiliated with a commercial use that is legally allowed in the Commercial District; specifically, a chemical dependency treatment facility that was approved in 2008 special exception permit#SE0177; 2. The on-premise commercial sign will not face a state highway and therefore does not require a permit from the Wisconsin Dept. of Transportation; 3. The proposed sign will be a single-face panel and will not be illuminated; 4. The proposed free-standing sign will meet all required dimensional standards specified in 17.65.C.2 and the height and surface area restrictions in 17.65.D.2.d; 5. With conditions requiring compliance with all sign standards, including but not limited to the standards in Section 17.65 C. of the St. Croix County Zoning Ordinance, the purpose of the sign regulation and the spirit and intent of the Ordinance will be met. Approval of the land use permit is subject to the following conditions: 1. All signs must be constructed in accordance with the plans submitted and as provided in the conditions below. 2. Sign construction must commence within one year of the approval date of this letter and be substantially completed within two years, after which time the permit expires. Prior to expiration, the applicant may request extensions of up to six months from the Zoning Administrator. The total time granted for extensions shall not exceed one year. Prior to that we had a six-month moratorium in place on signs January—July. I didn't say that all cities, villages and towns were precluded from enacting sign ordinances. That is incorrect. The authority to regulate signs is regulated under two areas of state statute. Those signs within the right-of-way of a roadway are regulated by the jurisdiction with authority over the road, county roads— County, town roads—towns, city streets—city, state/federal highways—state. The authority to regulate signs outside the right-of-way resides, by state statute, under zoning authority. So each municipality with zoning authority has the authority to regulate signs within its jurisdiction. Cities and villages have their own zoning and regulate their own signs. The Town of Hudson has its own zoning and regulates it own signs. The County regulates signs in all towns under County zoning. What I said at the presentation was that the Town of Somerset was concerned about signs generated along the new expressway—outside the right-of-way -- and started to develop their own sign ordinance. When they asked us to review it, we discussed under what authority they would adopt a sign ordinance and it quickly became clear to them that they do not have the authority to adopt a sign ordinance because they are under County zoning. So they then wrote a letter to the St. Croix County Planning and Zoning Committee asking for changes to the sign section of the County zoning ordinance. Within three months the Committee made the sign ordinance rewrite a priority and started the process to develop and adopt a new sign ordinance, with extensive input from towns, residents and the sign industry. My point was that intergovernmental cooperation occurs within the regulatory process when the county and one or more towns work together to address issues. My other example was the Town of Kinnickinnic and the need to address an issue with existing houses and setbacks. The Town Chair, at that time, wrote a letter to the committee, obtained support from other towns, attended the Towns Association meeting and then presented the information to the Planning and Zoning Committee. The Committee when it saw the support for the change made it a priority and had staff work with the towns to develop and adopt language and the change was made within a few months.
