Dear Mr. Jewell:
After reviewing your variance request with Greg Timmerman, St. Croix County Corporation Counsel,staff
found that you do not need a variance from the County's road setback requirements to reconstruct your
house, instead a County land use permit per Section 17.63 (7) is required. The Board of Adjustment fee
will be refunded,you can expect the refund in a couple of weeks. You are not required to attend the St.
Croix County Board of Adjustment on May 27`x'.
Pursuant to Section 17.63 (7),you are required to apply for a land use permit for the reconstruction project.
If the application is found complete and the project complies with the ordinance; a land use permit will be
issued by the Zoning Department.
As part of the county(land use) permit review process please provide the following information:
1. An area map showing exact setbacks of adjacent dwellings from the right-of-way within 150 feet
of the proposed building envelope. The map must contain all road right-of-ways, road names and
highway centerlines.
2. Provide documentation on the year the adjacent dwellings were constructed.
Please contact Dwight Farnham, Deputy Zoning Administrator at 715-549-5203 to inquire about obtaining
the necessary building permits for the project from the Town.

Applications will not be accepted until the applicant has met with department staff to review the application and
determine if all necessary information has been provided. A hearing will be scheduled after the pre-application meeting is
conducted and the application is deemed complete. A complete application must include,at a minimum,the items listed
below;additional information may be needed(see reverse). The application deadline is the 15th of each month.The hearing

❑ A complete site plan showing at a minimum the location of all existing structures,specific project location in the
town,all proposed structures, location of septic system,well;-driveway,property,lines;navigable water ways,
wetlands,floodplains,blufflines,slopes in excess of 20%,and any other unique limiting condition of the
/property. (See reverse for additional information)
o The name and mailing address of all owners of property that adjoins the parcel that is the subject of the request.
You must contact the Town to coordinate a recommendation on your application, before the County public
hearing. The County will forward your application to the respective Town. You may be asked to attend a Town
meeting to discuss your application. The Town may make a recommendation to the County on or before the
public hearing date.

Variance Request:
An area variance is being requested for the property of Kenneth A. Jewell located in St.
Croix county, lot 3, block 5, village of Houlton.
On the above stated property Mr. Jewell would like to replace his existing single family
dwelling with a new single family dwelling.
The request is to have the new dwelling be 34'- 6" from the edge of the road compared to
the existing location which is 32'- 6" from the edge of the road.
The arguments for the proposed location are:
• The dwelling can not meet the class"E" setbacks of 108'-0" from the centerline
of road. The existing road has a 14 foot asphalt width(7'- 0" from the centerline
to edge). The property stakes are approximately 5 feet from the edge of the road.
The length of the lot is 132'- 0". The proposed length of the dwelling is 44'-0".
The following calculation determines where the setback is on the property:
108'- 0" (Setback requirement)
- 7'-0" (Centerline of road to edge of road)
- 5'-0" (Edge of road to Property line)
96'- 0" (Edge of property to setback requirement)
The following calculation determines the available length the dwelling can be:
132'- 0" (Length of lot)
- 96'-0" (Edge of property to setback requirement)
- 10'-0" (Edge of property to building)
26'-0" (Length available for dwelling)
Conclusion: The dwelling exceeds the property line by 18'- 0"
26'- 0" (Length available for dwelling)
-44'- 0" (Proposed length of dwelling)
- 181- 0" (Shortage)
• The dwelling is located on a dead end street that has no potential to become a
throughput street.
• The width of the road could not be increased without affecting several of the
dwellings on Church Street.
