Staff conducted an on-site inspection of the area on 10/17/14 and determined that the proposed project is necessary and meets the spirit and intent of the St. Croix County Riverway ordinance based on the following findings: Code Proposed Project Standards&Requirements References 17.36.F.2.a.5) Installation of stone rip rap will require minimal disturbance of soil at the base of a slope preservation zone and above the river's OHWM of 680'. This project will repair existing undercutting of the slope and prevent additional erosion and sediment loss to the river. CDD staff inspected the proposed location for installation of rip rap and found that several mature trees(pines,oaks, and cottonwoods)are currently at risk due to soil erosion around their bases and exposed roots. The rip rap will stabilize the toe and lower portion of the slope down to the beach area and provide anchoring to preserve this mature shoreline vegetation. 17.36.H.6.a.1)- Performance standards for rip rap and Shoreland protection: CDD staff determined that rip rap 6) is necessary to prevent erosion, especially during high water periods. The rip rap placement will be done by hand and will require some minor excavation to prepare for laying filter fabric underneath the stone. Existing vegetation on the shoreline will be maintained as much as possible and no tree removal is proposed as part of this project. 17.36.H.6.b The ordinance requires the landowner to record an affidavit for maintenance of the rip rap. A form will be enclosed for completion and submittal to the Register of Deeds office for recording. 17.36.J.1.a A complete Land Use Permit application was submitted on 6/23/14 with the$350 p ermit fee. Based on these findings, approval of the land use permit is subject to the following conditions: Compliance Conditions for land use permit approval: Dates: Notify the CDD when the affidavit has been submitted to the register of deeds for recording,prior to beginning excavation and rip rap placement. Please arrange for a copy to be given to CDD for inclusion in the permit file. No vegetation removal is approved other than necessary to shape area for filter fabric and rip rap placement as shown in the approved plans. Any bare soil on the slope above the rip rap shall be stabilized with native seed mix and/or native species plantings.
