WI 54082 RE: Land-Use Permit Application (04LU05) i Dear Mr. Jewell: I This letter confirms zoning approval according to the plans you submitted to the Zoning Office to replace your existing single family dwelling with a new single family dwelling at 28 Church Street, Houlton, Wisconsin. Please find enclosed an administrative land use permit for your project. This permit allows you to complete the project as submitted. This permit has been issued with the following conditions: • The new dwelling must be constructed a minimum 43-feet from the centerline of Church Street per Section 17.63 (7) of the St. Croix County Zoning Ordinance. • Notify the Zoning Office 3 days prior to the commencement of the project. • Contact the Zoning Office upon completion of the project to schedule a final site visit to verify compliance with this approval. • Permit is valid for one year from the issuance date. • Obtain a Sanitary permit for the POWTS from the Zoning Department prior to obtaining a building permit from the Town of St. Joseph. • Obtain a town-building permit prior to the commencement of the project. Please contact Dwight Farnham, Deputy Zoning Administrator at 715-549-5203 to -obtain the necessary building permits for the project. • Submit photos of the final construction to the Zoning Office. The plans as submitted are found to be in compliance with the provisions of the St. Croix County Zoning Ordinance. Staff finds that the project meets the spirit and intent of the St. Croix County Zoning Ordinance for the following reasons: Single-family dwellings are a permitted use in the Ag. Residential District. ?. This request is consistent with Section 17.63 (7), which allows the setback averaging. 3. The new dwelling will be 5 feet further away from Church Street than the existing dwelling. 4. The dwelling's height conforms to the height requirements of the District. 5. The dwelling complies with County's side yard setback requirements. 6. The approval of this project will not affect the public health, safety and welfare of the residents of St. Croix County. 7. There is an established pattern of development within the Houlton. This community's infrastructure was in place before the adoption of County's ordinances. 8. This approval will not change the character of the neighborhood. 9. As a result of the reconstruction project, the existing Private Onsite Wastewater Treatment System (POWTS)will be replaced with a new code compliant POWTS. If the scope of the project changes, please contact the Zoning Office immediately so we can assess the project to ascertain if additional zoning permits or approvals are necessary. May 2, 2004 St. Croix County Land Use Permit Application: A land use permit is being requested for the property of Kenneth A. Jewell located in St. Croix county, lot 3, block 5, village of Houlton. On the above stated property Mr. Jewell would like to replace his existing single family dwelling with a new single family dwelling. Based on the Zoning Code Subchapther VI 17.63 (7) Structures permitted within setback lines Mr. Jewell would like to request is to have the new dwelling be 43'- 0" from the Centerline of the road compared to the existing location which is 39'- 5" from the edge of .i the road. The arguments for the proposed location are: The following calculation determines average of the existing neighboring buildings: (From the centerline of the road to the edge of building) The Jewell building is 39'-5" from the centerline of the road. The following shows the average of the Reese and the Johnston buildings located on the west and east sides of the Jewell property. 34'- 6" West building-Reese + 51'- 6" East building-Johnston 862- 011 86'-0" = 43'-0" Average setback from the centerline of the road to the edge of 2 the building. CROIX COUNTY GOVERNMENT CENTER -=- 1101 Carmichael Road Hudson, WI 54016-7710 (715) 386-4680 • Fax (715) 386-4686 May 3, 2004 Kenneth Jewell 28 Church Street Houlton, WI 54082 RE: Variance Application dated 3/23/04 Dear Mr. Jewell: After reviewing your variance request with Greg Timmerman, St. Croix County Corporation Counsel,staff found that you do not need a variance from the County's road setback requirements to reconstruct your house, instead a County land use permit per Section 17.63 (7) is required. The Board of Adjustment fee will be refunded,you can expect the refund in a couple of weeks. You are not required to attend the St. Croix County Board of Adjustment on May 27`x'. Pursuant to Section 17.63 (7),you are required to apply for a land use permit for the reconstruction project. If the application is found complete and the project complies with the ordinance; a land use permit will be issued by the Zoning Department. As part of the county(land use)permit review process please provide the following information: 1. An area map showing exact setbacks of adjacent dwellings from the right-of-way within 150 feet of the proposed building envelope. The map must contain all road right-of-ways, road names and highway centerlines. 2. Provide documentation on the year the adjacent dwellings were constructed.
