your application that you are constructing a house and garage at this location.
Staff finds that the proposal to construct the house and garage at this location meets the spirit and intent of the
St.Croix County Zoning Ordinance for the following reasons:
1. The proposed house and garage meets the Class E roadway setbacks(83 feet from the centerline or 50 feet
from the right-of-way,which ever is greater)as shown on the map of survey. You should verify the town
setback requirements when applying for the building permit.
2. Harvey Johnson,licensed surveyor,flagged and staked the bluff line and house location.
3. On March 13,2001,zoning staff verified the bluff line and side yard setbacks as staked by the surveyor.
4. Single-family homes are permitted in the Lower St.Croix River Way District.
5. The resulting construction will not take place on slopes greater than 12%.
6. The height of the structure will be 25-feet as measured from the lowest exposed foundation to the peak.
7. The exterior will be an earth tone color(The exterior will be Weather wood-grayish-brown).
8. You have filed an application for building permit review with the Zoning Office. By signing the
application,you are agreeing to complete the project as submitted.
A copy of your application will remain on file in the Zoning Office.THIS APPROVAL ONLY VERIFIES

Meeting of December 27 , 1977 , called to order by Chairman Luckwaldt
at 10 : 10 a.m.

Hearing called to order by Chairman Luckwaldt at 10 :15 a.m. All
i
members present at roll call.
Zoning Administrator read notice of hearing as published in the
County Newspaper on December 8 and 15 , 1977.
Zoning Administrator read request of Mr. Wallace Cudd to build
a ;am ily room and deck onto his existing house that would not meet the 75
foot setback requirements of the Zoning Ordinance.
Mr. Cudd presented his request to build an addition for a family
room and a deck approximately 60 feet from the shoreline of Bass Lake
in St. Joseph Township, Mr. Cudd stated that he could not build to the
i east as the septic system was located in that area also the hill and bank
on either side of the house.
Questions were asked by the Board members .
Chairman Luckwaldt informed Mr. Cudd that the Board would inspect the
property and the Zoning Administrator would notify him of the decision.
Zoning Administrator read the request of Mr. Lavern Anderson to
construct a lift that would run from the top of the bluff to the St. Croix
River. This is a variance of NR 118 .05(3) . The lift would effect up to
10 homes in the St. Croix Riverway District. He stated that there would be
less erosion of the bluff and the lift would not be visible from the St.
Croix River except for possibly the top 100 feet.
Mr. Steve Johnson of the Minn-Wis Boundary Area Commission feels
that the request of Mr. Anderson is reasonable and would not destroy the
beauty of the River. He also stated that Minn. permits this type. He
stated that it is not a permitted use in NR 118 nor is it in the special
exception of 3 . 10.4(c) (3) of the ST. CROIX COUNTY RIVERWAYORDINANCE.
Mr. Al Santala agrees with Mr. Johnson that the request is reasonable
but is not permitted in NR 118 at this time. Mr. Santala informed the Board
that there well be some meetings and there will be some changes in NR 118
and this would possibly be one of the changes . The changes could be
forthcoming in the spring or summer of 1978 .
After discussing the possibilities of the changes , a motion by Supv.
Pierson to table the request of Mr. Anderson until June, 1978. Seconded by
Supv. Afdahl, motion carried.
Motion by Supv. Pierson to adjourn hearing in order to make the field .
inspection. Seconded by Supv. Afdahl, motion carried.
After inspection of the Wallace Cudt�
P property, the Board of Adjustment
went into an executive session.
Executive Session December 27 , 1977
Motion by Supv. Afdahl to deny the request of Mr. Wallace Cudd to
construct a family room and deck closer than 75 feet from the shoreline of
Bass Lake as permitted in the St. Croix County Zoning Ordinance. The
property is located in the NWT of the NEk of section 26, T30N-R19W, Town
of St. Y Joseph. Seconded b Supv. Pierson, motion carried.
