BOARD OF ADJUSTMENT HEARING
Hearing called to order by Chairman Afdahl at 10:00 A.M. All
members present.
Zoning Administrator Harold Barber read request of Mr. Charles
Slabis to build on a non-conforming lot which is less then 1 acre
in size. Mr. Slabis purchased the lot in 1968 and is unable to ac-
quire more land due to the state o-=ing land on three sides. The
lot would be of no value unless a home could be constructed on it.
Mr. Slabis ' lot is 160 X 270 or 43, 200 square feet.
Mr. Douglas Johnson represented Mr. & rIrs. Slabis on their
property. He stated that Mr. Slabis pi.rchased this parcel before
the county had the one acre parcel requirements. also the state
was asked if they would like to purchase the property and was
turned down as the state had no use for the land.

Chairman Afdahl informed Mr. Johnson and Mr. &Mrs. Slabis
that the board would inspect the property and the Zoning Adminis-
trator will inform them of the decision. Hearing adjourned in order
to make inspection.
After inspection of the Slabis property, a motion by Luckwaldt,
seconded by Holmes to grant the variance provided that physical con-
struction shall commence within one year from January 17 , 1975 or
this variance will be null and void. Motion approved with all mem-
bers voting affirmative.
Being no further business, a motion by Holmes, seconded by
Luckwaldt to adjourn. Motion carried.
Hearing adjourned at 3:00 P.M.

Re : Property of Charles G. Slabis
Dear Mr. Barber:
I need your advice and some information from your office concern-
ing the property of Charles G. Slabis .
Previously Mr. Slabis talked to you or a secretary with regard to
acquiring the necessary permits to build on the land described in
the copy of the abstract which I have included with this letter.
This is a one-acre parcel that Mr, Slabis bought in the Willow
River Park area, Apparently that land is zoned to require a mini-
mum of one acre for construction of a residence, Mr. Slabis
bought the land and thought it was a one-acre parcel . It was
later determined that the plat is possibly 360 square feet short
of being an acre.
Apparently you indicated that he would be denied any permit because
the lot was not a full acre. Mr. Slabis now wants to go forward and
appeal that decision. I have a standard form notice of appeal, but
am having difficulty filling it out.. I am disturbed that there has
been no formal rejection of any application made by him. Have you
specifically told him that any permit he applies for would be denied?
Is such a verbal transaction sufficient to form a basis for an appeal?
Could you please in writing indicate to us your determination that no
permits of any sort would be granted because the parcel was less than
one acre. I
Also, in addition to that letter, is it necessary to use the standard
form notice of appeal? Or should we file a formal request for a vari-
ance before this notice is used?
