715-386-4680 I am writing as a follow-up to my letter to you dated April 2, 2008. In that letter,I informed you
that your day cabin was a nonconforming use since the St. Croix County Zoning Ordinance
Land Information cXcr` does not currently allow secondary residences. Nonconforming uses in the Lower St. Croix
Planningf t::w, Riverway District cannot be expanded or enlarged pursuant to Section 17.36 1.1 of the
715-386-4674. ' Ordinance. Since I had not seen a site plan showing the location of the cabin on your property, 1
informed you that the cabin may also be a nonconforming structure if it does not meet current
Real P rry setbacks and dimensional standards. Nonconforming accessory structures in the Lower St.
715 -4677 Croix Riverway District can be maintained and repaired,but cannot be structurally altered,
R clang reconstructed, or expanded(except for non-habitable sheds and garages) pursuant to Section
-386-4675 17.36 I.3. of the Ordinance. After reviewing the scope of work proposed by Tony Fall of
Nordic Builders,I determined that all of the work, including repairing and replacing the
,..,,. footings of the cabin, constituted ordinary maintenance and repair and would be allowed
without a permit from the County.
I have since been in contact with the Wisconsin Department of Natural and received
confirmation that replacing footings is not considered ordinary maintenance and repair but
rather structural alteration of the foundation. Contrary to what 1 stated in my previous letter to
you,replacing footings on a nonconforming accessory structure used for habitation is not
allowed per Section 17.36 I.3.b.3) of the St. Croix County Zoning Ordinance. Repairing
footings may or may not be allowed depending on the extent of the repairs.
Please feel free to contact me with any questions. If you have a site plan showing the location of
the cabin and a full set of construction plans,I would be happy to meet with you to determine
what standards in the St. Croix County Zoning Ordinance apply. Please be advised that you
must meet both the County's and the Town's requirements to proceed with your project.

I would find it difficult to agree that replacing footings is not a structural component of the building you identify.
From my understanding, this structure has also been used for habitation? If it is an accessory structure and not a
garage or storage shed, only ordinary maintenance and repair can be done.
This accessory structure would need to be a garage or storage shed and meet NR 118.08 (3)(a-g) in order to be
allowed, by conditional use permit, to reconstruct the footings.

I didn't read any language pertaining to permits. It just says under NR 118.08(3)(a-d) Non
conforming accessory structures must meet those standards listed to be structurally
altered. The permitting appears to be up to you. I would recommend calling Pierce, Polk
or Pepin to see how they handle this.

Hi Dan and Carrie,
We have a property owner who wishes to replace siding, shingles, doors and windows, as well as
do some interior electrical work on a nonconforming accessory structure in the Riverway District, all
of which falls under maintenance and repair. No vertical or horizontal expansions or structural
alterations are planned; however, some of the footings may need to be repaired or replaced. Neither
NR 118 nor the SCC Zoning Ordinance specifies whether repairing or replacing footings on
accessory structures would fall under ordinary maintenance and repair, so we're looking for some
guidance. We did find that NR 118 and the SCC Zoning Ordinances state that the replacement or
structural alteration of the foundation of a principal structure is allowed with a land use permit, but
there is no similar language that pertains to accessory structures. Any thoughts?

conditions. Any change to the plans submitted by Nordic Builders will require prior review and
