CROIX COUNTY ZONING ORDINANCE. ) August 25, 1987 Location: SW 1/4 of the NW 1/4 of Section 5, ) T29N-Rl9W, Town of St . Joseph ) The St. Croix County Board of Adjustment conducted a public hearing on August 25, 1987, to consider the request of David Waldroff for a special exception use, Article 17 . 64 ( 5) (a) 3 Access .Driveway, ST. CROIX COUNTY ZONING ORDINANCE. The St. Croix County Board of Adjustment conducted an on- site inspection of the site in question. After inspection, the St. Croix County Board of Adjustment entered an executive session to discuss the request . After returning to open session, the following decision was rendered: Motion by Supervisor Kinney to approve a variance of 130 feet east of the existing driveway, center to center, or 80 ' from the common lot line . Culvert to be placed so as to prevent any possible ponding. Motion seconded by Supervisor Sweitzer . Motion to approve : Kinney, yes; Sweitzer, yes; Meinke, yes . Motion carried . All variances approved must be acted on or constructed within one ( 1 ) year from date of approval or they shall be null and void. a C" Edith Sweitzer, Secreta- ry St . Croix County Board of Adjustment ES :TN:rc David Waldroff St. Joseph Town Clerk MINUTES BOARD OF ADJUSTMENTS MEETING AND MINUTES August 25, 1987 Hearing called to order by Chairman Meinke at 9 : 00 A.M. in the County Board Room, Courthouse, Hudson. All members present . Motion by Supervisor Kinney to amend the July minutes so as to read that the meeting was called to order by Vice-Chairman Kinney. Motion carried . The next regular meeting will be September 22, 1987 . OLD BUSINESS: Harold Soderberg presented his request for a larger building for his horse arena that was originally requested . There was an expressed concern by the board that the timing of the erosion control structures and the building be coordinated so as to not create further problems . Collins-LaCrosse Sign: Bruce Cowell presented his requested that the board change their decision on the consolidation of signs for River 's Edge advertisement, allowing two separate signs, one advertising the restraunt; the other the campgound. The board indicated the sign ordinance was going to be reviewed this winter providing criteria on which to base approvals or denials for signs . Mrs. Stephen Gianoli presented her request to place additional fill for landscaping and erosion control purposes . This had not originally been requested, but is needed since the bluff has slumped since the project was completed . Hearings called to order by Chairman Meinke at 9 : 30 A.M. The Zoning Administrator, Tom Nelson, read the notice of the hearings as published in the local newspapers . Chairman Meinke explained the procedures of the hearing. 1 . ARTICLE: 17 . 15 ( 4 ) Side Yard Setback and 17 .15 ( 6 ) (m) Limited Commercial APPELLANT: Mr . & Mrs . Mark F. Wolf LOCATION: SE 1/4 of the SE 1/4 of Section 32, T28N-R19W, Town of Troy 4 . ARTICLE: 17 . 64 ( 1 ) (b) 2 Highway Setback & 17 . 64 ( 5) ( 1) 2 Access Driveway APPELLANT: M & M Storage Inc. LOCATION: NE 1/4 of the NE 1/4 and the SE 1/4 of the NE 1/4 of Section 21, T29N-R18W, Town of Warren 1 gSVId Wgidf8if : Mr . David Waldroff presented his request to be closer to an existing driveway on his proposed lot than 2001 . The reason for this location would be to enhance the safety of the access since there is a hill at the 200 ' mark and beyond . Mr. Mark Wolf : Mr . Mark Wolf presented his request for a variance to construct a garage that would be closer than 100 feet from the right of way line but further back than the existing residence, and only 3 ' for the side property line . He also requested a special exception use for a Barbershop in the basement of the residence . Mr . Dean Albert representing the township of Troy indicated the township had no problem with the requests . , M & M Storage, Inc. : The Zoning Administrator informed the board that M & M Storage, Inc. had requested their appeal be cancelled and monies be returned . Fred & Vivian Trautmiller : There was no one there to testify on behalf of this appeal . Hearings recessed for viewing the parcels in question. After viewing the sites, the board returned to session to render decisions . The following decisions were made : 1 . HAROLD SODERBERG: Motion by Supervisor Kinney to postpone for 30 days so that the erosion control structures can be installed . Motion seconded by Supervisor Sweitzer . Vote to approve postponement : Kinney, yes; Sweitzer, yes; Meinke, yes . Motion carried . 2 . STEPHEN GIANOLI : Motion by Supervisor Kinney recommending that the Soil Conservation Service or other professional engineer be contacted and assist on the design of the proposed fill areas along the bluff . The areas on the side of the house and toward the bluffside under the house to be permitted when the projects have been completed. Both the township and the Zoning Office ' should be contacted so as to check for compliance . Motion seconded by Supervisor Sweitzer . Motion to approve : Kinney, yes; Sweitzer, yes; Meinke, yes . Motion carried . 3. FRED & VIVIAN TRAUTMILLER: Motion by Supervisor Sweitzer to postpone for 30 days so that appellants can appear to present their request. Motion seconded by Supervisor Kinney. Motion to approve postponement : Kinney, yes; Sweitzer, yes; Meinke, yes . Motion carried . 4 . DAVID WALDROFF: Motion by Supervisor Kinney to approve a variance of 130 feet east of the existing driveway, center to center, or 80 ' from the common lot line . MARK WOLF: Motion by Supervisor Sweitzer to conditionally approve the garage setbacks and to approve the barbershop use contingent to state permit . The condition of the setback being that the neighbor, Gary Moelter, express in writing that he has no objection with the structure being 3 ' from the lot line . There shall also be followup inspections by the township and Zoning Office upon completion of the projects . The owner is to notify both agencies . Motion seconded by Supervisor Kinney. Motion to approve conditions : Kinney, yes; Sweitzer, yes; Meinke, yes . Motion carried . 6 . M & M STORAGE, INC. : Motion by Supervisor Kinney to reimburse monies left over after cost of publication has been satisfied . Motion seconded by Supervisor Sweitzer . Motion to approve partial reimbursement: Kinney, yes; Sweitzer, yes; Meinke, yes . Motion carried. Motion by Supevisor Kinney to read into the minutes the folowing statement : "The Board of Adjustments and Comprehensive Zoning, Parks & Planning Committee has heard some serious charges and allegations made by Mr . John Pfleider in regards to past violations by people in the Cove area and lack of enforcement of the Zoning Ordinance by past and present Zoning Administrators . By review of past actions of the Board of Adjustments and actual onsite investigations, we the present Board of Adjustments find his allegations to be without any foundation. Motion seconded by Supervisor Sweitzer . Motion to approve : Kinney, yes; Sweitzer yes; Meinke, yes . Motion carried . Motion by Supervisor Sweitzer to adjourn. Seconded by Supervisor Kinney.
