Location: SE14 of SEA & ) Gov't. Lot #5, T30N-R20W, Town of St. Joseph. ) The St. Croix County Board of Adjustment conducted a public hearing on April 24,. 1984 to consider the request of Edward T. Johnston for a special ex- ception use, Article 3. 12 G (GG) , Dock Placement, St. Croix Riverway District, ST. CROIX COUNTY ZONING ORDINANCE. The St. Croix County Board of Adjustment conducted an on site inspection of the site in question. After inspection, the St. Croix County Board of Adjustment entered an Executive Session to discuss the request. After returning to open session, the following decision was rendered: Motion by Supervisor Stephens to approve the request for a dock on the St. Croix River upon receipt of written approval of the U.S. Corps of Engineers, and receipt of a building permit for a house on the property; a written guarantee that the dock will be removed after the boating season, and approval from D.N.R and M.W.B.A.C. Zoning Administrator to inspect upon completion. Seconded by Supervisor Meinke. Motion carried. George, yes; Stephens, yes; Meinke, yes. All variance's approved must be acted on or constructed within one (1) year from date of approval or they shall be null and void. Mr*s. Paul Germain presented their request to construct an addition to their present house that would not be closer to the road than their present home. 6. Mr. Terrence Barrette presented their request to construct an addition to their present house and garage that would be 128 feet from the centerline of CTH "V". Questions by members of the Board. 7. Mr. Robert Raleigh presented the request of Alice, Inc. to construct a foot bridge ;ind rip rap the shore of the Apple River. Board went into executive session and returned to open session to render the following decisions: 1 . c,rc-.e,_ory tiu ert: Motion by Supervisor Stephens to grant a 100 foot setback from Chipman Road to accommodate the hill on the property. Seconded by Supervisor George. Motion carried. Vote to approve: Meinke, yes; George, yes; Stephens, yes. 2. Village of Baldwin: Motion by Supervisor George to grant approval in order to accom- modate present sewage treatment plant and its addition. It presents little future interference with county highway. Seconded by Supervisor Stephens. Motion carried. Vote to approve: George, yes; Stephens, yc .., Meinke, yes. 3. Edward T. Johnston: Motion by Supervisor Stephens to approve the request for a dock on the St. Croix River upon receipt of written approval of the U. S. Mr. Gregory Huppert presented his request to construct a house that would be 100 feet from the centerline of a town road. A hill restricts the 133 .foot setback. Mr. Louis Huppert owner of the property, has no objections. 2. Al Berg, Consulting Engineer for the Village of Baldwin,explained the reason for the requested variance. Questions by members of the Board. 3. Edward T. Johnston (Richard G. Frietag) presented the request of Mr. Johnston to have a dock on the St. Croix River. Approval has not been received from the U. S. Corps of ,Engineers. Mr. Steve Johnson, M.W.B.A.C. , encourages consolidation of slips on she river. Docks not be constructed until the houses are construe .,d. Docks shall be removed at the end of each season. Mr. Jake Vander Voort, DNk, stated th,it the docks not be constructed until houses have been built. 4. Mr. David Black presented the request to have a feed lot on his parcel of approx- imately eight (8) acres. The description is on the enclosed ' certified survey map located in Government Lot 1 of Section 34 and also in the ,{q SE-14 of the SF4 and Government Lot 5 of Section 27, T30N, R20W, rfown of St. Joseph, St. Croix Cuunty, Wisconsin. Also enclosed is a l �tion ruap,��ictures and so forth. _ I have received approval from St. Joseph's Township and St. Croix County for our lift to the. docks, which is shown on our lift line profile. I have also had �. communication with Dan Koich with the Wisconsin Department of Natural Resources. He has informed me that the type of system we are using, where the docks will be floated away each fall and put back into place in the spring of the year by using the methods of drop spud anchors, will not be necessary for a permit from the Wisconsin Department of Natural Resources for the docking sv, tem. We have presently made application to St. Croix County for a special exception use permit. The reason for our special exception use permit is we are proposing a common use of one lift and four slips for four sites. The lift and sites will become part of the deeds for the four sites and the four owners will be under a special use covenants and assessed on a yearly basis for cost and maintenance of the liftb and boat slips. Under the owners covenants, the slips will be restricted to the use of the owners for pleasure craft in the range of twenty to forty feet and, as enclosed, the dock specifications are designed to facilitate this. The only facility on the dock will be for electric. There will be no necessity for any `redging or fill materials. In ply conversations with Tom Nelson at St. Croix CouIicy and also with the Wisconsin Department of Natural Resources, they favor the idea of one lift and one docking system versus four lifts and four individual docks. I would like to have you take special notice that the extention of the docking system, from the shoreline out into the water, is adjustable and would only be extended out as far as would be necessary in order for the pleasure craft to maintain the proper draft.
