Installation of a water line from well to cabin will require minimal excavation through areas 1)-4) previously graded for building foundation and driveway and will not be in a slope preservation zone(<12% slopes). Filling and grading on a portion of the driveway to an existing cabin has already been done to repair erosion and stormwater runoff damage that occurred earlier this year, but there is additional grading that may be needed to finish repairs. This will prevent additional erosion and sediment loss to the river. 17.36.H.8.a- Proposed vegetation removal of two(2)basswood trees and projects to repair/replace existing f steps and handrail were reviewed by Craig Thompson of WI DNR and CDD staff. These projects were approved as landscaping and/or allowable without zoning permits. DNR approved the removal of only the 2 trees that pose an imminent hazard to the principal structure. 17.36.J.1.a A complete Land Use Permit application was submitted on 6/23/14 with the $350 permit fee. Based on these findings, approval of the land use permit is subject to the following conditions: Compliance Conditions for land use permit approval Date Erosion control measures(sediment logs)will be installed between disturbed soil areas and slopes toward the St.Croix River during excavation for the water line. Disturbed soils adjacent to the driveway repairs must be stabilized with seed and mulch to establish a permanent vegetation cover.The applicant shall maintain all erosion and sediment control measures until permanent, self-sustaining cover is successfully established on all newly disturbed areas of the site, specifically over the waterline and alongside the driveway. No vegetation removal is approved beyond the two(2)basswood trees that are an imminent hazard to the cabin as indicated by DNR staff and as shown in the approved plans. Submit photo documentation after tree removal has been completed. Within 30 days of completing the approved projects,the applicant shall submit to the CDD photos of stabilization of disturbed areas for documentation of compliance with permit conditions. Removal of two basswood trees—the trees pose a safety hazard to persons or structures, namely the roof of the cabin. Therefore, they can be removed without a zoning permit per Section 17.36.F.1.a.3. No other trees or vegetation may be removed as part of this project. Existing vegetation surrounding the cabin is more than adequate and therefore we will not require planting replacement trees, which may not be successful due to the shade from the forest canopy. 5. Burying a waterline from well —the line from well to cabin will require minimal excavation through areas previously graded for building foundation and driveway and not in a slope preservation zone (<12% slopes). Your excavator should install a line of sediment logs along the west edge of the driveway until the water line trench is backfilled, then seed and mulch to stabilize exposed soil. This filling and grading in conjunction with the proposed additional erosion repair on the driveway/road are allowed with a land use permit per 17.36.H.5.a. 6. Driveway repair— Work has already been done by Todd Featherstone to apply gravel cover, but there is additional erosion/sediment control that may be needed to repair damage from stormwater runoff. Ilwaco Rd., Town of Troy Parcel #: 040-1168-40-000, Computer #: 35.28.20.641C Dear Mr. Thompson, Thank you for contacting this Department with your request for several maintenance and repair/replacement projects on the above property in the Lower St. Croix Riverway Overlay Zoning District. Kevin Grabau and I made a follow-up site visit on July 15th to determine what, if any, zoning permits might be necessary to accomplish the work you propose. Craig Thompson, WDNR District Land Program Manager, copied us on a letter that summarized the project list and offered his approval with some conditions for implementation. The CDD staff determination with regard to St. Croix County Riverway ordinance requirements is as follows: 1. Boathouse step replacement— stairways are allowed in slope preservation zones and have no structural setback to the Ordinary High Water Mark (OHWM) per 17.36.G.5.c. As long as the steps are replaced in the same location and same dimensions as before (no expansion of the existing stairway and no additional landings) and the new plastic boards are earth tone materials, no zoning permit is required. 2. Handrail replacement for steps down to beachfront— ordinary maintenance and repair of accessory structures such as stairways and handrails are allowed. The existing handrail just needs to be painted or stained same color as the stairs (earth tone colors). No zoning permit is required. 3. Replacement of existing limestone rock steps—we concur with Craig Thompson's requirement that the steps are not to be expanded in width and flagstone pavers may be used to maintain a non-erosive surface for the existing walkway from steps to cabin. A handrail may be added and must be of earth tone colored material. The existing rock steps act as a structural erosion control measure to maintain stability of the slope above the driveway and are visually inconspicuous from the river. Replacing the limestone rock with concrete will be acceptable for the small number of steps involved, but maintain existing vegetation and rock stabilization on either side of the steps. Erosion control may be simply applying seed and/or mulch for any exposed soil immediately after steps and pavers are installed. Boathouse Steps During the recent storms these steps have been torn off the deck and are floating in the river. Every year when the water is high in the spring these steps are partially underwater. The steps are part of the deck on the boathouse. The boathouse is a concrete structure from the early 1800s, which served to house the launch for the Ilwaco Springs Resort. Besides restoring the stairs, which are necessary to get from the deck to the south end of the beach, I would like to have them constructed of the new plastic boards so that rotting is not a continuing problem. These new products come in a variety of colors and I would choose an appropriate color as recommended by Mr. Wert. 2. Rock Steps to Cabin The steps to the cabin are rocks, like all the stairs on the property from the Resort era. They are irregular, have insufficient tread and rise. These 4 steps originally had a handrail for stability, but it became too wiggly to be of any use. As my friends and I get older(I'm 70) they have become a hazard. Many of us trip and fall on the steps. I propose pouring simple concrete steps in their place with a handrail fixed on the steps. Once up these steps there is a slanted dirt area about 15 ft. long to arrive at the wooden steps to the cabin. I propose putting 15 ft. of pavers along this dirt path (probably about 6). 3. Handrail to Beach The north end of the beach(which is about 100 ft. long) is accessed by climbing down some rocks. Again this climb is hazardous. Originally there was a handrail adjacent to the rocks, but this was destroyed in 2001 or 2002 when a large quantity of rip-rap was place in the area to stabilize the shoreline after a particularly high spring water. This rip- rap was placed pursuant to approvals by the County, State, and U.S. Corps of Engineers. I propose restoring the handrail alongside the rocks for something to hold onto when descending to the beach. I propose to have my son, Ben, an accomplished carpenter, do the repairs on #s 1,2,&3. They are large enough to do substantial damage to the cabin once they fall. They are on a fairly steep slope toward the cabin, so the likelihood is that they will fall downhill onto the cabin. These trees are essentially not visible from the river because they are directly behind the cabin. Also, their removal would not be noticeable in that I have probably the most densely wooded property along the river with many large trees, both deciduous and coniferous, in front of the cabin and all along the shore. Bury Waterline I have a pump in front of the cabin. The waterline is made of plastic. This material cannot be exposed to the sun, so we have an insulating material around it to protect it. The protective material is degrading. The plastic pipe is vulnerable to puncture in that it is on the surface. Also, the plastic doesn't drain properly in the fall and often I have to replace breaks in the lines in the spring. The plastic pipe runs in the air and along the ground into the doorway of the basement and then is tacked to the walls of the basement running to the water pressure tank. This means of getting fresh water into the cabin seems to present clean drinking water issues. I propose to have Hoyer Bros Well Drilling and Pump Repair bury the waterline from the pump into the basement where it will again connect to the water pressure tank. Fix road The road requires maintenance every few years as required because of erosion and more substantial maintenance every decade. The more substantial work is necessary to replenish the gravel so the road is stable and does not become muddy and more susceptible to erosion. The road is about 1/2 mile long and serves three families, to wit: Rolle, Thompson and Lundgren. 2 This year I planned on the more substantial maintenance, but before the work could be permitted and done, the downpour rains began. In response I hired our usual excavator who found that a culvert had become blocked causing all the water from the field above the road to run down the road. This resulted in large dangerous nits in the road. The excavator unclogged the culvert, repaired the worst of the ruts and erosion and placed gravel placed in this area. Therefore, the top 20% of the road is safe and the bottom 80% needs additional gravel, and grading. Without the additional gravel and grading (with any appropriate vegetation) the road will be too muddy to be functional. I propose to have Featherstone Exc, Inc. complete the work.
