CROIX COUNTY,WISCONSIN Case: SE0015 Applicant: Allen and Judith Taylor,property owners Complete Application Received: May 16,2005 Hearing Notice Publication: Weeks of June 6 and 13,2005 Hearing Date: June 23,2005 FINDINGS OF FACT AND CONCLUSIONS OF LAW Having heard all the testimony, considered the entire record herein, and reviewed the site, the Board finds the following facts: 1. The applicants are Allen and Judith Taylor,212 N Ilwaco Road,River Falls, WI 54022. 2. The site is located in the SW '/4 of the NW '/4 of Section 36, T28N, R20W, Town of Troy, St. Croix County,Wisconsin. 3. The applicants requested special exception permits for the following three items: Item #1" After-the-fact special exception request for filling and grading to install rock riprap for shoreline protection within the Lower St. Croix Riverway District pursuant to Section 17.36(6)(a)3. Item #2: After-the-fact special exception request for filling and grading to replace an old timber retaining wall and stairway with landscaping rock within the Lower St. Croix Riverway District pursuant to Section 17.36(5)(1). Item #3: Special exception permit for filling and grading to replace a rotten retaining wall and install rock for slope protection within the Lower St. Croix Riverway District pursuant to Section 17.36(5)(1). 4. The Land and Water Conservation Department did not object to the approval of these special exception requests. 5. The Wisconsin Department of Natural Resources (DNR) did not object to the approval of these special exception requests and has confirmed that the applicants are working with the DNR to meet their recommendations. 6. There was no public opposition to the special exception requests. 7. The spirit and intent of the Ordinance would be met by granting these special exception requests,and substantial justice would be done. 2 DF C ISTO ` On the basis of the above Findings of Fact, Conclusions of Law, and the record herein,the Board approved all three special exception permits,with the following conditions: item #1" 1. This after-the-fact special exception permit allows the applicant to keep rock riprap along the shoreline of the St. Croix River as installed and as indicated as "Project A" in the plans submitted on May 16,2005. Approval of this after-the-fact special exception permit does not include any additional rock riprap, filling and grading, or other structures not indicated in the plans. 2. The applicant shall allow native vegetation to reestablish itself on the rock riprap to retain the natural appearance and function of the shoreline. Item #2: 3. This after-the-fact special exception permit allows the applicant to keep landscape rock, stairs, and timber retaining wall segment along the lower driveway as installed and as indicated as"Project B"in the plans submitted on May 16, 2005. Approval of this after-the- fact special exception permit does not include any additional landscaping rock, filling and grading, or other structures not indicated in the plans. 4. Within six months of this approval,the applicant shall remove the carport overhang. Within the six-month timeframe,the applicant shall remove from the property all materials resulting from the demolition of overhang. These materials shall be disposed of in accordance with all local, State, and federal regulations. The area shall also be restored as near and practicable to the original conditions. 5. Within six months of approval,the applicant shall screen the wall with native vines and plantings to make it visually inconspicuous. Item # : 6. This special exception permit allows the applicant to replace rotten timber retaining wall segments and conduct filling and grading with rock along the upper driveway as indicated as "Project D"in the plans submitted on May 16, 2005. Approval of this special exception permit does not include any additional rock riprap, filling and grading,or other structures not indicated in the plans. 7. The applicant shall be responsible for implementing best management practices for erosion control during the filling and grading activities, and shall re-establish native groundcover immediately upon completion of the project. 8. The applicant shall have one (1)year from the issuance of the special exception permit to commence the project. If the special exception permit expires before construction commences,the applicant may request a time extension from the Zoning Administrator ahead of time or will be required to secure a new special exception permit before starting or completing construction on the project. 9. The applicant shall notify the Zoning Administrator at the start and the finish of the project. II 3 I i Conditions Applieahle to items 41-3• 10. Any minor change or addition to the project, including but not limited to design of the project, shall require review and approval by the Planning and Zoning Department and the Land and Water Conservation Department prior to making the change or addition. Any major change or addition to the originally approved plan will have to go through the special exception approval process. 11. These conditions may be amended or additional conditions may be added if unanticipated conditions arise that would affect the health and/or safety of citizens or degrade the natural resources of St. Croix County. Conditions will not be amended or added without notice to the applicant and an opportunity for a hearing. 12. Accepting this decision means that the applicant has read, understands, and agrees to all conditions of this decision. 13. The se requests area roved unless r pp ess the Town of Troy requests a reconsideration based on new information no later than July 18, 2005. The following vote was taken to approve all three special exception permits:Nelson,yes; Luckey,yes; Chairperson Speer,yes; Jensen,yes; Malick,yes. Motions passed unanimously. APPEAL RIGHTS Any person aggrieved by these decisions may file an appeal in St. Croix County circuit court within 30 days after the filing date shown below,pursuant to Sec. 59.694(l 0),Wisconsin Statutes. St. Croix County assumes no responsibility for action taken in reliance on this decision prior to the expiration of the appeal period. St. Croix County does not certify that the identity of all persons legally entitled to notice of the Board of Adjustment proceedings,which resulted in these decisions,was provided to the County. If an appeal is taken of these decisions,it is the responsibility of the appellant to submit at his/her expense a PP p ty PP p transcript of the Board of Adjustment proceedings to the circuit court.The Planning and Zoning Department can be contacted for information on how to obtain a transcript. It is the responsibility of the Board of Adjustment to submit its record(file)of this matter to the circuit court.
