Chairman Bradley explained the procedures of the hearing requesting that individuals wishing to testify sign their names and addresses in the front of the room. Supervisors Kinney, Stephens, Menter, Neuman and Bradley were all present. Staff included Tom Nelson, Zoning Administrator. Stephens made a notion to approve the minutes as written. Seconded by Neuman. Motion carried. OLD BUSINESS ROBERT O'BRIAN Nelson stated that his was a request for an extension of time for his filling and, grading permit which was issued one year ago. Motion by Stephens, seconded by Kinney to approve the extension for a one year period. Motion carried. RULES & BYLAWS There was a gene al discussion on the rules and bylaws that govern the Board of Ad j stment. He is now requesting an after the fact permit and variance to the setback. Bollom stated that he did not have a hardship other than the expense of moving the building. GEORGE SINCLEAR Nelson stated that Sinclear is requesting a special exception permit for a directional sign to his food stand on the Apple River. Marian Sinclear provided diagrams and pictures of the location and what the sign would look like. The township supports the proposal. MATHY CONSTRUCTION Dick Erickson presented a request for a temporary hotmix plant at the quarry in Springfield township. This is a special exception use limited up to 120 days and for Town, County or State projects. They are requesting four weeks beginning in mid August. ROBERT O'BRIAN Nelson stated that O'Brian was requesting the placement of directional signs f or a real estate development he owns. There would be three signs at different locations. O'Brian presented diagrams and pictures of the locations and what they would look like. THOMAS MEYER Nelson explained that a dog kennel is a special exception when located less than 700 feet from a residential property. Meyer presented diagrams and pictures of the facility as it exists. He purchased the property a year ago having moved from Indiana. At the time of the purchase he had been informed by his realtor that kennels were no a zoning issue and that his one had been permitted. it was just recently he discovered he was in violation of the land use ordinances and a permit was needed. He is requesting a permit for eight dogs that he will kennel for field trial and breeding purposes. there has been no neighbor objection and the town board supports the proposal. JOEL BLEKUM Nelson stated that it is a special exception use to reside in a temporary residence while construction of another residence takes place. Blekum stated he would like to live in his 17 foot yellowstone trailer until the residence is completed. The township supports the proposal. MCGRAW/BECKLIN Nelson stated that demolition land fills are a special exception by 1 county ordinance. Becklin presented the facility plans and diagrams showing the location and reclamation for a one time burial of the Baldwin school demolition. The township supports the proposal. PATRICK O'NALLEY Nelson stated that golf courses are a special exception by the land use ordinance, however, complete plans have not been submitted and O'Malley is not in attendance. Discussion. DAVID HUEHN Nelson stated that Huehn had been cited for a junkyard and was requesting a special exception permit for the Junk yard. Huehn stated that he was operating a car repair and body shop that had been there for years. Every spring excess cars are being hauled out. DELWIN PETERSON Nelson stated that placing riprap on the shores of the Apple River is a special exception use permit. Peterson shared plans with the Board of Adjustment showing the proposed project. THOMAS NENSING & SUZANNE BATES Robert Mudge, attorney for Mensing and Bates, presented plans for a deck reconstruction that showed a 10 foot encroachment on the bluffline of the St. Croix River. There is an architectural theme that is extremely important for this design. The hardship being to fulfill the overall theme of the property design. Nelson stated that he could not support the encroachment request since the hardship is self imposed and there is a reasonable use of the property. Both DNR and the township are also opposed to the encroachment. JOHN L. & STEVEN PETERSON Nelson stated that duplexes are permitted by a special exception permit in the Ag.-Residential district. Steve Peterson presented drawings showing the proposed duplexes. Dennis Tornio, the original developer of the lot and neighbor to the property stated that he had originally developed the property for single family residential use and was opposed to this request. Stuart Smith is building a house next door and is also opposed to this use. request. Motion carried. THOMAS MENSING & SUZANNE BATES Motion by Bradley, seconded by Kinney to deny the variance request since no hardship could be shown and a reasonable use of the property exists. Motion carried. JOHN L. AND STEVEN PETERSON Motion by Kinney, seconded by Bradley to deny the duplex special exception use permit. This use is not compatible in this residential setting. Stephens explained the procedures of the hearing requesting that individuals wishing to testify sign their names in the front of the room. Supervisors Menter, Neuman and Stephens were in attendance. Supervisors Bradley and Kinney had excused absences. Staff included Zoning Administrator, Tom Nelson. Motion by Menter, seconded by Neuman to approve the agenda as published. Motion carried. Motion by Neuman, seconded by Menter to approve the minutes as mailed. Motion carried. OLD BUSINESS ALAN BIGLOW Nelson stated that this was back before the Board because of several unanswered questions that came up after the site visit last month. One of these questions was how the original access permit was issued. Having checked with the County Highway Department, a permit was issued back in 1988 for access to C.T.H. "V" . The construction of this drive did not follow the private easement or access onto C.T.H. "V" perpendicularly as it should have. Now that this access is serving as a point access, there is the need to exceed the twenty-four (24) foot width standard. After a brief discussion it was agreed that it would be better to rehear and view this site at the May meeting when the snow is gone. At this same time someone representing the Highway Department should be in attendance to answer questions. At the conclusion of the hearing the Board of Adjustment visited each site in question. After these viewings the following decisions were made: RANDY BOLLOM Motion by Stephens, seconded by Neuman to deny the variance request. Construction Was done without building permits and compliant location exists on the property. Motion carried. GEORGE SINCLEAR Motion by Newman, seconded by Stephens to approve the directional sings providing state permits are obtained. Motion carried. MATHY CONSTRUCTION Motion by Menter, seconded by Stephens to approve the special exception use permit with the following conditions: 1) Hours of operation be from 6:00 A.M. to 6:00 P.M. ; 2) Project be limited to 60 days beginning in mid August; 3) Be for state, county or town projects only. Motion carried. ROBERT O'BRIAN Motion by Menter, seconded by Stephens to approve the directional signs fora two year period. Motion carried. THOMAS MEYER Motion by Kinney, seconded by Neuman to approve the kennel operation by eight dogs. this decision is not to go into effect for 30 days. Should any neighboring complaints arise. The permit granted was for a temporary occupancy permit in a trailer while Blekum constructed his house. Health problems, weather and unforeseen construction delays have slowed the construction. The township of St. Joseph supports the proposal. Motion by Menter, seconded by Neuman to grant a six (6) month extension for the temporary occupancy use permit of the trailer so construction can be continued. JOHN FOKER/MARC PUTMAN Nelson introduced the application stating that this was a three part request on property located along the St. Croix River. The first part is requested is to be able to replace the existing deck that has fallen into disrepair. Second, they would like to add a second deck at the top of the roof line for astronomy purposes. Third, they would like to install a drainage system for surface waters that would involve a fair amount of filling and grading. Marc Putman provided site plans, pictures, and a detailed outline of the proposed activities. Dave Hense, Supervisor for the town of Troy stated that this application has not been reviewed by the township as of this time and therefore no recommendations can be made. After some discussion it was decided to postpone any decision until the township could give a recommendation. DR. DONALD J. AND BETH ARVOLD Nelson stated that his request was a variance to reconstruct an entrance onto the Cylon Methodist Church building two (2) feet closer than the existing nonconforming structure. Dr. Don Arvold stated that there was need for this encroachment so as to provide a safer and separate entrance to the lower level of the building. The township of Cylon supports the proposal. DAVID AND SUSAN WILMES Nelson stated that this was a request for an after the fact special exception use permit for a duplex. The building has been constructed without a code complying septic system or the special exception use permit. A permit was recently obtained for the septic system. Susan Wilmes presented plans showing the design of the building and how it was located on the lot. There was a discussion on building and fire codes relating to duplex residences. The township of Somerset supports the duplex request. At the conclusion of the hearings, the Board visited the sites in question. Upon returning, the Board of Adjustment rendered the following decisions: DR. DONALD J. AND BETH ARVOLD Motion by Menter, seconded by Neuman to approve the two (2) foot variance as outlined on the plans. Motion carried. DAVID AND SUSAN WILMES Motion by Stephens, seconded by Neuman to conditionally approved the duplex based oft the following conditions: 1. Septic system to be installed as per code; 2. Staircase be constructed with proper risers and treads; 3. No storage of materials beneath stair case; 4. Smoke detectors be located beneath the ceiling tiles in kitchens, bedrooms and furnace room.
