In answer to your letter of May 27 , 1975 .
In August 1969 , Mr . Arnold Biagini requested to build on a non-conform-
ing lot . At the time Mr. Biagini requested to build a summer cottage.
This permission was granted for a summer cottage with a setback of 60
feet from the centerline of C.T.H. "H The setback from water is 75
feet . I don' t know if you have ever walked over this property but if
you have you will notice that the lot would not be 200 feet due to high
water at times .
Lot size in St . Croix County is one acre minimum and all lake shore lots
shall have a 2 : 1 ratio in essence the lot would have to be 150 feet wide
by 300 feet deep , as of October 1972 .
When Mr. Biagini made his request , minimum lot size was 100 X 200 feet
or 20, 000 square feet .
Upon inspection of the Biagini property on June 2 , 1975 , the lot was
measured by my assistant and I. The lot size is as follows :
90 feet wide at road and 75 feet wide at the lake. The depth
of this lot from the center of the road is 152 feet for an
average of 12 , 540 square feet which is considerably less than
the 17 , 000 square feet quoted by you .
With these figures and with the 75 feet setback required from water and
the Board of Adjustment approval of building 60 feet from the centerline
of C . T.H. "H" , Mr . Biagini would be able to build a residence 17 feet
by 67 . 5 feet .
There could not be a conventional sanitary system on the property due
to elevations from high water mark. The only type system that could
be installed is a holding tank.

I noticed in your letter addressed to Mr. Atkins dated
,Tune 28th, 1974, that you made reference to a summer cottage in
the second paragraph. I realize that the limitation to build a
summer cottage was not a decision made by you but rather by the
Board of Adjustments, but perhaps you might have some insight
to their reasoning. My client is desirous of building a nice
home that he might utilize in the future as a year-around home.
I am sure the Board of Adjustments has a good reason for
preferring a summer cottage on this lot but I would like to
know what that reason is. If you know will you please advise me.
I wish to thank you for your giving this matter your
prompt attention and I shall await your reply.

Dear Mr. Barber:
Last week I sent to you a copy of my letter to Mr. Nelson
dated May 16th, 1975. I am enclosing herewith a copy of my second
letter to Mr. Nelson. I believe you have received a copy from
Mr. Nelson of his letter dated May 24th. Mr.Nelson suggests that
we contact you to answer our questions regarding the present status
of Mr. Biagini's lot as set out in our May 16th letter to Mr. Nelson.
As I understand it from your letter of October 14th, 1974,
addressed to attorney W. W. Ward, the Board of Adjustments has
decided that Mr. Biagini is eligible for a sanitary permit if he
agrees to install a holding tank or privy; abide by setbacks of
75 feet behind the high water mark and 60 feet from the road; and
submit building plans for approval.
I know of no reason why Mr. Biagini could not comply with
these requirements. My question is this: what else, if anything,
will be required of him in order to be entitled to a building permit?
Mr. Biagini wants to make certain that after complying with these
requirements and spending money for plans and attorney's fees and
other costs, that he does not find himself in a position where he
is denied a building permit because of an additional requirement
which he was not made aware of previously. I am sure you can
appreciate his concern.
I would like to impose on you for further information if
you don't mind. Mr. Biagini's lot has been referred to in several
letters as a non-conforming lot. I would like to have it explained
to me why it is non-conforming. It appears to me that the lake
frontage is in excess of 90 feet and the road frontage is 80 feet
with a lot depth of over 200 feet. The total area of the lot
exceeds 17,000 square feet. I am at a loss to understand what is
wrong with the lot for building purposes unless the high water mark
is less than 50 feet from the road. I can understand the problem
with the high water table but this can be solved with a holding tank.
Any help that you can give me in this regard will be greatly appreciated.

Dear Mr. Nelson:
This will acknowledge receipt of your letter dated
May 24th, 1975.
First, I wish to express my appreciation for your promptness
in replying to my letter. Secondly, I realize that you cannot issue
a building permit until the sanitary permit has been issued by the
Zoning Administrator. Mr. Barber's letter of October 14th, 1974,
advised us of the same requirements. According to his letter, the
Zoning Board would allow Mr. Biagini to build on the lot if he abides
by certain special requirements. These special requirements provide
for a holding tank; front and rear setbacks; and building plans.
I know of no reason why he cannot comply with the requirements.
If I understand Mr. Barber correctly, a sanitary permit will be issued
as soon as he complies. I am writing to Mr. Barber today to make
sure that I understand his letter of October 14th, 1974. I assurm that
if a sanitary permit is obtained, the town board would issue a building
permit. However, he would not want to go through the trouble of
obtaining a sanitary permit and then find out that a building permit
will be denied for other reasons. As soon as I receive a reply from
Mr. Barber, I will contact you again.

I believe Mr. Biagini purchased this lot prior to the
enactment of your local Zoning Ordinance. In doing so, he purchased
it upon reliance that he would be able to build on it. I believe
that this qualifies him for a nonconforming use. I do not wish to
make a lot of noise about legal issue unless the action of the
governing body is arbitrary, capricious or unreasonable. At this
time I would simply like to know what your community will allow my
client to do with his lot. If we are unhappy with your answer, we
will then delve into the question of legality and do whatever we
feel necessary. If you could give my request a little priority, I

Dear Mr. Nelson:
Our law firm represents Mr. Biagini with respect to his
real estate located on Cedar Lake.
On August 20, 1974, Mr. Biagini received a letter from you
in which his building permit was denied. Subsequent to that time,
Mr. Harold Barber, Zoning Administrator, wrote a letter to Mr. Biagini'a
attorney in Wisconsin, W. W. Ward, dated August 14, 1975 in which he
stated that the St. Croix County Zoning Office would issue a sanitary
permit if certain requirements were made. These requirements are
set out in that August 14th letter, of which you have a copy. We
interpret Mr. Barber's letter to mean that a building permit would
be issued if Mr. Biagini would do the things required by the Board of
Adjustments.
At this time, Mr. Biagini is uncertain of his position as to
whether or not he can build and what he will be able to build if
issued a permit. For this reason I am directing this inquiry to you
personally so that I might be assured a reasonably prompt reply.
If Mr. Biagini is permitted to build, he would like to do so during

permit, my next question is this: will he be restricted to building
only a summer cottage. It is Mr. Biagini's hope that he can build a
high grade year-around house. He does not intend to live in the year-
around at this time but he is thinking to do so in the future when
he will be retiring and would like to move to that site permanently.
It would seem to me that a well built year-around home would be a
better investment for Mr. Biagini and a greater asset for the adjacent
properties. It would command higher local taxes then a summer cottage
and its appearance obviously would more likely enhance the adjacent
land. Permanent homes generally have a better appearance than summer
cottages.

Enclosed please find a copy of my letter of September 4,
1974, written to Vern Nelson, Town. Chairman of Star
Prairie, and copies of other papers involving this property.
There is one letter from. you to Arnold Biagini dated
July 14, 1969, one to me from you dated June 7, 1971 , also
one from Vern Nelson to Arnold Biagini, one .from you to
Eugene Akins, and a copy now from Doar and Knowles to me
in which they say that until Arnold Biagini gets clearance
from you, they will not issue a building permit.
It seems as though the Town is trying to prevent this man
from using his lot, or selling it and that he is being
deprived of using his property, still he has to pay taxes
on it. What is your opinion on this and what does he have
to do in order to get a building permit. Thank you for

Dear Bill:
Apparently the county ordinance has been changed since
Harold Barber wrote his letter of July 1.4 , 1969 . If the
county zoning administrator will give a new permit under
the present existing ordinance, the Town of Star Prairie
will issue a building permit . However, they do not feel
that they are authorized to do so unless and until the
county gives its permission.
