Immediately upon completion of the paving,the applicant shall re-establish native groundcover over all disturbed areas. 7. Upon completion of the paving,the applicant shall submit to the Zoning Administrator photos of the finished driveway. 8. Upon completion of the construction,the applicant shall plant additional trees and shrubs as needed to substantially screen the driveway as viewed from the river from any direction during summer leaf-on conditions. This approval does not allow for any construction,grading,filling,or clearing of vegetation beyond the limits of this request. Please be advised that any structures including walkways, patios, stoops, steps, or additional pavers within the 40-foot bluffline setback will require that you apply for and obtain a variance. Your information will remain on file in the St. Croix County Planning and Zoning Department. Please contact the Town of Troy to obtain the necessary permits under their Riverway Ordinance for the proposed driveway. Approval of the land use permit is subject to the following conditions: 1. Prior to beginning any paving,the carport must be removed as required by the Wisconsin Department of Natural Resources and as required by Condition#4 of your special exception decision dated July 8, 2005. 2. Prior to beginning any paving,the applicant shall install erosion control measures as necessary. Please follow the steps in the publication,Erosion Control for Homebuilder. 3. The brick pavers shall be earth tone in color similar to the surroundings so as to comply with the scenic easement held by the Wisconsin Department of Natural Resources and not be visually conspicuous from the St. Croix River. 4. Storm water runoff from the driveway surface shall be diverted to a gravel infiltration buffer in between the new pavers and the existing pavers as recommended by the Wisconsin Department of Natural Resources. The landscaped area between the driveway and the bluff shall also be maintained to function as an additional infiltration buffer. I just received your request to review this application of Allen Taylor's to pave a portion of his driveway. There are 3 minor variations in the application and what was agreed to with Mr. Taylor on site as far as the scenic easement. 1. It was agreed that the 100 feet would provide some area at the bottom of the new pavers that would be gravel for more infiltration. The drawings show that these pavers continue to the existing pavers. 3 or 4 feet of gravel in between was agreed to allow more infiltration. 2. It should be mentioned that the pavers will be earthtone in color similar to the surroundings so as to comply with the easement and not be conspicuous from the river when leaves are off. 3. Allen, I spoke to Joe Renville re: your request. Joe said there is no conflict in paving a 13'x100'portion of the driveway as far as the easement, if the driveway was legally there at the time we purchased the easement rights. As you stated and have photograph to prove, the driveway was there at the time we purchased the easement. As we discussed you will leave an area of gravel to speed infiltration of runoff at the end of the paved area. The carport will be removed as discussed earlier before the paving in done. The purpose of the paving of drive is to prevent erosion on slope with present gravel. In effect you are changing a portion of the surface of the legal driveway from gravel to brick pavers. Pavers must be a earth tone color so as to blend with the surroundings and not be conspicuous from the riverway. You must still comply with all NR118, and local township and county zoning and other requirements. You mentioned the county requires an engineering study to insure that the project is in compliance with ordinances. Part of this driveway is a fairly steep incline and it continually washes out in a heave rain. The runoff will go to several large flat planted areas as shown in the survey map. We understand that as part of this project, Mr. Taylor wishes to place approximately 1,250 square feet of pavers over his existing gravel driveway. The following narrative and attachments address storm water runoff from the proposed pavers. To be conservative, the pavers were treated as an impervious surface although it is likely that some infiltration between the individual paver blocks will occur. Runoff from the paver area travels westerly through four separate landscaping areas. These landscape areas are contained by timber retaining walls, each which creates about 1" of ponding. These areas will act as "series" sediment removal from the runoff prior to reaching the infiltration area. The infiltration area consists of an existing grassed bench area also created by timber retaining walls. This large, nearly level area is contained on the river side by a timber wall that is approximately 4" high. To be conservative, only the portion of the bench area downhill from the proposed pavers was considered. The infiltration area should be inspected for performance, sediment accumulation and perimeter erosion on an annual basis for a minimum of five years after the infiltration of the pavers.
